LAGOS – The battle for the ownership of more than 10 communities in Ogun State, including Kajola Iboro, Ajelanwa Onse Olose, Onse Agbedi, Moseri Onse Orita Adeknmbi, Olatilewa and others have shifted to the Court of Appeal in Ibadan.
The case with the suit no CA/IB/115/2016 is a continuation of an earlier case before Justice J S Olusanya of the High Court of justice in the Ota Judicial Division.
A notice of appeal has since been given to the appellants, Alhaji Yekini Solabi and 10 others against Oba Samuel Ojugbele and three others on the affected communities.
Many residents of the affected communities have been thrown into uncertainty over the true status of the legal battle between the two groups.
The appellants have in a recent notice warned residents of the affected communities and prospective land buyers to stay away from the communities, pending the determination of the case in the Appeal court.
The notice from the appellants was to counter an earlier notice from the respondents to the residents in respect of Kajola Iboro, Ajelanwa Olowo Igni villages.
A notice of appeal from the Court of Appeal, in Ibadan reads “Take notice that the defendants /appellants being dissatisfied with the decision of the High Court of Justice, Agbara in Agbara Judicial Division in Ogun State delivered on 29th day of February 2016 by Honourable Justice O. S. Olusanya do hereby appeal to the Court of Appeal upon the grounds set out in paragraph 3 and shall at the hearing of the Appeal seek the relief set out in paragraph 4.”
The notice of appeal further reads that “the appellants further state that the names and addresses of the person’s directly affected by this appeal are those set out in paragraph 5.”
According to the notice of appeal, the grounds of appeal include errors in: traditional evidence, customary tenancy and payment, identity of land in dispute and others.
The appellants are asking for an order setting aside the decision/judgment of the lower court delivered on February 29, 2016 and dismissing the claim of the claimants/ respondents.
