OSSIEC'S EFFORTS TO HOLD COUNCIL POLLS SUFFER SETBACK AT APPEAL COURT

Efforts by the Osun state All Progressives Congress (APC) and Mr Gboyega Oyetola to further waste almost N2billion on illegal local council election suffered a setback today as the Court of Appeal in Akure struck out OSSIEC's appeal designed to hold the election at all cost.

In a related victory for the Osun PDP family, the same court also set aside a kangaroo judgement which had recognised a dissident PDP group and which formed the basis of Dotun Babayemi's proxy war against the state PDP.

OSSIEC had filed the appeal to frustrate the hearing of the suit challenging the holding of the local government election as it violates the Electoral Act, 2022 and was meant to divert Osun money to private pockets.

The appeal sought to exclude application of relevant Electoral Act provisons from consideration of the suit brought by the state PDP to stop the election. The appeal was particularly hoping to exclude application of the extant Electoral Act which hosting any election will violate.

As it is now , the main matter at the lower court will now go ahead with OSSIEC in clear legal trap as it can not host the election without being in contempt of the court and incurring heavy sanction.

If the Appeal Court had upheld OSSIEC appeal, it would have secured a strong platform to forge ahead with the hosting of the election , banking on the upholding of its position to oust the application of some relevant sections of the Electoral Act, 2022.

Reacting to the judgement, the State Caretaker Chairman of the PDP, Dr Adekunle Akindele congratulated Osun people on this major victory to stop wastage of billions of naira, warning OSSIEC not to hold the election as planned.

"This is a good development for the State. We know APC is not really interested in the election but in deploying and diverting the resources. It is a continuation of the outgoing administration's efforts to plunge Osun into deeper debt and enrich its chieftains.

"We call on OSSIEC to stop this charade. The law is not on its side. Public morality is not on its side. All factors are against such ignoble act including APC members who have gone to court over candidates' nomination", the party Chairman affirmed. The Party Chairman also warned the OSSIEC helmsman that history will not forget the blanket of gross misconduct which he has cast for himself and his members. He assured the good people of Osun State that the incoming PDP Administration will always put their interest and resources of the State into consideration and will not in anyway engage in any frivolity, illegality and criminality that the Osun APC is known for.

An interlocutory Appeal of OSIEC at the Court of Appeal Akure against the ruling of Federal High Court Osogbo which granted application for amendment of all the processes filed by PDP has just been struck out by Lord Justices of Court of Appeal, Akure.
