Legality of Appointment of Ajimobi as APC Acting

The order of Court dated the 4th of March 2020 which was made
by Justice Danlami Senchi of the FCT High Court Abuja in an
action filed by Mr. Oluwale Afolabi suspending the National
Chairman of APC Comrade Adams Oshoimole was affirmed
yesterday by the Court of Appeal sitting in Abuja pending the
determination of the substantive suit.
In other words the suspension of the National Chairman will
continue to be in place until the final determination of the
substantive suit by the trial court.
However, in a swift reaction or response to that Order by the apex
court the NWC of APC has validly appointed the Deputy National
Chairman of the Party South; H.E. Senator Ajimobi as the acting
National Chairman of the party in line with Article 14;2 (iii) of the
APC constitution;
Needless to mention that the adversaries of the National Chairman
of the party which is led by Senator Lawal Shuaibu Deputy
National Chairman North..or Chief Victor Giadom the vice
chairman of APC South South cannot act as the National Chairman
of APC since there is a Deputy National Chairman, South of the
party in person of Senator Ajimobi the former governor of Oyo
State.
Actions or duties or proclamations already performed by the NWC
under the Leadership of Comrade Adams Oshoimole in respect of
the APC primary election in Edo State are very much intact and
valid in law. On point is the case of Rt. Hon. Michael Balogun &
Ors Vs. Governor Of Anambra State & Ors. (2009) LPELR-729 (SC).
Consequently the Deputy National Chairman of the party HE.
Senator Abiola Ajimobi will continue to preside over the affairs of
the party until the said order is reversed or set aside by the
Supreme Court. In an effort to set aside this Order the National
Chairman of the party and the APC would have to file a Notice of
Appeal and motion for stay of execution of the Order and perhaps
ensure that the records of proceedings are swiftly transmitted to
the SC wherein the appeal would be said to be entered!. I think
there’s no cause for panic because the Leadership of the party is
very much in control.
