A Lagos business hotelier Babatunde Saka of OFLYGLOBAL RESOURCES LIMITED has taken Saheed Ayinla Ogundare under the name and style of SEADOF HOTEL & SUITES Block 2, Flat 5 Luth Staff Quarters Idi Araba, Lagos and Kolawole Bankole operating under the business one of the DE RITE HOTEL AND PRIMAL HOTEL AND RESORT SERVICES LIMITED, to Lagos state high court, IGBOSERE over alleged use of his company account for fraudulent diversion of the financial resources of LUTH and bridge of contractual agreement between Babatunde Saka of OFLYGLOBAL RESOURCES and Kolawole Bankole of DE RITZ HOTEL AND PRIMAL HOTEL RESORT SERVICE LIMITED.Saheed Ayinla Ogundare who once worked as a customer resource agent for PRIMAL HOTEL as a canverser to bring LUTH staffs and guests to the hotel received his agreed agency fee.Unknown to the management of the hotel, Saheed Ayinla Ogundare contacted the leasers of the hotel Mr.kolawole Bankole and promised a bigger and better financial gain to the leaser instead
According to a statement made by the claimant written under oath what lead to the current legal action started on the 8thof August 2016 by a contract agreement between Kolawole Bankole (owner) and Babtunde Saka,when Kolawole Bankole let out his fifteen (15) bedroom hotel with related facilities known as DENEST HOTEL at 5 M.K.O Abiola Crescent to him with an agreed down payment for a particular period. Babatunde Saka incurred a further expense to the tune of three million, nine thousand, five hundred and forty-nine naira, seventy kobo (N3,009,549:70) to put the hotel in a better shape and for advertisement in print media.On the14thJuly, 2017 Mr.kolawole Bankole and Mr.Babatunde Saka entered into a contractual agreement to another hotel facilityin respect of thirty-four (34) bedroom hotel with other related facilities at PRIMAL HOTEL AND RESORT SERVICES LIMITED at 46B Isaac john street, GRA, Ikeja,Lagos,Nigeria.
After taking over the second hotel, Babatunde Saka expended eight million eight hundred and eleven thousand, nine hundred and thirty-one naira only (8, 811,931.00).However on the 16thOctober 2019, kolawole bankole who lease the hotel to babtunde saka, stormed primal hotel and resort services in a war like manner with thugs and violently and forcefully took over the property and drove out Babatunde Saka and his staff out from the property seized all their purchase item, provision of the contract signed which gives privilege to other party for notification should there be terminationof contract by either party on the 6thof February 2020, Kolawole Bankole took the same action In a gendarmemanner as earlier exhibited in respect of DeNext Hotel and claim all purchased items to enhance the value of the hotel
The chairman lodge a complaint about the breach of contract, illegal and unlawful seizure of his properties to the assistant inspector general of police, at Nigeria police force criminal department alagbon, Lagos. Dated 24thOctober 2019 claiming the sum of twenty-one million, Eight hundred and twenty-one thousand, Five Hundred and Forty naira seventy kobo (N21, 821,540:70) it was further revealed that Saheed Ayinla Ogundare ex-customer resource agent who works at LUTH is now in charge of the management of the hotel under the name of SEADROF HOTELS AND SUITESwhich gives room for conflict of interest and corruption. The account of the claimant Ofly global resources limited is still being used to receive money and ask the claimant to forward the money to his account which the compound with initially until he was advise against such act the account of the company was used to collect the total sum of (N3, 851,170) three million, eight hundred and fifty-one thousand, one hundred and seventy.The claimant claimed against the defendants jointly and severally are as follows:
1. The sum of 15 million as general damages and special damages.
2 .Declaration that the forceful and wrongful taking over of the hotel and seizure and continued detention of the claimant’s items purchased to enhance and improve the management of the two hotels by Kolawole Bankole without resorting to the provision of the contractis unlawful and illegal
3. Declaration that Saheed Ogundare as a public servant in the employment of LUTH to engage in a private business and managing Hotel is unlawful.
