The Federal High Court has declared as unlawful
the defection of 53 lawmakers in the National
Assembly to other political parties.


Delivering the judgement today, Justice Okon
Abang held that based on the judgement of the
Supreme Court, which gave reasons that would
allow for defection, the lawmakers did not meet
that requirement.

The judgement followed a suit filed by the Legal
Defence Assistance Project (LEDAP), challenging
the defection of the Senate President Dr Bukola
Saraki, the Speaker of the House of
Representatives, Yakubu Dogara and 51 other
lawmakers and Senator Godswill Akpabio.


LEDAP had asked the court to order the
lawmakers to vacate their seats in the National
Assembly and return all salaries and allowances
earned since their defection, arguing that the
lawmakers defected from their political parties for
selfish reasons other than division in their parties
as prescribed by law.

But in the case of Senator Godswill Akpabio,
Justice Abang held that he did not violate the law
because he neither decamped nor defected to the
All Progressives Congress (APC) with the facts
before the court.

The court had on Monday, granted leave to the
senator to file an application challenging the suit
by LEDAP, saying that there is no evidence before
it that he was personally served, since the suit is
not a class act against the Senate.

It is really shameful that most of our youth don't really read. Akpabio has always said 'he moved' to APC. He neither 'defected nor decamped'. The law understands 'decamp and defection' but NOT 'move'.

No one has said how Buhari’s coup 30+ years ago was illegal but see dem talking about decamping as if Buhari did not decamp to run for office in different parties over 12 years

Defection: Court strikes out suit seeking sack of Saraki, Dogara, 52 other lawmakers



A civic group had asked that their seats be declared vacant due to their defection from the parties on whose platforms they were elected.

The group, Legal Defence and Assistance Project (LEDAP), had on September 14, 2018, asked the Federal High Court to order that the members of the National Assembly who defected should vacate their seats.

In July 2018, 37 members of the House of Representatives defected from the All Progressives Congress (APC). About 32 of them joined the Peoples Democratic Party (PDP), four joined the African Democratic Congress (ADC) while one did not announce his new party at the time.


On the same day, 14 APC senators defected to the PDP.

Meanwhile, being part of the defendants, Mr Saraki and Speaker of the House of Representatives, Yakubu Dogara, in their response asked the court to dismiss the suit filed by the group on grounds that it is an abuse of court process.

The duo added that the suit lacked merit.

The defendants had submitted that the plaintiff has no ‘locus standi’ to institute the case.

Delivering judgement on Friday, the judge, Okon Abang, held that “the plaintiff’s case has merit but lacks locus standi to institute the case.”

“The plaintiff that instituted this case is not a political party that sponsored the election of the lawmakers.

“Also the plaintiff is not Independent National Electoral Commission(INEC) that regulates the activities of political parties and monitor elections.

“The plaintiff is not a registered voter in Nigeria.

“They are not members of the National Assembly.”

“None of the political party that sponsored the lawmakers is a party in this case.”

“They, therefore, lack the capacity, legal power to institute the case.

“The plaintiff’s case is incompetent and thereby struck out,” Mr Abang ruled.

Justice Okon Abang says Saraki/Dogara were wrong to defect to PDP, but Akpabio was right crossing to the ruling party APC.

One day, Abang will leave the Judiciary or the Judiciary will leave him and then he will know just how much he sold his soul to the Devil.
