CORRECTION TO MY EARLIER POSTS - PRODUCT: Nigerian Light Crude Oil QUALITY: NNPC Export standard QUANTITY: 10,000,000 Barrels, Bonny Light Crude Oil in lots of 2,000,000 Barrels per shipment. VESSEL: TBA PERIOD: 12 Months with Possible Roll Over and Extension PAYMENT BY : RDLC DISCOUNT: US$8.00 FIXED DISCOUNT BELOW PLATTS: $7.00 TO BUYER, $1.00 COMMISSION TO AGENTS/FACILITATORS TRANSACTION:CIF xxxxxxxxx PERFOMANCE BOND: 2% SUPPLIER NNPC PROCEDURES: 1. Seller issues SPA contract for the full term of product delivery (12 months plus any additional time to complete final delivery) and presents NNPC confirmation Letter of Authorization to sell excess crude allocation as Proof of Product availability to sell under Seller’s name. 2. The Buyer signs and seals the contract and returns to Seller. Buyer’s Bank sends RWA via SWIFT to show Buyer’s readiness and intent. 3. Upon exchange of the fully executed contract the Buyer will have his bank issue an inoperative RDLC via SWIFT to the Seller’s bank in favor of the Seller forthe term of the contract, to be activated by Seller’s 2% Performance Bond and funded for one month’s delivery. Operative for security only and will not bedrawn down unless MT103 payment is not received in accordance with contract terms. All documentation will be deposited into the Buyer’s Trust EscrowAttorney’s Bank account with bank instruments transferred to the account via SWIFT. 4. With all of the required documentation inclusive of contract and the Buyer’s POD data with Tank Farm and on shore Tank Storage details and the bankinstruments on deposit in the Trust Escrow Bank Account the Seller will have the keyboard terminal programmed and scheduled for the first lifting. 5. Upon the vessel being loaded, Seller will issue a Pro Forma Invoice based on the price of the agreed discount off of the daily Brent Platt and the Load MeterReading. 6. The Pro Forma Invoice will include all of the Loading Documents, SGS report, Bill of Lading, and the Ship Masters’ copies of all loading and export docs. 7. Upon setting sail, Seller’s Ship Masters will be instructed to send a Q88 to Buyer’s POD, to the Buyer's contact and to the Seller. 8. The Ship Masters will repeat the sending or the Q88 update at three (3) days, two (2) days, one (1) day and then 12 hours out of the POD. 9. The payment process, to be completed via SWIFT MT103 Bank to Bank issued against the Commercial Invoice, will be initiated by the SWIFT MT 103 PreAdvice issued against the Pro Forma Invoice, in exchange for Title Transfer. The MT103 Pre Advice must be received by the Seller’s bank and on deposit in theTrust Escrow Account within five (5) days after receipt of the Pro Forma Invoice. 10. Upon completion of each discharge there will be a new SGS report issued with the Q & Q of the out turned barrel (BBL) count which will be used to recalculate the Commercial Invoice Price for the payment due. This invoice will include copies of the discharge SGS report, all other discharge documents (as required), and Deed of Ownership if not provided earlier. 11. All payments will be made bank to bank to the Seller’s nominated banks as stipulated in the Commercial Invoice. Upon completion of discharge, andwith all documents and bank instruments on deposit in the Buyer’s Trust Escrow Account the MT 103 funds are released and documents transferred as required.
