The National Industrial Court sitting in Abuja has ordered the Nigerian Association of Resident Doctors, NARD, to call off the strike action they commenced since August 2.

The order followed a suit the Federal Government filed before the court to challenge the legality of the strike action.

FG, alongside the Federal Ministry of Health, had insisted that resident doctors embarked on the strike action, without proper notice as provided by the extant Strike laws.

It argued that members of NARD, being of “essential services providers”, were prohibited by law from embarking on strike.

“The continued and sustained industrial action by the Defendant/Respondent is contrary to public policy and equally endangers the lives of the citizenry,” it added.

Though FG earlier threatened to invoke the no-work-no-pay policy against the Resident Doctors following their refusal to return to their duty posts over alleged irregular payment of their salaries, however, the court, in a ruling on August 23, ordered all the parties to “suspend all forms of hostilities”, pending determination of the suit.

At the resumed proceedings in the matter on Friday, Justice Bashir Alkali, ordered NARD to suspend the strike action “with immediate effect”, after he heard all the parties in the matter.

The court has just done the bidding of the FG. U expect people that have not been paid for 4 to 6 months to resume back to work?
Nigeria is damned as the court seems just as an extension of the Presidency.

It's part of the play. He doesn't want to rule on it but still ordered doctors being owed salary for months to resume while another judge takes up the case.

These doctors are very inconsiderate.
They take out their greediness on the down trodden.
Running private practice with little regard for human life in government hospitals.

They attend highly subsidised tuition free medical training only to bolt out to greener pastures at the slightest opportunity without repaying your benefactor country.

The leadership of the National Association of Resident Doctors (NARD) has faulted the ruling of the National Industrial Court (NIC) directing its members to return to work.

A communique jointly signed by NARD President, Dr Uyilawa Okhuaihesuyi, and the union’s Secretary-General, Dr Jerry Isogun, on Friday revealed that the doctors have begun the process to appeal the ruling.

“As we are all aware, especially those that were present in court today (Friday), the NIC has given a ruling on the application for interlocutory injunction filed by the Federal Government,” the statement said. “We are not satisfied with the ruling.

“After consultations with our lawyers, we have instructed our lawyers to appeal the ruling and file an application for stay of execution.”
