INEC Must Transmit Governorship Election Results Electronically - Court by press9jatv: 1:41pm On Mar 09, 2023
The Federal High Court in Lagos, on Wednesday, ordered the Independent National Electoral Commission to directly and electronically upload from the polling units to the IReV the results of the forthcoming, governorship and state House of Assembly elections in Lagos State.

Justice Peter Lifu made the order while delivering judgment on a suit filed by the Labour Party and 41 others, in which they sought an order of mandamus to compel INEC to obey the Electoral Act and its guidelines for the conduct of the elections.

The judge held that the court had the jurisdiction to entertain the suit because it was commenced in accordance with the provisions of the law.

He also held that the subject matter of the suit was not a pre-election issue because the reliefs sought by the applicants deal with preparation for elections and not the conduct of the elections.

Justice Lifu further stated that all that the applicants were trying to do was to compel the electoral body to comply with the Constitution, its regulations, and guidelines, following its failure to do so during the presidential and National Assembly elections held on February 25.

Therefore the court granted the applicantsan order of mandamus directing and compelling the defendant and all its agents and their privies or any persons acting under their directions to comply with and enforce the provision of Clause 37 of the Regulations and Guidelines for the Conduct of Elections, 2022 for the conduct of the governorship and House of Assembly elections in Lagos State on 11 March 2023, to wit: Mandating the Presiding Officer of all Polling Units to paste the Publication of Result Poster EC60(E) at the Polling Units conspicuously after completing the EC8A result sheet.”

And what about the presidential election wherein INEC failed to do likewise? This is the most morbid and dreaded fear of APC govt, leadership, their urchins and miscreants on this platform.

They are rejecting BVAS, IREV, and electronic transmission of election results in a 21st century civilization? I can't just fathom it. However, our electioneering, democratic and constitutional processes must make progress.

Good! Anything short of this is against INEC's own law. If Nigeria was civilized country, the sham of a presidential election would have been cancelled for failing the basic requirements as enshrined in the law.

grin

The oppositions are missing something important in their narration.

Okay let's assume transmitting of results electronically is mandatory, is displaying of the transmitted results on INEC public portal is also mandatory?

Because I believe before all the results were announced, the results must have been transmitted to INEC back up server which only they have access to, after verification of both results transmitted electronically and the one about to be delivered physically, then they update the public portal.

If there is no law making transmitting of results electronically mandatory in the Inec public portal, then the petition about electronic transmitting would be quashed so early as the opposition argument is about results in public portal

"The Federal High Court in Lagos, on Wednesday, ordered the Independent National Electoral Commission to directly & electronically upload from the polling units to the IReV the results of the forthcoming, governorship and state House of Assembly elections in Lagos State...."

Guess you understand the English Language there now or you need explanation that it must "be @ the discretion of the criminal INEC" as you lots have been postulating?

This time don't just read my comments emotionally, read it with pure mindset and be healed.

PLP ( People's Labour Party ) claim is the transmitted results were not available on INEC public portal ( take not of the public) even if INEC had them on their back up server while waiting to compare with the physical delivered results before uploading it on INEC public portal?

The question which Apc lawyers would pose is, is there anywhere in the electoral law where transmitting of results to the Inec public portal is mandatory .

Slowly this time, cold water should help

When? It is as ridiculous as waiting for bank alerts before leaving bank premises after collecting your money. We like using technology to hang ourselves instead of help ourselves in this country. So if alert no show till tomorrow and i have collected my money nko, or the BVAS will only be used in Lagos?
What happened to both BVAS and REC from South East states on February 25 that they were the last set of people to arrive collation center?

LP said inec failed to give credible elections because the results doesn't tally with what was uploaded and that they won the elections.
Pdp is saying same thing while claiming they won the elections
Apc is saying they rigged, LP rigged in SE and PDP rigged so they can win because they were the best riggers cheesy
