What happened in Omeha versus Rotimi Amechi in River State PDP can not happen in Osun State PDP between Dotun Babayemi and Senator Nurudeen Jacson Ademola Adeleke because the facts of the two cases are different .

Firstly, in the case of omeha versus Rotimi Amechi the National organ of the Party came to River State to conduct their governorship primary and both aspirants were in attendance at the end of the exercise Rotimi Amechi emerges as the Party candidate but for the reason best known to the then PDP National organ Omeha name was sent to the INEC as the party candidate. Rotimi Amechi went to Court to challenged the decision of the Party National organ of the Party and the Supreme Court ruled that the ballot paper in Nigeria does not include the candidate name only includes the party name and the party logo therefore all vote cast during the election belong to the party and since Rotimi Amechi won the pdp primary before his name was changed he won the election and should be sworn in immediately.

In the reccent case of Dotun Babayemi and senator Nurudeen Jackson Ademola Adeleke the National organ of the party picked an accredited venue for the primary in conjunction with the INEC as required by law and on the morning of the primary day Dotun Babayemi decided to go to another venue (Wocdif) to announce himself as winner of the Party governorship primary and the National organ of the Party and Inec went ahead with the primary at the accredited venue and senator nurudeen Jackson Ademola Adeleke emerged as the party candidate. Senator nurudeen Jackson ademola Adeleke had been given certificate of return by the Pdp national organ and his name had been sent to the Inec and the Inec had pasted his name as the pdp candidate for the osun state governorship election July this year.
Position of law from the above scenario .

(1) No court take over the duty of any political party by electing their candidate for them Supreme Court had ruled on this in different plethora authorities that no court should dabble in to the internal affairs of the political party.

(2) An aspirant that want to challenge the out come of a primary election of his or her party must participate in the primary to have locus . In the eyes of the law Dotun Babayemi did not participate in the governorship primary that produced senator nurudeen Jackson Ademola Adeleke having abandoned the accredited venue and went elsewhere to declare himself.

(3)The case of omeha and Ameachi is not the same as the current issue between dotun babayemi and senator nurudeen Jackson ademola Adeleke.

(4) The osun people should ignore all unfounded rumours from any quarter and prepare for the coming gubernatorial election in the state which is scheduled to come up by July this year.

The issue that emanated concerning party delegates was only an exparte order which would only lapse for just seven days and which had lapsed. The main suit is still pending before the court moreso the hon judge that gave the order had adjourned that case sine die for the same order had been appealled against by the Party at the Court of Appeal Akure, therefore as it is now, there is no subsisting order of the court recognising any delegates from Dotun Babayemi camp until same is determined by the Appeal court Akure.

Pdp is not the only party in osun state and we all witnessed how the national organs of the other parties in the state came to conduct their Congress and primary and we also saw and heard the decision of the Federal High Court that no court has power to dabble into the internal affairs of any party on the suit instituted against the APC by Top group in the Party shortly after the congress of the party .
