"There is a congregation which prays on the second and third floor of a building that was built over a graveyard. Is it permissible for them to pray there and can they carry on doing so?"



Praise be to Allah.

If the building is separate, and there are no graves in the place where prayers are offered, then the prayer is valid. Whether they pray on the first floor or the second floor or the third floor, there is nothing wrong with that and the prayer is valid. But if the graves are on the same floor, on the first floor, and they pray on the first floor, then praying at the graves or between the graves is not valid, because the Prophet (blessings and peace of Allah be upon him) said: “Indeed those who came before you used to take the graves of their Prophets and righteous men as places of worship. Do not take graves as places of worship, for I forbid you to do that.” And he said: “May Allah curse the Jews and the Christians; they took the graves of their Prophets as places of worship.”

If there are graves around the building, so long as the ground is completely free of graves and there are no graves in it – meaning the land on which the building was built, but there are graves around it, in front of it, or behind it, or to its right or to its left – that does not matter if the ground itself is free of graves and there are no graves in it.

But if the land was part of the graveyard, and it was seized by force, then praying there is not valid, and no prayers should be offered in the building, whether on the first floor, or the second floor or the third floor, because it is part of the graveyard and the land was seized by force. So it is not permissible for them to remain on that land or to pray there; rather the building should be removed from the graveyard, because this is wrongdoing and is a transgression against the graveyard. End quote.

I'm interested in anyone showing me where Jews or Christians made the graves of Moses or Jesus their places of worship. I've never heard of that especially Christians who believe Jesus is alive and ascended to heaven.

Salaam alaikum
Pls like my own case now I have buried my mom in the same compound of a plot of land and still have a mosque in that compound but not close to the grave.

From the post above you can pray in your mosquebecause the grave is not under the building but sperate from it.

Compare and contrast

Albāni demanded in four or five of his books that the Noble Grave and the body of the Prophet ﷺ be brought out of the Mosque in Madīnah and its Green Dome destroyed (we seek refuge with Allāh!). Ibn al-‘Uthaymeen said: "We hope one day we'll be able to destroy the Green Dome of the Prophet Muhammad.” Similar statements by other key-preachers of the Khārijiyyah and Najdiyyah movement have led to the demolishment and destruction of shrines, graves, mosques and Islamic heritage by Saudi authorities as well as incited terrorist organisations to attack and perform suicide bombings at these blessed sites whose theological foundation is based on the methodology of Ibn ‘Abd al-Wahhāb, Albāni, Bin Bāz, Ibn al-’Uthaymeen etc.

The reality is, it is a Sunnah to build tombs/shrines/structures ������ (not to be confused with “on”) the graves of the Prophets, Salaf and Awliyā’. It’s also proven from Qur’ān which we’ll demonstrate and show how the Khārijiyyah/Wahhābiyyah sect contradicts our Holy Book.

Allāh جل جلاله states: “Thus did We make their case known to the people, that they might know that the promise of Allāh is true, and that there can be no doubt about the Hour of Judgement. Behold, they dispute among themselves as to their affair. (Some) said, "��������� � �������� ���� ����": Their Lord knows best about them: those who prevailed over their affair said, "��� �� ������ ����� � ����� �� ������� ���� ����."

Now to the explanation of the verse by 11 classical Mufasirīn:

Qādī Thanāullāh Pānipattī writes:
“After the death of Asḥāb al-Kahf a dispute occurred between Muslims and non-Muslims. The ������� said that ���� ���� ���� � ������ ���� ���� ������� ���� ���� �� ��� ����� whereas the ������������ said ���� ���� ����� ����� ��������� �� �� ����� ������ ���� ����. This Āyah is proving that Mosques could be made near graves of Awliyā’ in order to say Salāt in them. Tabarruk is also attained through the tombs of Awliyā’.”

Imām Fakhr al-Dīn al-Rāzī:
“Some people said that the door of the cave should be closed so that nobody can enter it and the Aḥwāl (of Asḥāb al-Kahf) are kept hidden. Some people said that it is better to build a mosque at the door, this saying proves that these people were ‘Ā������ �� ����̄� ��� �������� �� ����������� ��� ������’. And when Allāh said {Those who prevailed over their affair} this refers to the ‘������ �����’ or the Awliyā’ of Asḥāb al-Kahf (i.e. their mu’minīn friends) or the leaders of town. {We will surely build a Mosque over them} so that we can ‘������� ����̄�’ in it and due to it we will ‘�������� ��� ������ �� ���̣�̄� ��-����.’”

