Edo 2020: APC Member Seeks Ize-Iyamu’s Disqualification by Nobody: 8:50pm On Jul 22, 2020
An aggrieved member of the All Progressives Congress, APC, and legal practitioner, Mr Charles Ude, on Wednesday, filed a suit before the Federal High Court in Abuja to disqualify the governorship candidate of the party in Edo State, Pastor Osagie Ize-Iyamu.

The Plaintiff, in the suit marked FHC/ABJ/CS/839/2020, told the court that the emergence of Ize-Iyamu as the candidate of the party for the September 19 governorship election in Edo State was unlawful, insisting that both the screening and primary election Committees that cleared him, were not validly constituted.

According to the Plaintiff, in view of the June 16 judgement of the Court of Appeal which affirmed that the former National Chairman of the party, Adams Oshiomhole was duly suspended on November 2, 2019, all the decisions he took during the subsistence of his suspension remained invalid, null and void and of no legal consequence.

He told the court that following the appellate Court’s judgement that affirmed Oshiomhole’s suspension, Chief Victor Giadom who took over the affairs of the party, cancelled both the screening and primaries election Committees that cleared Ize-Iyamu, which he did not set up.

Cited as 1st to 6th Defendants in the suit are the APC, Oshiomhole, Giadom, Hilliard Eta, Independent National Electoral Commission, and Pastor Ize-Iyamu.

Specifically, the Plaintiff, is praying the court to determine, “Whether having regard to the entirety of the constitution of the 1st Defendant (APC), a suspended member of the 1st Defendant can validly exercise the powers and discharge the functions/duties of the National Chairman of the 1st Defendant?

“Whether in view of the judgment of the Nigerian Court of Appeal in Appeal No: CA/A/188/2020 delivered on the 16th day of June 2020, affirming as valid the suspension of the 2nd Defendant on the 2nd day of November 2019, all the decisions are taken by the 2nd Defendant as the National Chairman of the 1st Defendant (during the subsistence of his suspension) is not invalid, null and void and liable to be set aside?
“Whether in view of the 16th March 2020 decision rendered by the High Court of the Federal Capital Territory, Abuja [Coram: Honourable Justice S.U. Bature] in Suit No. FCT/HC/M/6447/2020, the emergence of the 6th Defendant as the candidate of the 1st Defendant for the September 2020 governorship election in Edo State is not unlawful and therefore invalid having been cancelled by the 3rd Defendant who did not set up both the screening and primaries election Committees of the 1st Defendant?

Upon determination of the legal questions, he is seeking the following reliefs;

“A declaration that having regard to the entirety of the constitution of the 1st Defendant, a suspended member of the 1st Defendant cannot validly exercise the powers and discharge the functions and or carry out the duties of the National Chairman of the 1st Defendant.

“A declaration that in view of the judgment of the Nigerian Court of Appeal in Appeal No: CA/A/188/2020 delivered on the 16th day of June 2020, affirming as valid the suspension of the 2nd Defendant on the 2nd day of November 2019, all the decisions are taken by the 2nd Defendant as the National Chairman of the 1st Defendant (during the subsistence of his suspension) is invalid, null and void and of no legal consequence.

If truly this Man is a lawyer then his Certificate needs to be taken away from him... The Electoral Acts stipulates when one can file a case of such.. It is over 14 days since APC had its primary, and submission of names to INEC..
I'm sure he is doing this so that his paymaster will know that He is working for the money they paid him.
I'm not a judge but this is effort in futility.

the suspended chairman did that during the period Appeal Court approved stay of execution for him, it was in place and NEC rectified it before sacking victor giadon

don't forget, when Gaidom was declared the authentic chairman, he wrote to inec to cancel the primary that produced apc candidate in edo.

Obaseki has two certificate, he submitted one in 2016 and another version in 2020, both from UI, he will need to explain to the court which one of them is original

don't forget, when Gaidom was declared the authentic chairman, he wrote to inec to cancel the primary that produced apc candidate in edo.
Even the so called acting chairman Gaidom order from FCT high court that lasted more than 2 weeks is strange in law so Supreme Court will also look into that too

we all know what is going on in FCT high court, its pay as you go, no where in law that order of court can be renewed so lets not even go there, the whole essence is just to get Oshomohle out of the way which ever way and that was the reason why those who used Mr. Gaidom arranged with NEC chaired by the President to order all members of the party not to go to court to challenge their actions that any member who refused to yield to the order will face severe consequence, should any member of the dissolved NWC goes to court to challenge their sacking, then NEC meeting convained single handedly by Gaidom and decision taken by the NEC will be in nullity

you got it all wrong. Xparte order is part of court processes and can be issued for just 2 weeks and can be renew by the same court which the court eventually did. Oshomole problem started in his ward which he ignored to attend to from the onset which eventually cost him his seat. Their is politics in it which is normal in any political parties but the legality overide the politics.

The beginning of the end to Pastor's quest to rule Edo State. This seems like the Final Straw.
What a waste of effort. Funny enough Justices Odili and Amina Augie will still be there when case gets to Supreme Court.

Read again ... 14 days deadline is for contesting the outcome of election. The case here is that there was no such thing as APC NWC led by Oshiomole. Meaning you cannot build something on NOTHING. The only leadership recognized in Law at the time of screening of candidates, primary and submission of candidate's name was Chairman Giadom. The latter expressly disowned the candidate in APC official letter head and seal.
