OSUN GUBER: ADELEKE SCORED 402, 349 AND OYETOLA 374, 256-FORENSIC REPORT

Forensic report admitted as exhibit today at the Osun Governorship Election Petition Tribunal affirmed Senator Ademola Adeleke duly won the July 16 election with 402,349 votes to beat Mr Gboyega Oyetola who polled 374,256.

The report which the Tribunal accepted as a key document posited that the above figures were arrived at after reviewing cases of irregulaties.

The forensic expert, Mr Samuel Oduntan posited that "pursuant to the Order of this Honourable Tribunal dated 2nd day of September, 2022 directing the 1st Respondent (INEC) to allow the 2nd Respondent inspect all the electoral materials used in the conduct of the Osun State Governorship Election, the 2nd Respondent instructed me to carry out the physical inspection as well as digital forensic examination on the BVAS machine devices used for the election.

Noting that he is familiar with all relevant Electoral Documents based on experience since 1999 viz: Voter Registers, Form EC8 series, EC25 Series, EC40 series, Ballot papers, other relevant electoral forms / Guidelines and electoral devices, Oduntan noted that the Respondent instructed him to carry out statistical analysis on the Independent National Electoral Commission’s (INEC) form EC8 Series used during the conduct of the election and also to carry out Digital Forensic Examination of the BVAS machines used in the conduct of election

"I examined the following documents (materials) / BVAS machices obtained from or supplied by INEC: CTC of Forms EC8A, EC8B, EC8C & EC8D ii) CTC of Forms EC40G (where provided) iii) INEC Osun State Directory of Polling Units, 2022 iv) BVAS Authentication Report v) BVAS Machines vi) INEC Regulations and Guidelines for the conduct of elections, 2022 and (vii) Manual for Election Officials 2022.

The report posited that of the 750 polling units being challenged by the petitioner, only six have issues as per over-voting as alleged in the petition with 771 votes of APC affected while affected votes of the PDP was 1, 022.

According to the report, votes of parties on EC8D were 375, 027 for APC and 403,371 for PDP. Less votes affected by irregularities are 771 for APC and 1, 022 for PDP.

According to the report, votes of parties after deduction was put at 374, 256 (APC) and 402, 349 (PDP).

Mr Oduntan who brilliantly defended the forensic report said the observations were reached in consonance with the global best practices required of a Statistician / Forensic Examiner in reaching the observations and discoveries made therein.

Update on Osun Tribunal

Inec witness said when cross examined that there is seeming overvoting in some units

. The question now is what is the dictionary meaning of THE WORD SEEMING? The word seeming Simply means appearing to be something, especially when this is not actually true, giving it a literal meaning in law the word SEEMING means Not true, in this context the Inec witness said No overvoting. Pls check your dictionary on the word seeming before you give your view.

Now the position of Law

It is trite in law that the petitioner in a petition has the burden in law to prove his case and he or she must not ride on the weakness of the respondent case to prove his case. All lawyers know this.

What is required of the law for the Inec to declare a winner in any election is the SUBSTANTIAL COMPLIANCE to the provisions of the electoral act and other relevant laws not total compliance. This position has been maintained severally by the Supreme Court of Nigeria.

The tribunal is on going to round up this petition within the 6months allows by the electoral act and other relevant laws.

It is also germane to know that the outcome of the tribunal will also be tested at the upper /regular courts of the land that is the appeal and Supreme Court by any of the parties and throughout the length of this period the Governor will continue to perform his duties until the case on the petition will be res judicata

OSUN TRIBUNAL UPDATE:

The Forensic Examiner confirmed that multiple BVAS machine can be used for accreditation in a polling unit but only 1 form EC8A can be used to input the result for the subject polling unit.

This is the Original Padlock which INEC used to locked up APC mouth since July 16 but trying to open it in tribunal while INEC doubles the padlock!!

Sections 60 and 62 (1) of the Electoral Act 2022, election and declaration of results starts and ends at each polling units where forms EC8As were signed by all parties agents.

The commission affirmed that over voting cannot be proven except through diligent comparison between form EC8A and the physical BVAS machine.

The tribunal has two sets of reports, obe from APC and one from INEC, both are not independent. They tribunal needs to conduct its own forensic report, or make deductions from both reports if it finds them credible.
