Two Obi Witness Contradict Each Other At Tribunal by stocktaker: 8:39am On Jun 23, 2023
Two witnesses of the Labour Party (LP) and Peter Obi contradicted themselves yesterday on the conditions to be met by the Independent National Electoral Commission (INEC) before deploying technology.
A cyber security expert, Dr. Chibuike Ugwuoke, said it was a statutory requirement under the National Information Technology Development Agency (NITDA) Act that technologies to be deployed by INEC must meet the ISO 27001 2013 standard.

He added that INEC must first obtain authorisation from NITDA to deploy such technologies.


But, the Head of the Legal Services Department at NITDA, Emmanuel Edet, said such requirements do not exist under the NITDA Act.

“The NITDA Act does not contain any cyber security standard code – ISO 27001 2013,” Edet told the tribunal.

Ugwuoke and Edet were subpoenaed by Obi and the LP to testify before the Presidential Election Petition Court (PEPC).

Ugwuoke, who said he was engaged by the petitioners to investigate information on INEC Results Viewing (IREV) portal, had tendered his report on Wednesday, in which he claimed to have discovered multiple uploads and strange objects instead of results.

Under cross-examination yesterday by INEC’s lawyer Abubakar Mahmoud (SAN), he insisted on his claim that ISO 27001 2013 was a statutory minimum standard requirement for any organisation intending to deploy technologies.

Although Ugwuoke claimed not to know the Section, he said what he wrote in his statement was copied from the Act.

Ugwuoke said the petitioners recruited him on March 10; that produced a preliminary report on March 17/18 and the final report in mid-May.

Edet, while being led by petitioners’ lawyer, Patrick Ikwueto (SAN), said his agency did not have documents requested by Obi and the LP, concerning the permission granted to INEC to deploy technologies for election and the status of the technologies.

He said the NITDA Act did not contain any requirements about ISO 27001 2013 on cyber security.

The witness also said no provision in their Act makes reference to INEC.

Edet confirmed that the claim by the former Communication and Digital Economy Minister Isa Pantami that there were about 16 million attempts to hack INEC IT infrastructure during the last presidential election emanated from his agency (NITDA).

Earlier, Hitler Uwala, an expert witness called by the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, admitted there were errors in the forensic report he produced for Atiku and his party.

Testifying as the 26th petitioners’ witness, he played down the errors by describing them as “title errors.”

Under cross-examination by the lawyer of President Bola Tinubu, Chief Wole Olanipekun (SAN), Uwala admitted discrepancies in his report about the actual number of the Bimodal Voter Accreditation System (BVAS) machines he examined.

The hearing continues at 9am.

NITDA expert has completely destroyed all of Obi expert witnesses. Have you heard of someone shooting themselves in the foot? That’s exactly what Obi has done to himself. Now, the people who should know have confirmed that 16 million hacking attempts were made on INEC iREV server. What else is Obi still doing at the tribunal? Even the other expert contradicting him also confirmed that there were multiple uploads and strange objects. Are they coming from BVAS held in polling booths? NO, of course. This is another strong evidence that the system was hacked. The lady who claim to work for Amazon may lose her job for declaring there was no such thing happening that day. She was an LP member and she is biased from the report she gave.

Let LP and it's obidients keep consoling themselves, immediately the NTiDA lawyer and LP contradicted themselves, I said it is over. Obi should call some obidient small boys to go and carry all those refuse he dumbs in court for only media sake. Opposition lawyers did great job even though their session is about to start as LP closes it's session.

Even without anymore defense, sensible people know Obi has lost woefully. I am sure Obi lawyers saw what LP expert wrote regarding NTIDA act, why can't they quickly check it up and make ammendment that can put them into trouble. When has it become the duties of IT expert to teach lawyer about law? Also, NTIDA lawyer must have pretended that he did not read LP petition before rushing to court. He has no choice than to say the truth to safeguard his job because he knows about dreadful opposition lawyers Olanipekun and Fagbemi will get to the bottom of case which may cost him his job. Even if LP wants him to lie, it is not possible under that kind of condition.

Obi should go and resume work and stop wasting his time at court, he has lost this case

You are ignorant at best.

The first question you should ask yourself is why was NITDA subpoenad? The answer is for them to show that there were cyber attacks on INEC/AWS servers that made it to have glitches. The fact that there were no documents supporting that claim when requested proved that no complaints came from INEC and therefore no attacks.

Every other question like whether he is a supporter of LP, or whether he has the approval of his DG to be present or whether there was a service agreement between INEC and AWS, or whether the ISO 20017 is mandatory are all mere technicality which cannot deny or deflate the witness report which is facts.

The fact that there were no documents supporting that claim when requested proved that no complaints came from INEC and therefore no attacks.

I think you are the ignorant one. Any argument to support a glitch is against Obi’s position. If Obi agreed there was a glitch which his witness has proven, why were LP and their supporters killing themselves over lack of electronic transmission of results? How would they expect transmission when a situation beyond INEC control has prevented that? Definitely that’s not what Obi wanted. Obi wanted to prove that there was no glitch at all. That INEC deliberately stopped the transmission of presidential results. That’s why the lady who will lose her job with Amazon was called to state there was no evidence of glitch from the AWS server.

You have either been reading the wrong report or you love beer parlours.

Obi and his witnesses have never accepted that there was any glitch. Read my post which you quoted very well for better comprehension.

PO says he is challenging the process. Mr Op have you cared to look up the ISO 27001 2013? You should be very concerned because PO's team just laid it bare with the testimony of the guy from NITDA that INEC didn't follow world's best practices in deploying the technology used in the last elections! So you should be very worried.

If it is further established that there were communication between NITDA and INEC later during the defense, it will further sink the credibility of INEC.

Let me guess that you've never been gainfully employed in any organization otherwise you would have known what ISO means and what it stands for in the daily affairs of institutions.
