Do you have any question on Islamic Inheritance? Post it here. It will be answered In Shaa Allah. Example: A man dies leaving behind his wife and three children: a male and two females. His estimated worth is N10m. How much will each person be entitled to? Wife = 1/8 = N1,250,000 The children are to share the remaining N8,750,000 such that the son receives twice the share of daughters. Thus, Son = N4,375,000 Daughter 1 = N2,187,500 Daughter 2 = N2,187,500 Due to the presence of a SON, the deceased's brothers, sisters, etc. will inherit nothing. The deceased's parents (biological and duly wedded father and mother) will inherit. But in the example above, they are assumed to be late i.e. have passed on before the deceased. PRIMARY HEIRS When a Muslim dies, his/her frontline heirs are: 1. Both parents – biological and duly married father and mother. Biological means man and woman who contributed to the chromosomal composition of the child. Thus, adoptive parents are not legal heirs of their adopted child and vice versa. Duly married means that the child is conceived after a marriage contract. A child conceived out of wedlock (even if the man and woman get married before he/she is born), is attributed to his mother only. So, only his mother will inherit if the child passes on and vice versa. 2. Children – progenies of a deceased that are conceived after a legal marriage. 3. Spouse – husband/wife/wives of a deceased. These three categories are called BASIC HEIRS. If they are alive, they must be given a share of the inheritance no matter how big or small it is. |

SHARING FORMULA Islam has prescribed standard shares to be given to each heir. That is why it is quite rare to see/hear law abiding Muslims fighting over inheritance since everyone knows what he/she is entitled to. Mother 1/6 of her deceased son’s/daughter’s property if he/she has a surviving child. 1/3 of her deceased son’s/daughter’s property if he/she does not have a surviving child. Father 1/6 of her deceased son’s/daughter’s property if he/she has a surviving child. 1/3 of her deceased son’s/daughter’s property if he/she does not have a surviving child PLUS ANY LEFTOVER. Husband 1/2 of deceased wife’s property if she has no surviving child from him or a previous marriage. 1/4 of deceased wife’s property if she has a surviving child from him or a previous marriage. Wife 1/4 of deceased husband’s property if he has no surviving child from her, other wife/wives or a previous marriage. 1/8 of deceased husband’s property if he has a surviving child from her, other wife/wives or a previous marriage. |

SHARING FORMULA (CONT.) Daughter 1/2 of her deceased father's/mother's property if she is the only surviving child Two or more Daughters 2/3 of their deceased father's/mother's property if they are the only surviving children Son(s) Whole property of his/their deceased father/mother - to be shared equally. If the deceased leaves behind parents and/or spouse, the son(s) inherit whatever remains after parents and/or spouse have been settled Sons(s) and Daughter(s) Whole property of their deceased father/mother - to be shared such that son(s) get twice the share of daughter(s). If the deceased leaves behind parents and/or spouse, they shall inherit whatever remains after parents and/or spouse have been settled |
