A federal high court in Abuja has adjourned till Friday, February 10 for mention, in a suit filed by Pastor Umo Eno, Governorship Candidate of the Peoples Democratic Party, PDP seeking to be joined in an earlier suit that was ruled in favour of Michael Enyong by the Court

This follows a failed attempt by Mr Michael Enyong to effect a change in the court in which the applications were made by Pastor Eno.

Pastor Eno, through his Counsel is seeking to be joined in the suit filled by Mr Enyong which initially involved the Peoples Democratic Party(PDP) and the Independent National Electoral Commission(INEC) as defendants.

Pst. Eno has also applied for an order to set aside that judgment and an order for a stay of execution.

When the case was called before the Justice Obiorah Egwatu presided federal high court in Abuja, Michael Enyong through his counsel, eventually filed his reply on motion, confirming that his earlier application for a change of court, had met brick wall.

It was reasoned that, Enyong was not comfortable with the assignment of the case to Justice Egwatu who had earlier presided over the now famous ‘Status Quo Ante Bellum’ matter against the PDP, INEC, and Pastor Umo Eno and Adhoc delegates by Friday Iwok and co.

Justice Egwatu being very conversant with the case had last year ruled that Eno is the authentic candidate of the PDP and should fly the party’s flag in the 2023 Governorship elections.

Mr Enyong is said to have allegedly obtained judgment in the same case surreptitiously, without the knowledge of the party and the governorship candidate, hence the appeals by the candidate and the party.

Mr Enyong, a member of the Federal House of Representatives had to be served through substituted means, the processes filed by Pastor Umo Eno, after he repeatedly reportedly evaded service.

The motion for stay of execution of the judgment filed on 27th January and all other processes in the suit were eventually served the Plaintiff, Hon. Michael Enyong by substituted means.

This order had followed the persistent evasiveness of Hon. Enyong to be served by the Court.

In granting this order penultimate Tuesday, the Court directed that Mr Enyong be served through pasting the motion on notice on His office at 342 Three Arms Zone, National Assembly Complex(House of Representatives) Federal Capital Territory Abuja or His Residence at No 10 Idris Kutigi Street, Asokoro Federal Capital Territory Abuja with the photograph of the service later tendered in court.

At the sitting of the Court in Abuja on Monday February 6, Mike Enyong through his lawyers argued that Pastor Umo Eno who was not a party to the suit, lacks locus Standi to Appeal the judgment praying the court to dismiss the application.

The Court adjourned till Friday to enable Pastor Umo Eno’s counsel respond to reply on notice and other processes hurriedly filed by Mr Enyong.
