The legal battle between Chief Great Ovedje Ogboru and Dr Emmanuel Uduaghan is not over as the leadership of the Democratic People’s Party (DPP) in Delta State has opposed to the verdict of the Court of Appeal sitting in Benin that gave judgment in favour of the PDP in the January 6, rerun election. The Court of Appeal last Thursday, Sept 22, ruled that Ogboru’s appeal was merely academic as the tenure of Governor Uduaghan under contention had expired and hence dismissed the appeal.

The Delta State chairman of the DPP, Chief Tony Ezeagwu while reacting to the judgment told Urhobo Voice by phone that it was quite unfortunate that the judiciary ruled against itself.

He expressed dissatisfaction at the verdict saying that the judgment was not against the Democratic People’s Party but against the judiciary and hence declared that the DPP is heading for the Supreme Court to contest the decision of the Court of Appeal.

“After the election in January, the Court of Appeal did not set up the panel until 28 days before the expiration of the litigation period.

“As for our concern, it is a judgment against the judiciary itself and not against thee DPP.

“We are going for appeal. We want the Supreme Court to hear this and give their verdict.

“We know that Uduaghan cannot have a right and Ogboru should not have equal right. For God’s sake, Ogboru is citizen of this State.

But the PDP whose favour the Appeal Court judgment was given has advised the leadership of the DPP to sheath their swords.
In a passionate appeal, Barr Chief Fred Majemite, the Political Adviser (Delta Central) to Governor Uduaghan said although it is the right of the leadership of the DPP to appeal the judgment, “it is high time for them to sheath their swords”.
“It is unnecessary distractions. The government of Delta State is extending the olive branch to them. I appeal to Ogboru and his followers to join hands with Uduaghan to move the State forward so that Delta State can move to the next level” For him, the victory of the PDP at the Appeal Court “is a good thing for us as it will enable the Governor to continue with his good works.

But if they insist in going ahead to the Supreme Court, we will meet them there”.
