The Defence Headquarters’ Joint Investigative Panel probing the killing of three policemen in Ibi, Taraba State, has yet to submit its report because it is still analysing the bank transactions of the soldiers arrested, Saturday PUNCH has learnt.

The panel constituted on President Muhammadu Buhari’s instructions on August 9, met on Friday and continued the collation of evidence obtained from the bank statements of the soldiers under investigation for their alleged roles in releasing a kidnap suspect, Hamisu Wadume, when he was being driven to Jalingo from Ibi after his arrest by the Inspector-General of Police Intelligence Response Team.

The panel is expected to submit its report to the Chief of Defence Staff, Gen Abayomi Olonisakin, and its failure to do so is said to be delaying the trial of Captain Tijjani Balarabe, and others who have been in detention since the first week of August.

Our correspondent reported on Friday that the trial of culpable soldiers might not begin until the first week of September.

The panel headed by Rear Admiral Ibikunle Olaiya has been meeting at the Defence Intelligence Agency, Abuja, during which they cross-examined the soldiers, police, civilians and the rearrested Wadume.

A source had disclosed that the seven-man panel’s report indicted some soldiers who face a court-martial and likely dismissal, “going by their level of culpability”.

An authoritative source confirmed on Friday that one of the issues delaying the report was the analysis of the bank statements of the suspects which would be “undeniable proof of their culpability or otherwise”.

He said, “The panel is not done with the bank statements of the soldiers obtained from several banks and which have to be analysed. This is one of the reasons why the panel has yet to submit its report.

“The evidence has to be factual and concrete, so that the authorities can have a solid case during its court-martial. This is because if the trial of the soldiers is not properly done, they can appeal at a general court, which can overrule the panel. The panel has a responsibility, not only to the CDS, but also to the President. Whatever they turn in is believed to be the position of the entire Nigerian military. That is a huge assignment. They are only trying to be thorough.”

to me I don't really see the fault of those soldiers, in the military their own is obey before command, you dare not disobey your subordinate when he gives a command. You must do that first before anything. Even if you're a number ahead of that soldier but mate in ranking you must obey him or her as you senior. So in this case Captain Balarabe Fari should say the truth & allow the innocent soldiers go free.then they should gather more facts on others who are under Wadume's payroll then they can be punished. Even the politicians Ade involved in this cos he can't lie that he got millions from the APC government.let God just take over this country cos if not.there are so many things that is yet to come my brother!

The investigations have been handled very well. It needs to be foresnsic and thorough. No rush. This is the benefit of permitting the criminal justice system to work. You learn many things, you uncover many things even things unexpected when you dig out a case properly. Had it been the men were lynched like Nigerians typically desire how will you get into their accounts, how do you get documents, passcodes, how do you setup stings, how do you locate accomplices and buried evidences..... how do you trace the masterminds aka 'sponsors' as Nigerians always cry.

When the system is permitted to work by both citizen and government we all profit from a more enlightened citizen and a better performing government. Kudos to eveyone from the CinC who initiated this and prevented a coverup and the police who remained dogged in seeking justice for their fallen colleagues. This kidnapping thing is surely a vast network which must be unearthed no matter whose ox is gored.

That is the point of investigation, to unearth the truth and learn more about the possoble criminal network. What I want to see as well is the military taking another look at its rules of engagement particularly in civilan theatres viz the training and orientation it gives to its operative deployed literally to 'the streets' and also how it interfaces with other law enforcement organisations.

To have policemen identify themselves at a military checkpoint and are allowed through only to receive a counter instruction and they are all gunned down is totally unacceptable. Even if they refused to stop, what are the rules of enagement. They cannot and should not be at the whim of junior officers (like a Captain who in a conflict scenario can head no bigger than a Military Company). To use deadly force, to kill identified targets should not be the decison of an Army Captain in a civilian theatre.

It also brings to the fore a bigger problem of military doctrine as to whether a soldier is typically in allegiance to the law or to his boss or command. I think if this is not handled properly we will experience a lot more tragic events. The law should always be upheld by every personel to the extent of questoning unlawful orders. I think if the military is going to prove it has finally submitted itself after decades of governace to civilian rule and democracy, it has to abandon its practice of tolerating unlawful acts and subject all its personel to the law. Soldiers need to develop a mentality of the law on one hand and their mission on the other at all times. If not a Lieutenant can pick up the phone and order his unit to do anything untoward without a hesitation by those ordered. This is dangerous.

Nigerian officials way of buying time is to be releasing processes and step they are taking (which should be nobody's business) to the press while the report is overdue. The investigation department of a commercial bank would have long submitted the report.
