Breaking: Lagos passes bill stopping parade of suspects

The Lagos House of Assembly on Monday passed an amended version of the Criminal Justice Law of the state barring the police from henceforth parading suspects before the media.

The bill was passed at a sitting presided over by the Deputy Speaker, Wasiu Eshilokun-Sanni, on behalf of the Speaker, Rt. Hon. (Dr) Mudashiru Obasa.

Section 9(A) of the newly passed bill states: "As from the commencement of this law, the police shall refrain from parading any suspect before the media."

The bill further stipulates conditions under which a policeman can arrest without warrant one of which is that a person must be reasonably suspected to unlawfully be in possession of firearms or other such dangerous instruments.

A subsection of the bill also barred the police or any other agency from arresting a person "in lieu of any other person in a criminal matter."


The bill adds that a person who is arrested "shall be given reasonable facilities for obtaining legal advice, bail or making arrangements for defence or release.

The bill stipulates that a suspect should be "accorded humane treatment, with the right to dignity of person; not be subjected to any form of torture, cruel, inhumane or degrading treatment; be brought before the court as prescribed by this law or any other written law; or be released conditionally or unconditionally."

After a voice vote, the Deputy Speaker directed the acting Clerk of the House, Mr. Olalekan Onafeko, to transmit the bill to the governor, Mr. Babajide Sanwo-Olu, for assent.

Hmmmmmmm, nice one.
Lovely bill, however, what are the mechanism put in place by the law to avoid indiscriminate arrest and love ones not knowing the whereabouts of such person, as the parade(illegal) often times help to know that someone is in police custody, eg, the oil worker arrested as IPOB member but family got to know his whereabout as a result of the parade.
Magistrates should be made to visit detention facility under its jurisdiction twice or once monthly and the visit should be impromptu to avoid relocation of suspects under custody

On this, the state have the power to make laws that guide the conduct and the kind of charges Nigeria police can press against individuals. For example, some states pass a law that, kidnapping is death sentence why other is some years imprisonment. So it varies from state to state in the same country. It is normal even in the US.

There are many loop holes in our constitution . If state governments are serious , laws can be passed that would make states independent. The main problem is revenue allocation and resources control. Funds are needed to implement those laws.

Some of you don't read, it is constitutional for magistrate to visit police cell, they don't do it, it is not Lagos thing, once in a blue moon they come and get explanation from police, at end of the whole thing, they will advise them to charge them to court nothing more than that...

Pẹlẹ ooo, reader. I know it is constitutional, but I said they should be made to, meaning there should be a compulsion through the law, the law can also includes that any illegal detainee that has exceeded a number of days in detention should be discharged till whatever investigation been carried out is concluded.
