The Appeal Court sitting in Enugu, Friday dismissed the suit filed by the candidate of the All Progressives Congress, APC, Ebonyi State, in the 2019 Governorship election, Senator Sonni Ogbuoji and his Deputy, Chief Justin Ogbodo Mbam, which demanded the Court to declare the seats of Governor David Nweze Umahi and his Deputy, Dr Kelechi Igwe vacant on account of their defection from the Peoples Democratic Party, PDP to the APC. Recall that on Tuesday, February 28, 2022, the Ebonyi State High Court sitting in Abakaliki, struck out the same suit and awarded N500, 000 as damages against the plaintiff. In a 37 minutes ruling, the Judge, Justice A.O Belgore dismissed the suit for being inconsistent with the constitution and extant laws of the country. Details later: |

Fahdiga: Where is it written in our constitution or Electoral Act that president, vice president, governor, or deputy governor cannot change party or defect to another party? The constitution only talked about lawmakers. Get it right. That judgement sacking Umahi was purchased by Wike and we all heard him confirming that he (Wike) was behind the removal of Umahi. |

The reason is because the plaintiffs in this case (APC flagbearers) cannot claim to have suffered serious damages by reason of the defections since the election was won and lost squarely back in 2019. Umahi may, however, not survive the case the PDP has against him. |

Harrison4adam:Did u read the post or just jumped to conclude as usual This was not a PDP case, it was a case brought to court by the APC candidate that contested with him in the last election. The APC candidate is saying since he decamped to the same party with him, he should forfeit the seat for him. It will take lobbying and alot of bribing to stop the PDP case from coming out because it is a legit case 1 Like |
