BUHARI SIGNS ELECTORAL ACT AMENDMENT BILL INTO LAW

The Electoral Act Amendment Bill 2022 has been signed into law by President Muhammadu Buhari (retd.).

On Friday, President Buhari signed the bill at the Presidential Villa’s Council Chamber.

Professor Yemi Osinbajo, Vice President; Ahmed Lawan, President of the Senate; and Femi Gbajabiamila, Speaker of the House of Representatives, were all there to witness the signing of the Bill.

In his address, President Buhari said in line with established tradition, he received inputs from relevant ministries, departments and agencies of government after careful and thorough reviews of the Bill and its implications to democratic processes in Nigeria.

He said, “It is gratifying to note that the current Bill comes with a great deal of improvement from the previous Electoral Bill 2021. There are salient and praiseworthy provisions that could positively revolutionize elections in Nigeria through the introduction of new technological innovations. These innovations would guarantee the constitutional rights of citizens to vote and to do so effectively.

“The Bill would also improve and engender clarity, effectiveness and transparency of the election process, as well as reduce to the barest minimum incidences of acrimony arising from dissatisfied candidates and political parties.

“These commendable efforts are in line with our policy to bequeath posterity and landmark legal framework that paves the way for credible and sound electoral process that we would all be proud of.

“Distinguished Senators and Honourable Members of the National Assembly, from the review it is my perspective that the substance of the Bill is both reformative and progressive. I am making this bold declaration because I foresee the great potentials of the Bill. Worthy of note include the democratic efficacy of the Bill with particular reference to sections 3, 9(2), 34, 41, 47, 84(9), (10) and (11) among others.

“This, however, cannot be said about one provision as contained in the proposed Bill, which provision constitutes fundamental defect, as it is in conflict with extant constitutional provisions.

“Section 84 (12) constitutes a disenfranchisement of serving political office holders from voting or being voted for at Conventions or Congresses of any political party, for the purpose of the nomination of candidates for any election in cases where it holds earlier than 30 days to the National Election. The section provides as follows: “No political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.

“This provision has introduced qualification and disqualification criteria that ultra vires the Constitution by way of importing blanket restriction and disqualification to serving political office holders of which they are constitutionally accorded protection.

“The practical application of section 84(12) of the Electoral Bill, 2022 will, if assented to, by operation of law, subject serving political office holders to inhibitions and restrictions referred to under section 40 and 42 of the 1999 Constitution (as amended).

“It is imperative to note that the only constitutional expectation placed on serving political office holders that qualify, by extension as public officers within the context of the constitution is resignation, withdrawal or retirement at least 30 days before the date of the election.

“Hence, it will be stretching things beyond the constitutional limit to import extraneous restriction into the constitution on account of practical application of section 84(12) of the bill where political parties’ conventions and congresses were to hold earlier than 30 days to the election.

“Arising from the foregoing, with particular regards to the benefits of the Bill, industry, time, resources and energy committed in its passage, I hereby assent to the Bill and request the Nationally Assembly to consider immediate amendments that will bring the Bill in tune with constitutionality by way of deleting section 84(12) accordingly.”

NBC can’t regulate advertising in Nigeria – Court rules

The Federal High Court sitting in Lagos has held that the Nigerian Broadcasting Commission (NBC) acted beyond its powers in seeking to regulate the practice of advertising in Nigeria contrary to the provisions of the extant Advertising Practitioners (Regulation) Act of 2004.

The court also declared that the NBC lacks the power to prohibit exclusivity on privately acquired intellectual property right in programme contents of a right holder viz a viz the salient provisions of the constitution and the copyright act.

Justice Ambrose Lewis-Allagoa also set aside the proposed amendment to the 6th Edition of the NBC Code for being ultra vires, incompetent null and void, and perpetually restrained the Commission from implementing it.

The court delivered the judgment, in a suit filed by a Lagos based journalist, Mr Femi Davies.

Mr Davies had approached the court contending among other things that the amendment sought by the defendant to the 6th edition of the Nigerian Broadcasting Code is in violation of his rights to own intellectual property in Nigeria over which he can exercise exclusive rights.

He had also argued that the amendment if allowed will greatly affect business and the development of the country as a whole as it will frustrate tonnes of investment and hard work of many years.

The NBC on its part had submitted that the amendment to the 6th broadcasting code was done to protect local operators, promote creativity and maximize local contents due to the anti trust provisions contained in the amendment.

It also claimed that the amendment was intended to among other things stimulate growth in the industry and attract foreign investment which would benefit the media industry generally.

But the plaintiff, Mr Davies argued amongst other things, that if allowed, the amendment would greatly violate his right to a fair hearing.

He asked the court to uphold his six reliefs as set out in his originating summons.

The plaintiff’s reliefs include “a declaration that the NBC lacks the requisite vires to prohibit exclusivity on privately acquired intellectual property right in program content of a right-holder viz-a-viz the salient provisions of the constitution and the Copyright Act.

“A declaration that the commission acted ultra-vires in so far as it sought to regulate the practice of advertising in Nigeria contrary to the provisions of the extant Advertising Practitioners (Registration, etc) Act, 2004.

