A constitutional lawyer, Kayode Ajulo, has weighed in on the controversy over the Magodo Estate Phase Two properties and the exchange of words between Governor Babajide Sanwo-Olu and Abimbola Oyewole, a Chief Superintendent of Police.

Some policemen, who laid siege to an estate in Magodo, Lagos, had defied Sanwo-Olu’s directive to leave the place.

Apparently surprised by the police’s refusal to comply with his directive, Sanwo-Olu had gone to the estate personally.

In a viral video, the governor was seen exchanging words with Oyewole, who told him that he and his armed colleagues were at the estate on the orders of the Inspector-General of Police, Usman Baba; as well as the Attorney General of the Federation, Abubakar Malami (SAN).

The South-West Governors’ Forum had condemned the exchange of words with the governor which they described as a show of disrespect to Sanwo-Olu who is the Chief Security Officer of the state.

They asked the President to call the Inspector General of Police and the Minister of Justice to order over the forceful implementation of the Supreme Court judgement which awarded 549 plots of land on the judgement creditors who are the Shangisha Landlords Association.

But Ajulo said if not for his immunity, Sanwo-Olu should have been arrested for allegedly attempting to stall the implementation of judgment of the highest court of the land.

Ajulo in a statement titled, “Sanwo-Olu & the Police Face-Off” said, “The context and the background leading to Gov. Sanwo-Olu of Lagos State face-off with the Chief Superintendent of Police at the Magodo Estates needs to be further interrogated.

“In all sincerity, the Governor, I must say is misguided, his extant action at the estate amount to grandstanding, incitement against constituted authority, and an attempt to subvert the cause of Justice.

Only in our clime this could happen. The Governor and his government are parties in the matter, in fact they’re Judgment debtors. What’s expected of the Governor by his Oath of office is to ensure that the judgment of the court is executed or find a way of appeasing the Judgment Creditors, that’s ensuring justice is done to all parties.

“Whereas he is seen giving contrary order to the Judgment enforcement team lead by the CSP in a way to compromise the interests of the Judgment creditors. Save for his immunity, he ought to be arrested and charged for contempt of the court. Kudos to the police officer for his professionalism.”

Which Governor has been arrested by US police amid all Executive rascalism?

Except on corruption, no State Executive can be arrested anywhere in the word for trying alternative dispute resolution.

According to Nigerian Constitution, the Governor has a final say on land in the State with good reasons and payments of compensation. Moreover, this issue was done by past military regime.

Most residents of magodo estate are politicians, their relatives and their tenants.

It was obvious that sanwoolu was forced to that estate by his associates who asked him to go there and use his power as the chief security officer of the state.

The dumb governor isn't even aware that nobody, not even the president can stop the law enforcement agents from carrying out a supreme court order.

I respect that policeman so much, he knows his power and limit more than a sitting governor who doesn't even know the rule of law.

Mind you the governor was a resident of magodo before he was elected.

The state has exhausted their alternative disputes measures since they couldn’t settle out of court until the Supreme Court. Lagos state is at fault in every Avenue, anyhow you want to bend the law.

One state cannot disrespect the Supreme Court, because it’s Governor is a puppet for a shadow man.

Let me even shock you, the Constitution doesn't say you can't arrest governors, it simply says you can't sue them..

Yes, our able and reasonable governor was misguided.

This is a Supreme Court judgement execution. He should have found a way to 'appease' the judgement.

I like Sanwo-Olu and his approach to governance.

Are the police there in favor of residents or government? I didn't follow the case though...but the little I read shows that the residents won the case at various levels but are being harassed by the government undecided

In the US they have state police which is controlled by the Chief executive officer of the state (governor) which make them answerable to the governor unlike in Nigeria where we have federal police controlled by the president .

In the Nigeria the Inspector General of police is actually more powerful than a state governor as he takes orders from the president alone , even the state commissioner of police in Lagos state will wait for IG's directive before carryong out the order of the governor.

A sitting governor dont have the power to override order of the highest court of the land, The IG and the AGF in a case he is party to.

Sanwo-Olu goofed big time

Ladyexcellency, you are allowing sentiments to cloud your reasoning or maybe you didn’t know the fact of the matter. The police came to enforce the judgement of which the State is a party to, and the judgement was against the State. The Governor rather than seeing that the judgement of the highest court was carried out, instead stood in the way.

Background of the story: Years ago, Lagos state government, under the military regime, land-grabbed some landed property belonging to Shangisha people of Magodo under a false pretense of using the land for public interest, only to turn around and shared the land amongst themselves and their elite friends and families.
The original land owners having seen that the government scammed them of their land went to court. All the court judgements since 1984, up to the recent judgement by the highest court in the land(Supreme court), favored the original land owners.

The AGF, being the number one law officer of the land, sent policemen, who are number one law enforcer in the land, to execute the final order of the supreme court of Nigeria.

However, Lagos governor, the number one "Pointus" Pilate of the land, went there to subvert, interrupt and prevent the execution of a valid court order.

So it was actually the FG protecting the interest of Shangisha people who were scammed by the state government.

Like you earlier said,you didn't follow the case,so, it's low of you to have said the "residents won the case at various levels".
The supreme court made a judgement on that case have you bothered to have a read on what the final judgement is ?
Because that's the most important thing in this conversation.

Oga the supreme court's decision on matters such as these is final in any functioning democracy. It's only in a lawless country such as ours that it would take 10 years for a supreme court judgement to be enforced. I agree with the lawyer on this, the governor erred

The resident and the Lagos State government are the judgement debtors while one Adeyiga family is the actual owner of about 549 plots in magodo...

Lagos State government took the land from one Adeyiga family..so the Adeyiga family took Lagos State government to court from high to appeal to supreme...and the judgement was in their favour..Since 2014 or thereabout


Nobody is harassing the current residents of Magodo...it's just the Adeyiga family trying to retrieve their lands...

Lagos State tried to relocate them to ibeju lekki but they didn't accept... because you the value is low compared to present day Magodo


The policemen only escorted court Sherriffs to enforce supreme court order....
