Prof. Adewale told Tinubu that the law does not say "including," but rather that the winner must receive 24 states and the FCT.
The President-elect, Asiwaju Bola Ahmed Tinubu not getting 25 percent in the Federal Capital Territory has been a major issue after the 2023 election.

The opposition had argued that the APC flagbearer didn’t get the required 25 percent that would have got him declared by INEC as the winner of the election. A Former National Secretary of the Peoples Democratic Party, Professor Adewale Oladipo has alleged that the provision of the Law is clear in this regard.

He stated that if the law has used the word including, it would have been interpreted in another way. He however identified that the word ‘and’ that has been used mandates that the winner of the election must have gotten 25% in the FCT before being declared as the winner by INEC.

According to him, if Tinubu has not gotten this then there is a problem. Although some other Senior Advocates had argued rather that FCT is also a state under the law and it doesn’t have a higher electoral value than other states.

Hs said, ”When you read the provision of the constitution, it says to be declared President, the candidate must get 25 percent of the votes in at least two-thirds of the states in the federation and the FCT.

The law did not say ‘including’, it means Winner must get 24 states minimum and the FCT. My simple knowledge of grammar tells me that a winner needs to have 25 percent in FCT. I have not looked at the result of the person declared. If he did not get 25 percent of the votes in FCT, then there is a problem.”

Prof. Let me ask you. What is the essence of the election when all it takes to fail is 'not make' 25% in FCT?

It means even though you win the entire 36 states with 98%, and garner over 34billion votes across the states. Not getting 25% in FCT means another election of 300bn will be re-conducted.

All it takes is political actors without any road to victory or path to majority votes, making sure they block any body from getting 25% in FCT; by crook or hook. Because they know even 25billion votes cant save anyone.

All it takes is political parties focusing on FCT only and giving middle fingers to the other states. They can even try importing people from 36 states into FCT just to vote and scuttle the opposition impending victory

People like Sowore and others who know they cant win will just campaign only in FCT, bribe the residents and make sure the votes are split. Then we will keep repeating election till thy-kingdom-come without president.

As a Prof,e make sense? Is this logical?

Do you think the above three phrases are same in meaning?

In addition, the law would have used including or or instead of and. When and is used, there's no room for option. This is an independent substatement according to the theory of probability.

How do you sane person compare such a woeful performance to that of LP with no single structure or support.?

The amateurish rigging is too obvious that the blind could see and feel it. Your president-select is a placeholder, in fact there are high chances that May 29 inauguration will rather usher in an interim National government

Tinubu's portrait will soon adorn offices of all formal organisations in Nigeria, SE inclusive. Infact any igwe or eze should attempt not hanging Tinubu's portrait in his parlour and see what happens afterwards.

299. The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly -

(a) all the legislative powers, the executive powers and the judicial powers vested in the House of Assembly, the Governor of a State and in the courts of a State shall, respectively, vest in the National Assembly, the President of the Federation and in the courts which by virtue of the foregoing provisions are courts established for the Federal Capital Territory, Abuja;

(b) all the powers referred to in paragraph (a) of this section shall be exercised in accordance with the provisions of this Constitution; and

(c) the provisions of this Constitution pertaining to the matters aforesaid shall be read with such modifications and adaptations as may be reasonably necessary to bring them into conformity with the provisions of this section.

The Prof must have been an IPOB support as the zombies will always say. Waiting for the judiciary interpretation on this sensitive issue. All previous election winners are FCT winners.

It wasnt an error. Check anywhere in the constitution. It is exactly that way. .. 'And' is used between states and FCT.

Even in section 299 i think. The constitution declares FCT as a state.
