An independent company executive with knowledge of the General Data Protection Regulation is known as a data protection officer. Under the GDPR, the DPO job was established to carry out internal privacy assessments and to oversee, direct, and offer consultation on all topics pertaining to the GDPR. Senior management can be reached directly by a DPO for assistance in decision-making about the processing of personal data. The DPO, however, is not completely under the top management’s supervision. This is in place to make sure that, in the event of a conflict of interest, the DPO will not be under pressure from senior managers. For the same reason, IT managers are never permitted to act in the capacity of a DPO.

Which Businesses Need a Data Protection Officer?

A DPO must be hired by some organisations, but not all, in accordance with the GDPR. However, it is advised that you employ a DPO even if your organisation does not need one. Having a GDPR expert on staff can help you keep your company compliant.

Hiring a DPO is required in the following situations, under GDPR Article 37:

When a public authority or a public body is in charge of handling the personal information of EU persons.

When the scope or goal of routine, systemic data monitoring is carried out on an extensive scale, this is referred to as large-scale, regular monitoring.

Special data categories processed on a large scale: This occurs when processing special data categories on a large scale is one of the organization’s key business operations.

Data protection officer requirements :

A DPO is still essential to have in-depth understanding of data protection laws and practises even though the GDPR handbook does not list any prerequisites for the position. They must be familiar with the company’s data processing procedures on a practical level. Overall, a DPO should have knowledge with EU privacy regulations, an awareness of internal infrastructures and IT technology, the ability to conduct information security audits, and leadership abilities.

Depending on the intricacy of your data processing activities, the qualifications may change a little. However, you must hire a DPO once you have defined the ideal credentials.

There are typically three methods for selecting a data protection officer:

A present employee may only be appointed as the DPO if their current responsibilities do not contradict with that of the DPO.

Appointing a DPO full-time and permanently.

Contract-based outsourcing of the DPO position. Data protection officer as a service, or DPOaaS, is provided by many IT service companies
