You lie.at the point results were disputed by melaye, some results were on the portal. The dispute resolution the electoral act was talking about was at the ward and lga collation. how do you now know that disputes were not raised at that stage and resolved?

In Section -64(5), the Electoral Act stipulated that a higher-level collation officer, or even the last-level returning officer can rely on the “Transmitted Results” to do a fresh collation, and the conditions for such are very clearly spelt out..

“.. if a collated result at his or a lower level of collation is not correct. ..”


Now, let's look at this question below:..

Question: So, how can we arrive at the conclusion that “the collation is not correct”.??

Answer: It is when the disputes raised at the collection center cannot be sorted out by using only the results that were brought in by the officers from the lower level of collation..

Thus, in this election,, the INEC clearly didn't do the needful as required by the Electoral Act itself., and thus, it made the settling of disputes (as required by the Electoral Act) to be very difficult.

Does the court have the right to make judgement that negate the constitution?

Section-149 is actually saying that the current mistakes and errors that were made by the INEC should be considered VALID, unless challenged at the court, and the court now declares it INVALID.