Imām Abū Ḥayyān al-Andalūsī:
“The person who told to make a building over them was a ����� �����, she told to make a Church over them where deeds of Kufr can take place; however, ��� ��’������ stopped her and made a Masjid over there instead”

� — [Tafsīr Baḥr al-Muḥīt, Volume No. 7, Page No. 158]

Imām Ḥākim:
“{Those who prevailed over their affair} refers to the ��’������ and they prevailed over this matter in that time.”

� — [Tafsīr al Wāḥidī under 18:21]

Imām Nasafī:
“{Those who prevailed over their affair} these are the ������� ��� ��� ������ who said to build over them i.e. on the door of cave a Masjid so that ‘������� ��� ���� �� �� ��� ���� ��������.’”

Imām Jalāl al-Dīn al-Suyūti:
“They were disputing, that is, the believers and the disbelievers, among themselves their affair, the affair of the youths, with regard to building something around them [as a monument]; so they, the disbelievers, said, ‘Build over them, that is, around them, a building, to cover them up; their Lord knows them best.’ Those who prevailed regarding their affair, the affair of the youths, ������ ��� ��������� ‘We will verily set up over them, around them, a place of worship, for prayers to be performed therein.’ And this indeed took place at the entrance of the cave.”

Imām Ibn Jawzī:
“Ibn Qutaybah (raḥimahullāh) said that the Mufasirīn said: ‘People who made Masjid were the (������) ���� ��� ��� ��’������ ����������.’”

� — [Tafsir Zād ul-Masīr, Volume No. 5, Page No.124]

Imām Shihāb al-Dīn al-Khafājī:
“(Making mosque on cave) is ����� �� ������ ������� ���� ��� ������ �� ��̄���̣��� just like It is mentioned in Tafsīr al Kashāf and it is ��������� to pray inside this construction.”

� — [Ināyatul Qādhī, Volume No. 6, Page No. 87]

Mullā ‘Alī al-Qārī:
“Anyone who builds a mosque near the grave of an upright person or prays in the tomb (Maqbara) or intends to ask for help through the Rūḥ of that upright person or intends to seek barakah from his left overs, if he does all that without the intention of giving him Ta’dhīm or doing Tawajjuh towards him (in prayer) ‘���� ����� �� ������� ����� �� ����, don't you see that Grave of Ḥadrat Ismā’īl (AS) is inside the Masjid ul Ḥarām near the Hateem and to pray there is superior than anything else’. However to pray near the graves is only forbidden when the soil becomes dirty because of Najāsah of deceased… In the Hateem near Ḥajr al Aswad and Mīzāb there are ‘graves of 70 Prophets.’”

Al-Qārī also states: “The early Muslims (Salaf) have considered it ����̄�̣ (�.�. �������) to build over the graves of famous Mashaykh and ‘Ulamā so that people can visit them and sit there (easily).”

‘Allāmah Ismā’īl Ḥaqqī Bursevī:
“To build over the graves of the ‘Ulamā, Awliyā’ and the Sāliḥīn is a ����������� ��� with this condition that the motive is that the greatness of these pious people must be made apparent so that the people don't think that it is an ordinary grave."

Ḥāfidh Ibn Kathīr
"When the people of the cave went into the cave, some people close to the entrance of the cave said, 'Build a mosque so we can worship Allah.' The people who said this were Muslims.”

Imām Abū Ḥayyān al-Andalūsī:
“The person who told to make a building over them was a Kafir woman, she told to make a Church over them where deeds of Kufr can take place; however, the Mu’mineen stopped her and made a Masjid over there instead”

Imām Ḥākim:
“{Those who prevailed over their affair} refers to the Mu’mineen and they prevailed over this matter in that time.”

� — [Tafsīr al Wāḥidī under 18:21]

Imām Nasafī:
“{Those who prevailed over their affair} these are the Muslim and the rulers who said to build over them i.e. on the door of cave a Masjid so that ‘Muslim can pray in it and seek Tabarruk.’”

Imām Jalāl al-Dīn al-Suyūti:
“They were disputing, that is, the believers and the disbelievers, among themselves their affair, the affair of the youths, with regard to building something around them [as a monument]; so they, the disbelievers, said, ‘Build over them, that is, around them, a building, to cover them up; their Lord knows them best.’ Those who prevailed regarding their affair, the affair of the youths, namely the believers ‘We will verily set up over them, around them, a place of worship, for prayers to be performed therein.’ And this indeed took place at the entrance of the cave.”

Imām Ibn Jawzī:
“Ibn Qutaybah (raḥimahullāh) said that the Mufasirīn said: ‘People who made Masjid were the (Muslims) King and his Mu'mineen companions.’”

Imām Shihāb al-Dīn al-Khafājī:
“(Making mosque on cave) is proof of making mosques over the graves of saliheen just like It is mentioned in Tafsīr al Kashāf and it is permitted to pray inside this construction.”

Mullā ‘Alī al-Qārī:
