The refusal by the Nigeria Senate to declare the seat of its Chief Whip, Senator Orji Kalu, following his conviction by a Federal High Court in Lagos goes to show how ineffective and callous the Nigeria Senate can be. In a saner clime, Conviction immediately removes the defendant from office. Following conviction, the Senate may vote to further punish the individual by barring him or her from holding future federal office, elected or appointed, but in Nigeria, who do we have as senates? Inadequates, unproficient, blundering clumsy, ability lacking, shamelessly corrupt men and Women who are totally ingnorant of the fact that, one of the vital functions of the Senates is to carefully guard its own procedures for judging the qualifications of its members and settling contested elections.
The Spokesperson for the red chamber, Senator Godiya Akwashiki, said it was not possible to declear the seat of the alredy convicted Senate "Vacant, that the request would only be considered after the embattled senator had explored all the legal options available to him without success.Godiya Akwashiki just called our judiciary worthless and inutile, because Kalu has been investigated and sentenced to 12 years in prison for fraud by a Federal high court. Fellow Nigerians lets come together and take the Bull by it's horn, it's time we draw the sword of revolution and if need be, DEAD TO THE LAST MAN.

Op, you are a confused element with hidden mission. The senate spokesman has truly given a clear position of law. Kanu still has the legal options to appeal the judgement. Allow Kanu to exploit the options left for him, if finally he's gone, the senate could then declare his seat vacant

What is the time frame for an appeal to be filed?
F it has no time frame, will Kalu be possibly enjoying his seat from prison and receiving salary till time he seemed best to appeal?

You don’t have to study law to know that When a person is accused of committing a crime or offenses, he or she will be tried in criminal court and face a representative of the state, or prosecutor. This person, along with several other state employees, forms the state’s prosecution team—and it is up to this group to prove that the accused is guilty of the crime in question.

So how does the prosecution prove the defendant (the person accused of committing the offense) is in fact guilty of a particular crime? Using evidence, such as eyewitness testimony, etc, the prosecution will present its version of events. In addition to proving he or she actually committed the offense, the prosecution is also responsible for proving that the defendant acted with intent or negligence. If the prosecution cannot prove both of these aspects, then the defendant cannot be convicted of the offense.
So, as you can see "Mr. Confuse Element , For Kalu to be sentenced to jail in a high court shows that the prosecution has more than enough"EVIDENCE" in their possession that made the high court judge sent the disgraced Senate Whip to GAO.

The question is, Does the law allow Kanu to appeal the early judgement?
In 2015, when Wike election was nullified by tribunal, did Wike immediately vacant the seat, further when Wike approached the appeal court and he lost, did Wike vacant the seat? This was because Wike had the legal options to appeal the case till the supreme court. Why don't you allow Kanu to exploit the legal options he has before his seat could be declared vacant

Wike obtained stay of execution from higher court but here No judge will give him that..