“A declaration that the commission acted ultra vires when it sought to retroactively compel right holders of programme content to compulsorily share extant right acquired under existing licence under the proposed amendment to the 6th Edition of the NBC Code.

“A declaration that the commission acted ultra vires when it sought to retroactively compel right holders of programme content to compulsorily share extant right acquired through a partnership and /or joint venture with an investor under the proposed Amendment to NBC Code.

“An order setting aside the amendment of the NBC Code and an order of perpetual injunction restraining the NBC from implementing the Amendment to the NBC Code.

In his judgment, Justice Lewis-Allagoa held:

“I agree with the submission that acquisition of exclusive rights to Broadcast a particular program is an investment for returns and by virtue of the above-stated provisions, no one should be forced to surrender same when it is lawfully acquired…

“I am in agreement with the plaintiff counsel that the said proposed amendment is a violation of the principle of fair hearing and natural justice. The proposed amendment purports that the defendant NBC shall without any fact-finding or recourse to the other party place the advertising agency on its black list, solely based on the complaint of a media house to the defendant and the defendant acting has the authority to itself shall pass its verdict without hearing the other parties.

“I have determined the questions in the originating summon in favour of the plaintiff.

“For reasons hereinbefore given, consequently, all the reliefs sought by the plaintiff are granted as prayed. That is the judgment of the court .”

*NEW ADVERTISING REGULATORY LAW INTENDED TO STRENGTHEN INDUSTRY, Says Lai Mohammed*

The Minister of Information and Culture, Alhaji Lai Mohammed has explained that the recent signing of Advertising Regulatory Council of Nigeria (ARCON) into law by President Muhammadu Buhari was informed by the resolve to strengthen the nation’s integrated marketing communications space.

Last week, President Buhari appended his signature to the ARCON Bill (now an Act), which repeals the Advertising Practitioners (Registration, etc.) Act, Cap. A7, Laws of the Federation of Nigeria, 2004 and enacts the Advertising Regulatory Council of Nigeria (ARCON) Act, 2022. ARCON is now recognised as the apex authority for the Nigerian advertising industry.

Mohammed said the Federal Government believes that, if properly carried out, the reforms would enable the regulatory body sanitise the advertising regulatory environment, encourage inclusive growth, attract investments to the sector, and enhance the operating environment for practitioners.

In his paper titled, ‘The New World Order: Digital Transformation in Communication”, the Minister described advertising and brand marketing as prime examples of sectors where consumer data is critical; hence the need for advertising practitioners to leverage technology for direct engagement with the audiences.

He noted that, in a rapidly changing world in terms of dynamics of opportunity and risks, talking directly with consumers in a data-enabled environment would take brands and entrepreneurs closer to their consumers more than ever before.

Mohammed therefore called on advertising practitioners to position themselves in a way that they would be able to avail themselves of the entrepreneurial opportunities awaiting them between technology and advertising.

By the new law, it is now APCON’s statutory responsibility to make provisions for the regulation and control of advertising in all its ramifications and create the Advertising Offences Tribunal among other powers.

APCON Registrar Dr Lekan Fadolapo had hinted that the ARCON bill was before the National Assembly and that the name change was imperative to the realisation of his vision to reposition the advertising industry in Nigeria for growth.

INEC bans election posters, threatens sanctions against violators.

The electoral body threatens to wield the big stick.

The Independent National Electoral Commission (INEC) has banned the display of electioneering posters and the airing of election messages, threatening sanctions against violators ahead of the 2015 elections.

The electoral body said it was poised to enforce the law limiting electioneering campaigns to three months before polling day.

“It is observed that campaign posters are being indiscriminately displayed, while electioneering broadcasts are being aired outside the statutory provision for campaigning towards elections into various elective offices,” INEC said in a statement by its spokesperson, Kayode Idowu.

“This trend is unhealthy and portends ill for the political process. Indeed, it is a threat to Nigeria’s democracy.”

Campaign posters, mainly those for the 2015 presidential elections, have recently flooded parts of Abuja.

In the past few weeks, posters of Jigawa state governor, Sule Lamido and Rivers state governor, Chibuike Amaechi-both under the Peoples Democratic Party; and those of former military head of state, Muhammadu Buhari- under the proposed All Progressive Congress; have appeared in several parts of the federal capital.

The leaders have all denied any responsibility for the bills, claiming they were the handiwork of “mischief makers”.

The electoral body, INEC, said the posters were “heating up the polity”, and it will act to stop the trend.

“The Commission hereby reminds all players of the provision of Section 99(1) of the Electoral Act 2010 (As Amended), which states as follows:

“For the purpose of this Act, the period of campaigning in public by every political party shall commence 90 days before polling day and end 24 hours prior to that day.”

Political parties are advised to note that campaigning outside this provision is a violation of the law, and the Commission will not hesitate to apply appropriate sanctions against culprits as provided by relevant sections of the law,” the statement said.

It called on security agents to apprehend violators of the rule, whose activities in this regard pose a threat to public order.
