Going by your analogy and the definition of wasted votes and voided votes, the total votes cast becomes 276,782 votes.
and what happen to the remaining 550,000 eligible voter? You denied them of their legitimate right. Only 17 poling unit were enough to decide the winner of osun election, becos you cant cancel anyones right. SCourt can not even do that.

APC votes are all invalidated. Unless on the grounds of the winning margin between PDP and the second runner up being less than the invalid votes.

That is not recognized by law/constitution. It is simple majority and 25% of 2/3. QED

Those 550,000 votes voted for an ineligible candidate. It's their loss. They wasted their votes. Wasted votes is different from void votes. Osun case is different. All candidates were eligible in Osun. Nobody wasted their votes in Osun

That is as a result of deceit and deliberate disobedience of court orders on the part of APC. They failed to do right and deceived Zamfara voters into the false belief that they had valid candidates. It's nobody's fault and the court is no Father Christmas. Elections must come to an end and this judgement of the Supreme Court puts a final end to the process.

Madam, APC votes are null and void and can't be added to rejected ballots during the election. Your only hope is when PDP didn't meet the requirements as per total votes minus the votes APC illegally got. The votes APC got ceases to exist with this judgement.

[quote author=NgeneUkwenu post=78684616]That APC has been disqualified by the Supreme court, and subsequently voided their votes, is no longer a news.

However, the Supreme court in passing their Judgement was being careful and vigilant not to create another constitutional crisis, hence the caveat " the second highest scoring party which met the Constitutional requirements should be sworn in as elected.

Now, which party came second?- PDP

Did the PDP meet the constructional requirements, for instance in the Governorship election?

Then, let's see the scores of PDP and APC as regards the Zamfara Governorship Election:

The apex court ordered that runner-up candidate be sworn in if he fulfils the constitutional requirement of getting one quarter of the total votes cast in at least 2/3 of LGs of d state.

Here is the analysis:

Total votes cast: 810,782
APC: 534,541 votes
PDP: 189,452 votes

Now if you remove the Voided Votes which now include that of the APC...You are now left with 189,452 votes of the PDP and about 10,000 combined votes of the "also ran" parties which will total about 200,000 votes.

From the above analysis, it is very clear that void votes are way higher than valid votes, which a winner CANNOT be Validly Returned.

Only Option before the INEC: order a rerun of the entire election, which must exclude APC ( Since the window for primaries had since closed).

Option before APC: Adopt one of the "also ran parties" put the picture of Buhari on the banners, and let their candidates be the candidates of the APC.

End!..

mushystuff:

These votes stand as though they were never cast because APC had no candidates in the eyes of the law. Those trashed votes will not now become numbers to reckon with for any reason. By this judgement they do not exist, they are wasted and not voided by reason of mutilation or disenfranchisement.
Therefore the contitutional spread will now be based in existing valid votes to the exclusion of all others.

Spot on.

This is too high for zombies like NgeneUkwenu to comprehend.

The answer is simple.

They clearly chose to be deceived by APC.

Their choice, their destiny.

Whose fault?

This Ngene is beclouded with Zombiestic sense of reasoning. Look at what a reasonable person is talking. He's adding ApC votes as cancelled votes instead of voided votes.

Mrs Lauretta. APC votes don't exist, the vote in consideration here is total votes cast with PDP and other party excluding APC . APC votes is non existent. Go and drink your palm wine.

Apc votes is not voided its wasted votes

Voided votes still remain the same as it was before

Expect INEC wants another inconclusive election

Apc votes will be deducted from the total number of votes casted and valid votes

Then they determine if Pdp have the 2/3 in 9 LGAs
Re: Zamfara: Why They May Be A Rerun Election. by markfem2: 7:33am On May 25, 2019
Upton:
Wait o, what is the original voided votes? You can't add ApC votes to the number of voided votes and say there will be a re run.
Also the supreme court said the votes given to APC are wasted votes, which I think is different from voided votes.

https://en.m.wikipedia.org/wiki/Wasted_vote

https://en.m.wikipedia.org/wiki/Spoilt_vote

Wiki has defined it for you. So I was right in my opinion. Voided votes are votes rejected and wasted votes are votes that have been needlessly added to that of a candidate.

So the constitutional requirement will be decided based on all votes casted for the other parties after subtracting what APC got. If PDP had 180+ and the others had 10,000 combined. Then they obviously met the two-third criteria. Unless the number of voided votes on the day of election is more than the difference between pdp and the party which came third.

Accept the fact that zamfara is gone. It was clearly stated that the votes cast for apc 'are' wasted votes and it's just all about common sense. When something is pronounced wasted,it means it's of no value...so the valid votes now remain the ones cast for the pdp and other parties that participated. If after adding all the votes cast aside that of apc and the pdp scores the required % acros d board, then it means the pdp candidate is now the gov. Elect. I know how u feel, but Supreme Court is called that name because it has the final say... Sorry for your loss
