So as it's now, the scenario is as follows:

1. Tinubu has 6m+ votes. 25% in 24 States. 19% in FCT.

He's short of constitutional requirement.

Therefore can't be declared the President.

2. Atiku has 5m+ votes.

25% in 24 States.

10% in FCT.

Can't be declared the President.

3. PITOBI has 4m+ votes.

25% in 24 States.

25% in FCT.

But lesser overall majority.

Can't be declared the President

Since only Obi got 25% in FCT he stands the best chance. After all the wuruwuru are corrected his votes will increase

I know it's the constitution, but it doesn't make sense that you have to have 25% in FCT itself. There's nothing special about the FCT for that clause to be there.

Section 134(3) has been regarded as flawed.



There is actually a subsection that allows INEC declare Tinubu the winner of the election.



My advice to you people is to go and get a lawyer.




But it would be a waste of time. It is open to different interpretations.

Good Analysis @ op... The conclusions on the candidates for run-off elections is would be as follows:

According to the Constitution, the 2 candidates for run-off are:

1. The Candidate with the Highest majority votes ( thats Tinubu _APC)
Against
2. The Other candidate with the Highest votes in more number of states (being Obi _LP)

Number 2 requirement confuses many persons even legally, learned, astute persons.. The loose interpretation of No. 2 candidate is anyboby with highest state won.... Obi won more states than Akitu here (but if remainder candidates won equal states, then person with highest number of votes would be picked to join No. 1)
