PDP and Judicial rascality. How can you expect a court to remove a governor who was voted by the people and not by the Party?

Indeed the party is just the vehicle through which he rode to power but the votes were given to him as an individual which is why even Inec when presenting his certificate of return has his name on it as the winner and not that of the Party.

PDP keeps showing how desperation can make one act like a court Jester and a fool

What of Amaechi's case when he became governor in 2007?

Election was already completed, and the PDP candidate sworn in.

5 months later, the supreme court ruled that Amaechi is the original candidate of the PDP, and he should be sworn in instead.

Also, Amaechi's tenure expired 4 years after the initial guy was sworn in (not 4 years after he was sworn in).

If Votes belong to individuals (and not party), how can this happen? shocked

That judgement delivered by that honourable Justice inyang is what the situation is just say that the supreme is control by APC when it get there is will be rubbish

This is not about who controls the Supreme Court but about the Judicial rascality being attempted by the PDP in the face of the Constitution of the Federal Republic of Nigeria.

Where did the Judge manufacture his Judicial foundaton for such ruling from?

Chief is lead counsel to Prof Ben Ayade and I don't expect a different view. Votes in an election belongs to party not candidates, Supreme Court judgements on Omehia vs Amaechi, Bello vs Faleke etc the pdp sought enforcement of section 221

For once, Ozekhome decided to stand on the side of the law. I actually expected him to take a biased position as usual but I’m pleasantly surprised he took the right position.

Nigeria judiciary system is contradictory...the same people same votes belonged to APC in the case of Late Prince Abubakar Audu case of Kogi State... which the APC have to present the second Runner up of the primary. If votes are for individuals then why didn't INEC nollify Kogi Elections after the death of Abubakar of APC in 2015 And conduct a fresh elections

I know from the beginning that the judge that delivered that judgement is not sound in law. Atiku vs Obasanjo, supreme Court made it clear that executive can cross carpet and still maintain his seat.

If the judiciary can harmonize their judgment, I think the cases in courts would be minimal, but everyone just heading to court to try luck and see where the judiciary will swing to in their cases,

If votes belong to candidates how come INEC will declare a party winner without a candidate?
How does that even made sense that you can use and dump a party that brought you to power, it is even morally wrong,

Time for the judiciary to work in synergy

But the issue shows that votes belong to the party - not individuals.

If Votes belong to individuals, the other guys votes in the election couldn't have been awarded to Amaechi.

Also, Amaechi's tenure would have expired 4 years after he was sworn in (and not 4 years since the original guy was sworn in).

Nigerian constitution and judicial system is a scrap.
When prince Audu Abubakar died before the final announcement of the winner, Yahaya Bello was nominated to inherite the votes already casted for Audu/ Faleke ticket on the premise that the votes belongs to the party and not individuals. This was upheld up to supreme Court.

Now, why will the same supreme Court contradicting itself?
I'm not for or against any party but we are in a banana republic.

There should be no much noise about this matter bcoz it's clear in d constitution that the only thing that can remove d president,vice president, gov n deputy gov from their seats after swearing in are;
1. The legislative arm
2. Pre_election case such as matter arising from primary election or matter of disqualification brought to the court before the election.
Any other matter even criminal matter is trash while the exco can face that after his term.

Wow coming from pdp lawyer wahala deyoo I kept telling myself ,is it not the candidate that was returned as winner, is it the party,he returning officer will say Mr this and that having pulled the highest number of vote is hereby returned as a winner, that judge should refund pandemic development party their stollen funds and proceed to any psychiatric hospital
If you're saying a party is inconsequential, why then contesting under a party platform? You think you can use a party to win elections and later discard such?

PDP or APC?

Which party did he campaign with? Who gave him the ticket to run under their party?

If you remove the 17 Honourables, then you swear in the 17 who came second in 2019 election and incidentally they're original APC. No be the same?

Then on Umahi, he cannot be removed bcoz the judgement is not based on any section of either the Nigeria constitution or Electoral Act or judicial precedent. The judge just decided to go on sabbatical judicial travel.

This is not about who controls the Supreme Court but about the Judicial rascality being attempted by the PDP in the face of the Constitution of the Federal Republic of Nigeria.

Where did the Judge manufacture his Judicial foundaton for such ruling from?

The major thing the judge emphasize on is that the vote the governor used to be governor are those of PDP and it is very correct.
During election people voted party and not individual so why carry the mandate of a political party to another political party.

That is common sense at work...so when leaving it will be better you return it to the platform your got that power.

President, Vice President, Governors, dep Gov can only be removed on 3 grounds:

Death
Pre Election matters
Impeachment.

Are you okay now?

But the lawmakers can be removed unless if they can proof that there was crisis in the Party.

I don't know where PDP is bringing a replacement from.
