Explaining the "and the federal capital territory" in the electoral act in simple and layman's terms. In current affairs, if you are asked how many states do we have in Nigeria? Your response is will be 36 states and the federal capital territory In simple terms, you are leting me know, we have 36 states but we also have a federal capital not called a state. So, when the electoral acts says you must win 25% of the 36 states and the federal capital territory its simply the same logic. Since FCT is not called a state, FCT is also part of the where a candidate can grab 25% electoral votes from. In other words, if you win 23 states and the FCT, you have met the 25% requirements of "24 states" because the electoral act recognises FCT as much as it recognises the states. There is no special requirement in the constitution to live in FCT, citizens who live there are like me and you. Why do you then think, a candidate must win 25% of Abuja residents votes to be decleared winner? Are Abuja residents more citizens than citizens in other parts of the country to make their vote so special, that you must win 25% of their votes in addition to other 24 other states? On what constitutional grounds will that stand? Except you want the electoral act to go against the constitution and just read that a presidential candidate must win 25% of the 37 states. The constitution does not call the FCT a State. The electoral act giving Abuja residents that kind of special status will have been against the federal constitution of Nigeria which recognises all citizens as equal. It so absurd that you think 25% of votes from fellow citizens in FCT must determine the validity of majority of votes that have also attained 25% in 24 states other states. FCT citizens must have Alien super powers So funny to even think of. I wish you luck proving in court that the electoral act can give some citizens super powers by making 25% of their votes a must to be president of Nigeria. koboko69: The electoral specifically mentioned FCT in order to protect the president and give a semblance of safety in this abode of residence in Abuja. How can you feel secured as a president in an FCT where you are not welcome? Can Peter Obi feel safe in Islamic states of Zamfara or Sokoto where he lost by almost 80%? Did the Americans feel safe in Afghanistan? The people who drafted that constitution are not fools, where the president resides, he must some semblance of local support. There is a reason why protests have erupted in the FCT as we speak now. 25% of FCT is mandatory by law. |

I think the reason why people are complicating things is due to their limited understanding of the use of English language and maths. Based on interpretation, in this context (context of how it was written), ‘and’ is basically an addition - since both ‘36 states’ and ‘FCT’ are independent. If ‘FCT’ had a separate requirement - they wouldn’t have used ‘and’ - they would’ve stated the requirement in a separate sentence. So, it basically means, 25% of 24 states in 36 states + FCT. Creeper: 100% Same way you have to include and District of Columbia when asked how many states in the united states. The electoral college awards 3 electoral college votes to the district of Columbia now known as Washington DC, but does not mean you have to win those 3 electoral votes because its the capital. 2 Likes 1 Share |

koboko69: Let me first remind you that if 9 additional states were to be created today to make it a total of 45 states, we’ll stop talking about 24 states but 30 states. The requirement still holds. The constitution could’ve said “25% in 2/3 of all the states including the FCT” and then clarified on the next line that FCT is considered as a state for this requirement, OR “25% in 2/3 of all the states and 1 additional state or the FCT” OR “25% in 2/3 of all the states not including the FCT” The constitution didn’t say any of those, it rather said “25% in 2/3 of all the states and the FCT” which means you need 25% in the FCT and 2/3 of all the states. 1 Like 1 Share |
