I have built and rented houses for nearly 15 years, but have never sent anyone packing from any of my premises. Now, there is this young man bent on changing my mind, he has been giving hell to the whole tenants living in my last completed building. From thunderous prayer sessions in the middle of the night to calling everyone names from witches to prostitutes and generally causing serious breakdown of peace. Some tenants are threatening to pack if I dont throw this man out.
I have got more than four calls this morning from concerned neighbors who could not sleep throughout the night because this man was doing some carpentry works from 12pm to 4 am. He nearly fought my caretaker when he tried to stop him.
How do I serve him papers? Can I just type his quit notice and sign or do I need a lawyer to draft the quit notice? Supposing he refuses to go easily, what are my options?

I need state here firstly that I am not a lawyer. But having worked in a Law firm as the Firm's Property Manager/Litigation Assistant before establishing my own Property Firm, I'd love you knowing that for a landlord (like yourself) to achieve his desired aim (as it concern tenants eviction), there are rules guiding the service of quit notices. Space & time may not permit me here to lay b4 U the intricacies surrounding quit notices, but we may do this via telephone call or arranged meeting. Before a quit notice is served, the landlord or his lawful attorney would have to supply some vital info

It would be great 2 have your reaction.

Is this in Nigeria? if so just give back what is left of from the rent money and ask the tenant to please leave or serve him with a notice to stop disturbing the peace and inform your area police station. If he refuses then refund back his money and ask him to move with police escorting him out. Your tenant seem to be a special case so be careful.

giving a tenant quit notice is an issue to be approached with caution.firsthave you exhausted all other means of resolving this issues?are these complais genuine?because as the landlord,you might end up giving him free accommodation for about up to 6months. Atleast,he needs like 3months to search for house else where and this takes time.also,are you sure of his financial capability cos at the expiration of his 3months notice,the waiting game may just cntinue.i advise you sort things amicably.all the best.

My brother well i want tell you that your is having Madness symtoms.very soon he will start giving rules in your property.

All you have to do now is get a quit notice letter from court signed by you and give 3months notice to leave your house.thats is all the guy head will cool down

First, get a lawyer. He writes a proper quit notice that will be registered in court and then served by bailiff.

This is the beginning of the waiting period. In the mean time cut off electricity supply by removing Nepa cable (notify Nepa office in 2 prepared sentence). This among many other options you have as a landlord is guarranteed to work.

the issue is very easy. well consult a lawyer, he will listen to you and first of all determine the type of tenancy and then decide the period for the notice to quit. then he will issue alll subsequent notices and take all steps to evict him. furthermore for a short period pending his eviction you could ask for a binding order from him. consult a lawyer.

Your tenant has rights under the law, so you must take careful and clinical steps to ensure that you do not perpetuate his stay by making technical mistakes. Anyone could serve a quit notice, but it is preferable that a lawyer be briefed to do that because a notice that doesnt meet the technical requirements will not stand up when challenged in court. His tenancy will determine the notice he gets (monthly, quarterly, weekly or yearly). After the notice is served (with the appropriate timing) upon expiration of the time on the notice, he is entitled to another notice of 7 clear days indicating your intention to get him to quit at the risk of filing papers to so do in court. As soon as the 7 days expires, u can file a writ in court (or rent tribunal depending on the rental value) and if the matter is expedited, in less than a month, you will get a judgement in your favour asking him to quit.

Being a stubborn tenant, chances are he will refuse to quit. Get the Baillifs, working with the Sherriffs through the Court Registrar to evict him at an unholy hour of the day (preferably during the rainy season) his things will be recklessly and indeed malicously be thrown outside the premises.

Advantages of following legal procedure include the following: He cannot turn back and go to court and say he was wrongfully evicted, he cannot go and claim injuctive reliefs on the grounds that you tampered with electricity (which you have no right to do anyways) and more importantly, upon his things being thrown out, the bailliffs and sherriffs will ensure that he pays up whatever amount that is outstanding on the rent (which the law now recognizes as mesne profit) and also the cost of eviction. Indeed talk to your solicitor

If you try this with me, i will use my left hand and rmove the stuff, boil the head or entire fowl and feed it to my dog, and guess what, i wount even discuss the happening of that event with you as a landlord or anyone else for that matter

OP, if you know what is good for you, you better find some area boys wey go help your stubborn tenant pack him load. Abi u no dey watch home video?

