If their action contravenes the Constitutional stipulations, someone can approach the Court and get them dragged out….same way elected Governors were dragged out when their elections were subsequently declared null and void. Nobody is above the law my friend!

The question is, did they resign at anytime before the withdrawal of their political ambition?
Question should be: Did they submit a resignation letter to Buhari or SGF and did Buhari already accept their resignation?

If YES, they must be re-appointed by Buhari and confirmed by the senate. If cleared to return to the FEC, they must be sworn in to begin a third tenure as ministers. If Buhari just accepts their withdrawal and retain them in FEC, it would be ultra vires under the law. Meaning that Buhari would be exercising powers beyond what the law gives him. Effectively exercising power of legislature and executive at the same time.

Of course Buhari can claim that he was still pondering about accepting their resignation. Provided FG, through media aid, SGF or anyone officially speaking on behalf of Buhari/FG has not publicly communicated that Buhari has accepted their resignation.

All other ministers that resigned published their letters. Malami's resignation will make the most headline of all resignations because of the power he has wielded to himself in this ungodly administration.

Attention seeker with blocked head; the subject matter is valedictory not FEC meeting, and the question is, if there was one, what for?

My question that is too hard for sized mind is, do they do valedictory meeting/get together or whatever for people whose exit has not been duly confirmed?!

Will such receiver who has rejected or planning to reject your resignation organize valedictory meeting in your honour?

What the legal luminary is pointing out is to the extent, as alluded by the Minister for Information, that there was a valedictory session of FEC held in honour of the 10 outgoing ministers for which 9 of them except the junior Education Minister were present.

And his point which is not ambiguous is that if the official spokesman of the government said there was a valedictory session, it will simply mean all other administrative procedures for resignation has been concluded!

So I beg to say the scenario that you painted here is valid but does not suffice in this very instance.

This evidence should only say one thing; there's no coherence in leadership; someone (maybe SGF) rushed to organize farewell session and the President doesn't have time to ask relevant questions as to why, since/when he's not accepted the affected ministers' resignation!

Falana was not singling Ngige out in his simple expression of the position of the law.. he's simply saying if anyone has resigned, and has been sent off, he or she can't be reabsorbed without legislation.

So whereas Falana may not have copies of their letters, his position is protected in evidence law with the purported valediction session organized for the resignees which was carried by news houses.

So like I said before, if there's anyone who jumped the gun, it is the Cabinet services desk which is most likely, SGF and by extension, the President himself!
