“Let me also say that it is not a state secret, if as the supreme court has ruled, David Lyon cannot now be sworn in as the person who has the highest number of votes and the spread to be sworn in, it simply means from tomorrow there will be no government in Bayelsa state.
“But, as far as we know the next candidate, as the facts are before court, who happens to be a PDP candidate does not have one quarter of the total lawful vote cast in that election in 2/3 of the local government councils in Bayelsa state. And, therefore from the fact available to us, in consultation with our lawyers, it is clear that there is no candidate that meet the requirements of the supreme court, which means no one can be sworn in legally tomorrow unless there is a delibrate abuse of the legal process.
“We have accordingly asked our lawyers to look at all the windows that exist in law, and take steps to ensure that the will of the people of Bayelsa state is not undermine on the alter of technicalities. I am not a lawyer and I don’t need to be one. When judges make judgement they are published and you can read and write. Even laymen like me can understand.”
Those were the words of the National Chairman of the All Progressives Congress, Adam's Oshiomole as quoted in The Cable in reaction to the Supreme court judgement that sacked his candidate, David Lyon as Governor elect of Bayelsa state.
The comments by Oshiomole points to the direction which the party would be taking in trying to recover its mandate in Bayelsa.
Having directed it's legal team to look at all the legal windows to ensure that the will of Bayelsans is not undermined, the most likely step the APC would take now is to apply for the review of the judgement, same thing the Peoples Democratic party has done in the case of Imo state.
Ofcourse, the highest court of the land remains the supreme court and after its judgement ,there is no higher court for appeal. This means that the only option left would be for the same court to reverse itself on the said judgement which could happen after a review has been sought through a formal application .
The question however will be, what's the possibility of the Supreme reversing itself on this one even though the judgement was based on technicalities.
Remember, the APC in the case of Imo state praised the Supreme court for the judgement and when the PDP insisted through series of protests that the judgement be reviewed and reversed, the APC countered by insisting that the Supreme cannot reverse itself and that the judgement was final.
The table appeared to have turned in this case and Oshiomole is looking for all legal means to reverse the judgement. Is the Supreme court no longer the final court of law?
Even as the APC has claimed that the beneficiary of the judgement is not qualified to occupy the seat, it is only a question of time for us to find out how the legal battle would pan out.
