You don't have an intellectual property claim over a work that isn't in any specific form or without an registration to your name.

The only basis that could help him make sense is if he had trademarked it before Peak Milk's usage. Otherwise, his lawyers are just stunting.


Modified: I see he trademarked the phrase. But lawyers know that you don't "trademark" anything that isn't related to concrete goods or products. The phrase, at best, is related to his comedy brand. It's not tied to any concrete product (that's being sold and/or bought). The copyright/trademark registration would thus be null and void. He lucidly has very little chances...

A recorded song is in a form. It passes as a concrete product/intellectual property (even if it isn't copyrighted). That phrase isn't related to any concrete product at all. It's not in any form at all.

And, to correct you, comedy brands "are not products bought and sold." There's a pellucid difference between a product and a service. A good dictionary can help...

Even at the registration, a copyright of the phrase is likely null and void, given that it isn't directly connected to any concrete product he sells or intends to sell. Copyright laws are only valid to the extent to which they relate to concrete products. Such a copyright registration would, in this case, be invalid.

Beyonce trademarked blue ivy's name, lets see who has two heads to want to name their child that name, you will wish you don't. That trademark has been accepted for registration, it is not yet registered. When it is, he is given a certificate. Before he gets the certificate, it is published so that if anyone has an objection, the can come forward.
Sabinus is like a pregnant woman fighting another woman for beating the child in her womb.

The issue here is a phrase. It doesn't fall within the basic requirements for a copyright according Nigeria's copyright act. As per the trademark, Nigeria's trademark act only allows for trademarking things directly linked to concrete goods and products ONLY.
