NIGERIA CONSTITUTION

182. (1) No person shall be qualified for election to the office of Governor of a State if -

            (a) subject to the provisions of section 28 of this Constitution, he has voluntarily acquired the citizenship of a country other than Nigeria or, except in such cases as may be prescribed by the National Assembly, he has made a declaration of allegiance to such other country; or

            (b) he has been elected to such office at any two previous elections; or


with section 182 1b fashola will not be elected as governor but as a deputy governor then be sworn in after the new dummy  governor resigns
in that case he wasn't elected as governor but as deputy governor

read the bold. it says you can't be governor if u have been governor twice already.

read the bold it said he cant contest as governor more than twice, this part of the constitution didnt say he cant be sworn in as governor, so he can contest as deputy but sworn in as governor

Don't you think by 2015 Nigerians should be thinking about how we are going to Split? Do you think the Northerners who feel the Presidency is their Birth Right will fold their arms and let Nigeria be ruled by SW?
You also said SW's turn which i term as zoning? Don't let us derail this thread but we only claim to be ONE in Nigeria but we are divided. There is no point forcing ourselves to make Nigeria to be ONE while our young generations are been slaughtered up North like rams. follow the link below

I don't seems to get it clearly, but if what you are saying from that part of the constitution is that the 2 times governor can contest as a deputy governor, and 'something' happens to the governor of which the deputy (now third time) can now become governor by default , the the constitution should be looked into.


I think that is not the intention of the parliament at the time because it will be allowing 3rd time by back door. Anyway no Gubernatorial candidates will take such a political risk and calculation to choose a two time governor to be his deputy. It is like chooses GOODLUCK to be your deputy grin grin grin It is political suicide that even the most unknow opposition will use to win election from such party, and the whole populace will cry, and matter will go to court, and no previous 2 times governor will like to be deputy unless there has a hidden agenda.

In theory YES but in practice NO.

Poster,yes the 1999 constitution is deeply flawed,another classic example is in the area of local govt creation.It empowers state to create&fed govt to fund,we all saw what it caused in the case of Lagos State vs Fed Govt during the Tinubu Era. . .That said,Fashola is a SAN and he clearly knows the implication of exploiting lacunas is the constitution.

You are Brilliant!!!! Very brilliant!!

The reason I believe at least any of the governors should attempt your suggestion is so that the constitution would be put to the test. That way the flaws would be made pretty glaring and those in charge would seek to correct it. Thats exactly what happened with the issue of Governers and their re-run cases! The new electoral act has taken care of the flaw that allowed some Governors to stay longer than the constitutionally required 4 years per term. If that correction was not done, Governor Uduaghan of Delta state would have spent a good 7 years on a 4 year term!

OP, Fashola has a brighter future beyond being Lagos State Gov. You don't want him to progress in life?

Anyway, it will never work. ACN will only self destruct with such move. We know the man is performing but I can assure you there are others coming behind him that can do better. It is left for us to find those people and vote them in. Egusi soup is tasty but wait till you taste banga soup before you conclude on which is bestgrin

I don't see Fashola ever being the president of Nigeria. I see him in the National assembly or something.
