Appeal Court To Rule On VAT Collection Dispute 2 Pm Today by limcar: 10:55am On Sep 30, 2021
The Court of Appeal in Abuja has scheduled an application by Lagos State to be made a respondent in the appeal filed by the Federal Inland Revenue Service (FIRS) for ruling at 2 pm today.

A cause list seen by DAILY POST at the Abuja division of the Court of Appeal indicated that a three-man panel of the court, led by Justice Hamma Tsanami, will deliver the ruling.

The appeal by the FIRS is against the August 9, 2021 judgment by Justice Steven Pam of the Federal High Court in Port-Harcourt, Rivers State, voiding the Value Added Tax (VAT) Act and holding the states could collect VAT.

A three-man panel, led by Justice Haruna Simon Tsanami, after listening to arguments by lawyers to parties on September 16, had said they would be informed when the ruling was ready.

In arguing Lagos’ application, the state’s Attorney General, Moyosore Onigbanjo (SAN) said his client was a necessary party as it would be affected by the outcome of the case.

Lawyer to Rivers State, Ifedayo Adedipe (SAN), agreed with Onigbanjo and urged the court to join Lagos, while lawyers to FIRS and the Attorney General of the Federation (AGF), Mahmud Magaji (SAN) and Tijani Gazali (SAN), argued otherwise and prayed the court not to join Lagos.

Why is the FIRS asking the Court not to accept Lagos State into this case

But this same FIRS will tell the Lagos State Government to abide by the ruling of the Appeal court undecided

If Lagos is eventually included and wins the VAT case, it means that every company will start paying their VATs in the states they are based, not their headquarters in Lagos paying for all the branches. That is going to be another lawsuit after this.

A bank whose head office is in Lagos cannot be paying VAT for all their branches scattered across 35 states and the FCT.

This debate is becoming interesting. However, this case will take a long time to come to a logical conclusion....it's legal abracadabra.

the Ruling will favor the FG because the Lead judge here is like Another Justice Abang....he must be bias..

WIKE has filed for a declaration at the supreme court challenging appeal court when it gives orders setting aside a high court Judgement even when the subject matter hasn't been debated at the Appeal court, and the fallacy of issuing a wrong order to Lagos state even when Lagos was declined to join the suit by same appeal court to join as a respondent was laughable and ribcracking this amount to sitting on its own appeal...

picking on this error by wike will stretch the supreme court judges who will be titght pressed to expunge loopholes if there is any to favor FG