I may be wrong though. If the houses you let are the types they let to expatriates at 5 digit dollar figures then you may have to go to court but if na face me, I face you type or normal duplex in areas like Egbeda, Shomolu e.t.c, then the area boy advice will be your best solution. Do you not know what real lawyers charge? I am not talking of those charge and bail guys outside the court house in Ikeja, I mean real attorneys.

Good one my mum needs to use dis advise o, she has a temant that is giving her wahala and the tenant herself is threathening to take my mum to court!!!
i just tire for the whole isssue since am far away and cant go there in person to solve d issue!, i had told her earlier to call d family lawyer but she says she will deal with d lady herself ,,,,, i think dis advice needs to be put to effect ASAP!

I love the advice am getting here. First, this young man pays monthly, I allowed him pack into my new house (finished building it only last January) a self contain apartment. First, this man has been thrown out of his previous houses twice. I picked his family from the uncompleted building they were living inside after being thrown out. He didnt have money so I took him in and told him to be paying monthly. All I get is trouble and more trouble. He is only owing me for February, and I dont need the rent, I need peace of mind. I am picking so much info from all your replies. The house is in Nigeria, Enugu town.
I tried settling the wahala, the wife was the one causing the trouble initially, but right now, the husband has taken over. They have gone to the police station twice. He says everyone hates him, because he is a man of God! And that it is expected, that even Jesus was hated and persecuted. I genuinely believe a nut is loose in his skull.
There is no way I can say he should leave so I can repair a new house? Holding a meeting wont work, it will end in fiasco as the last one we held there.

If he is owing you one month's notice in arrears, and he pays monthly, then the two fold implication are 1. He is a monthly tenant and is only entitled to one clear month's notice. 2. since he is in arrears, he has by that conduct waived a right to notice, so you could go ahead and serve him the statutory 7 days notice and thereafter file your eviction writ.

Please resist the urge and desist from any acts that will prejudice the law and the courts against you. If you take a wrong step, he steps into the driving seat and determines the speed at which the court proceedings will go and dont forget, he is a statutory tenant and therefore protected by law.

Once you get into court, your solicitor should be able to file applications for expedited hearing and get the matter to be fixed for some 3 cosecutive days hearing and you may be able to quickly get judgement. I generally do not recommend meetings with tenants, if my tenant needs the house, he should press to meet with me, at any rate, he is only protected to an extent, at the end of the day, he will yield possession to you as the landlord. If you could, i would have advised that you could really commence and conclude the eviction process, my dad did, and successfully too. I recommend you talk to a solicitor (lawyer) and give him a full brief). I guess you have a mad man in the making and he needs to be treated with care and dealt with URGENTLY.

You do not have to furnish him with an excuse for evicting him. and you are lucky he is a monthly tenant.
its this simpe fact all the greedy landlords in lagos do not get. a yearly tenant takes an average of 1 year to evict, a monthly one max 4 months


GET A SOUND LAWYER. eviction is not hard, but technical. you don't need a SAN but at the same time don't go for a cheap haggard looking doofus.

if u are concerned about his fee then get a young bright lawyer, he may be willing to take a decent sum. but remember, if u want your job done properly, do not pay a sum that will only get the lawyer to court twice then three months later u start complaining.

you SHOULD give him the statutory one month's notice forget the shortcuts. it will end badly. the law and the court is very very sympathetic to the tenant!

After that give him 7 days notice of intention to recover possession.

Then promptly file a brief to recover possession in court. if u prefer speed, forgo the arrears, and instruct the lawyer to ensure maximum possible speed. there are ways to speed up these things.


When you get judgment, get bailiffs to execute it instantly. in say 3 months you should be able to get your accommodation back
