How can Sheriff with disputed credentials take part in the primaries. He stands disqualified.

Even if the new primary is going to be conducted, can they really meet up before the deadline day of submission which is next Friday bearing in mind there's public holiday on Monday and Tuesday and they need to give INEC notice. I think it's over for PDP in Delta.

Yes, what the petitioner asked for was for Oborevwori to be disqualified. Once the Court grants same, he will come in there, because he came second.

However, INEC will be on Siddon look because it will still go up.


It could be what he asked for but was that prayer granted? Did the judge make an order to that effect? It is not all prayers that are granted by the court, moreover has the time lapse for substitution of candidates by political parties not elapse?

In cases like this substitution of names does not come into play. The runner up automatically becomes the flag bearer.

The answer to your questions is Yes.

1. The Court nullified his Candidacy that he shouldn't have participated in the first place.

2. That he shouldn't carry himself as the PDP Guber Candidate for Delta State.

3. That INEC and PDP are restrained from accepting his Candidacy.

4. Yes, substitution window is not closed.

I am sure the full judgement will still become public.

According to section 29(6) of what you attached, the sponsoring party stand disqualified from the contest. If the general election has been held before this judgement and PDP had won, the party that came second would be declared winner.

The aspirant that came second at the primary election cannot inherit the ticket since the winner and party have been jointly disqualified. Now I see why the judge simply disqualified Sheriff without granting any other consequential order in favour of the petitioner. Las las, Na Supreme Court go decide this matter.

Okowa will be removed as vice presidential candidate. We the deltans are not even supporting okowa. They are fighting themselves to make way for omoagege who is buying transformers and Installing streets light all over his constituency.

All the prayers granted by the court:

1. A DECLARATION that the 1st Defendant is not qualified to participate and/or be declared the winner of the 2nd Defendant’s Delta State Governorship Primary elections which held on 25th May, 2022 for the purpose of electing its candidate or flagbearer in the forthcoming 2023 Gubernatorial Elections in Delta State, scheduled to hold on 11th March, 2023 by the 3rd Defendant.

2. A DECLARATION that having supplied false information and submitted dubious or forged credentials/certificates in order to participate in and be declared the winner of the 2nd Defendant’s Delta State Governorship Primary elections which held on 25th May, 2022, the 2nd Defendant herein is legally precluded from submitting, forwarding or otherwise transmitting the name of the 1st Defendant to the 3rd Defendant as the candidate or
flagbearer of the 2nd Defendant in the forthcoming Governorship elections in Delta State, now scheduled to hold on 11th March, 2023 by the 3rd Defendant.

3. A DECLARATION that the Plaintiff who, next to the ineligible and unqualified 1st Defendant, scored the highest number of valid votes cast at the Delta State Governorship Primary elections of the 2nd Defendant which held on 25th May, 2022, ought to and should be returned and declared the winner of the 2nd Defendant’s Governorship Primaries and, accordingly, returned as the candidate of the 1st Defendant for the forthcoming Governorship elections in Delta State scheduled to hold on 11th March, 2023 by the 3rd Defendant.

4. A DECLARATION that the 3rd Defendant is legally precluded or prohibited from accepting or receiving from, acting on or otherwise recognizing or giving effect to the name of the 1st Defendant as the candidate or flagbearer of the 2nd Defendant for the forthcoming Gubernatorial elections in Delta State now scheduled for 11th March, 2023 by the 3rd Defendant.

5. AN ORDER of this Honourable Court disqualifying the 1st Defendant from participating as the candidate of the 2nd Defendant in the forthcoming 2023 Gubernatorial elections in Delta state, scheduled for 11th March, 2023 by the 3rd Defendant.

6. AN ORDER of this Honourable Court commanding, directing or otherwise mandating the 2nd and 3rd Defendants to replace, forthwith, the name of the 1st Defendant with that of the Plaintiff as the lawful candidate of the 2nd Defendant for the forthcoming Gubernatorial elections in Delta State, now scheduled for 11th March, 2023 by the 3rd Defendant.

That's what I have been saying.

Going by Saleh v Abah, the Supreme Court has set a precedence.

This being a pre-election matter, we agree with the trial Court that votes polled by the 1st Respondent (Abah) through nomination by the 2nd Respondent (PDP) are invalid and wasted. The Appellant (Saleh) being the runner up in the PDP Primary election conducted for the said election automatically steps into his shoes as nominee and winner of the election into the Ado, Okopwu and Ogbadibo Federal Constituency of Benue State.

Abah had forged his Certificate and won the House of Reps election, and Saleh challenged him. The SC though did not let Saleh take the House of Reps seat because he didn't pass through all the stages of the election but ruled that the second highest votes is the winner.

However, in this case, unless the Court ruled that the PDP did not follow the provisions of the Electoral Act or their own constitution, Edevbie is the Candidate.
