It's an interlocutory appeal that was struck out, it has nothing to do with the main petition. It's in respect of PDP's appeal against the tribunal's refusal to allow it file a reply to APC's application. The decision will be of no effect even if granted,

The matter (main Petition) at the tribunal is already at the address stage so even if the Supreme Court decides PDP has the right of reply, it would amount to nothing because the tribunal won't go back to that stage, therefore it has been overtaken by events.

You must understand that we are talking about a *status barred* case here which means you cannot appeal an ongoing case that is yet to be concluded. Any decision taken at the tribunal should not be appealed until after the final judgement. Any dissatisfied party can now appeal any arising issues of the judgement. This ensures completion of the case withing the stipulated period in constitution. It is one of the positive effects of the revised constitution and electoral laws. Atiku's/PDP'S case has been completed with only oral submission tomorrow. The supreme court is right in its decision to strike the case out. That is the meaning of *Status Barred* and it has nothing to do with the final verdict of the Presidential Election Petition Tribunal (PEPT). Thank you

APC&PDP are group of monsters determined to send you (Nigerian youth and masses) into modern slavery. No to APC, No to PDP, No to party politics, it's people that rule and not party.
Let's start joining active politics to secure our future because those that destroyed our past and are destroying our present cannot improve our future.

This shows atiku's legal team is inefficient and after his money. Why appeal a case at the supreme court when it's yet to be concluded at the PETP, knowing fully well the amended constitution no longer supports that.

Could you please explain the ruling to me? Thanks in advance.

I still believe however, that not promptly responding on Atiku's behalf smacks of incompetence of Atiku's lawyers.

Sorry sir,you are the one not getting it as usual.pdp wont have appealed it if it wasn't germane.it simply means that since pdp didnt file a reply to apc application seeking to dismiss atiku case, the tribunal can dismiss it since not replying is same thing as acquiescance in legal terms.atiku is almost losing it.accept it

It actually has everything to do with the main case.it means that there's nothing stopping that tribunal from dismissing atiku's petition based on apc's application since they didnt reply to it.all these things are interconnected

Let me help you because that guy does not understand legal procedures or election petition cases.
During the pre trial stage of the tribal sittings when all appeals were being entertained, apc filed an application seeking the tribunal to dismiss atiku's case.atiku had 7 to 14 days to reply but he didnt.during court sittings,a party to the case must always respond or reply to a suit or a prayer against you within a timeline and failurw to do that means that you have agreed with the allegations labelled agsinst you and that the court is free without any obstacle to rule against you.you are totally exposed.
Now,atiku team tried to reply after the deadline to reply but the tribunal rejected it.they now appealed at the supreme court albeit late after all issues at the tribunal has been concluded making it status and time barred hence their judgment to today.
The import is that the tribunal may likely grant apc prayers and dismiss pdp's case without even going to the main issues or substantive issues since there's no reason why there shouldn't except they want to be lenient to atiku.
Tuniski is the last person you should be asking for clarifications from,he's empty.a similar thing happened in osun and he was arguing vainly,my predictions finally came to pass.the supreme court today also dismiss atiku application to inspect the server.tuniski and deji take note

Thanks for this submission.

It seems as if my expectations of Atiku's impending loss of this case, was not unfounded.

Is it every judgment that is delivered based on technicalities? Why not follow the rules and avoid falling to technicalities

The philosophy of the supreme court currently tends to technicality rather substantive justice. Obvious injustice gets away under technicalities yet, we want a better nation.
