I’ve seen/read a lot of Tinubu supporters making statements like “the case will drag on for 3 years” and similar things in response to Peter Obi’s case in court against Tinubu’s victory in the last election.

Well, do not know if they have been making those statements out of ignorance or they deliberately want to misinform the public.

Well, I’m here to educate them and the rest of Nigerians, that Election Petition dragging on for years is a thing of the past that has been taken care of by Amendments to the constitution.

This amendment was made to ensure that wrong candidates who were wrongly declared at the polls do not enjoy the privilege of such office for years before being booted out of office through the courts.

To this end, the lifespan of Election Petition Tribunals was pegged at 180 days for Election Petition Tribunal. 60 days for Appeal Court and 60 days for Supreme Court. That’s cumulative of 360 days that an election thief can hold onto a stolen mandate from the time that the petition was filed in court.

This is the reason why the former governor of Imo State, Emeka Ihedioha, spent just about 8 months in power before he was sacked by the Supreme Court. Again, if you have followed Election Petitions in recent years in Nigeria, you’d have realized that no Election Petition has lasted up to one year from the Tribunal to the Supreme Court.

However, it becomes different in the Presidential Election Petition because the Presidential election petition originates at the Appeal Court and not the High Court/Tribunal. What this means is that the Presidential Election Petition Tribunal MUST decide the petition within 180 days from the day the case was filed in court. Any party who disagrees with the ruling of PEPT would now proceed to Supreme Court which MUST also give its ruling within 60 days.

What this means is that the PEPT can decide to give judgment within 30 days or 50 days, but MUST not exceed 180 days. Same thing applies to the Supreme Court.

This goes to say that if Peter Obi and his Lawyers push for a speedy trial as many people are advocating, and get it, the election petition can be decided before May 29th.

Meanwhile, Tinubu and his Lawyers have 21 days from the day they were served with the Petitioner(s) case to respond to the case. They have just about 6 days to that after which trials will begin proper.

So, next time you hear Tinubu boys say that the Election Petition can drag on till infinity, just laugh at their ignorance and move on.

When was Adeleke sworn in? In November, 2022.

Now, remember that both Tribunal and Appeal Court has already decided the case. That’s in less than 5 months.

If they go to Supreme Court, Supreme Court will give her judgment within 90/60 days which would be cumulatively less than 8 months.

So, what are you now saying?

First, can you provide credible evidence to support your claim that Tinubu supporters have been saying the case will last for 3 years?

Secondly, go back and do a better research. Election tribunal which is the court of first instance have a maximum of 180days (6months) to deliver judgment. If the tribunal judgment is appeal, the appellate court (Supreme Court in presidential election petition) have a maximum of 60days (2months) to hear the case and deliver judgment.

So you see, that’s a total of 240days (8months) in presidential election matters.

Supreme Court has another 2 months to decide the case after appeal court judgement last month. So, don’t expect final judgement on Osun till May. Overall, that’s about 10 months.

nope you are wrong here Seunmsg. Appeal Court of justice is 2 months while Supreme Court of justice is 1 month. So by April ending, The Supreme Court of justices will decide on Oyetola appeal case. That’s for the governorship election petition. But for the Presidential election, it takes 210 days cos’ the presidential election petition tribunal takes 150 days while the Supreme Court of justice decide on the appellants case in 30 days for the presidential election . Probably by August or September this year, the Supreme Court of justice will decide on the 2023 presidential election petition this year.

1. Governorship election petition tribunal- 180 days

You got everything mixed up. All election appeal to the Supreme Court takes 2 months maximum whether presidential or governorship. All tribunal cases whether presidential or governorship takes a maximum period of 180 days.

Commutatively, governorship cases last a maximum of 10 months from the day the petition was filed while presidential cases last a maximum period of 8 months.

So either ways, Obi and Datti baba Ahmed's greatest nightmares will eventually come true - which is that Tinubus government would have been inaugurated. Is that not what Datti was arguing to stop in his senseless Channels interview? These people are just labouring in vain because till now they have not been able to show Nigerians how they won the election by publishing their own collated results different from INEC's. Obi and Datti are just clowns!

PEPT is 180 days while SC is 60 days. So PEPT and SC decisions on presidential election are not to be determined till eternity..If time is against the SC , the Apex court will give the judgement in summary and select another day for the details. Buhari vrs ATIKU 2019 SC judgement ...
