Activist warns against presidential candidate with dual citizenship
In a letter titled, ‘Secret Memo to the President and Leadership of the APC on the Eligibility of Persons to Contest for the Office of President of the Federal Republic of Nigeria’ dated May 22, 2022, Ajulo said it was important for the APC to get its act together so that the party would not lose its deserved victory.

Ajulo asked the APC to take into consideration the 1999 Constitution specifically Chapter VI, Part 1, Section 131 and which outlines the basic requirements to be met by a candidate to be eligible for an election into the office of the President in Nigeria.


He said these requirements include: the aspirant must be a citizen of Nigeria by birth; the aspirant must have attained the age of 40; the aspirant must be a member of a political party and is sponsored by that political party; and must be educated up to at least school certificate level or its equivalent.

Ajulo added, “Section 137 of the same constitution as amended, goes further to illuminate this matter by providing for several situations which doth render a candidate ineligible to be elected as the President, stating that a candidate will be ineligible: If he/she has voluntarily acquired the citizenship of a country other than Nigeria or has declared allegiance to such other country.”


He noted that the constitution also disqualifies anyone that has been indicted for embezzlement or fraud by a judicial committee of inquiry or an administrative panel of inquiry or a tribunal and which the indictment has been accepted by the federal or state government; or if he/she has presented a forged certificate to INEC.

The lawyer added that the constitution disqualifies anyone who has been found guilty of an offence involving narcotic drugs or any other psychotropic substance by any court or tribunal in Nigeria or any other country.

2023: Fielding any candidate other than Tinubu will be catastrophic, Shettima warns APC
A former governor of Borno State, Kashim Shettima, has said that a frontline APC Presidential aspirant, Bola Tinubu, has the capacity to secure victory for the party in the 2023 elections, warning that “any attempt to explore options would be catastrophic”.

Mr Shettima, who is also the Director-General of the Tinubu Campaign Organisation, stated this while speaking at the Journalist Hangout, a TVC News current affairs program, monitored by our correspondent.

He said: “If our party is desirous of winning the 2023 elections, Asiwaju Bola Ahmed Tinubu is almost a fait accompli. Amongst our presidential aspirants, and with no intent to diminish any of our illustrious countrymen.

Asiwaju is the only candidate with the pedigree, political IOUs and reach across length and breadth of this country to stand shoulder-to-shoulder and even overwhelmed the former Vice President Atiku Abubakar because of his statue and pedigree”.


Any attempt to explore other options, the party has every right [because] we are in a democratic dispensation, but I’m afraid it will be catastrophic to the party.”

Reacting to a trending comment made by the presidential aspirants, Mr Shettima, who is one of the prominent northern elites rooting for Mr Tinubu’s presidency, accused political opponents of distortion and deliberately quoting the presidential aspirant out of context

Mr Tinubu had during a meeting with delegates in Abeokuta on Thursday said it was his turn to become the president having supported President Muhammadu Buhari to become the president in 2015.
Reacting, Mr Shettima reaffirmed that Mr Tinubu had played a pivotal role in Mr Buhari’s victory in the primary election and presidential elections in 2014 and 2015 respectively.


“Whether Asiwaju opponents like it or not, whether they are willing to admit it or not, he played a pivotal role, not only in the emergence of President Muhammadu as the candidate of the APC but in the ultimate election in 2015,” he added.

MATTERS ARISING: Does INEC have the power to disqualify Tinubu?
Amid the build-up to the 2023 presidential election, there has been a rehash of allegations involving several candidates, with the most recent on Bola Tinubu of the All Progressives Congress (APC). Over the past days, court papers about a forfeiture case in the US linked to someone named “Bola Tinubu” surfaced online.

According to the documents on a case dating back to 1993, it is alleged that funds traced to the Tinubu in question are linked to proceeds of narcotics trafficking. The documents also show that the court ruled that the sum of $460,000 in one of the accounts be forfeited to the US government

Reacting to the documents, Festus Keyamo, spokesman of APC presidential campaign council, said the case didn’t prove that Tinubu was linked to illicit drugs, adding that the funds forfeited to the US were tax deductions.

“After all the rigamarole trying to find out whether the accounts where the money came from are linked to drugs, they came to the conclusion that the deposits he made — what these bankers called investments — they said he had not paid tax on these interests. That is all,” Keyamo said.


CAN INEC DISQUALIFY TINUBU?
Although Tinubu is yet to react directly to the court documents, there have been questions over if INEC has the power to disqualify Tinubu considering the issues raised on the 1993 case and the said indictment on links to illicit drugs.


Section 84(3) of the electoral act provides that: “A political party shall not impose nomination qualification or disqualification criteria, measures, or conditions on any aspirant or candidate for any election in its constitution, guidelines, or rules for nomination of candidates for elections, except as prescribed under sections 65, 66, 106, 107, 131, 137, 177 and 187 of the constitution.”

On the disqualification of a presidential candidate, section 137(1) of the constitution provides that:

“(a) subject to the provisions of section 28 of this Constitution, he has voluntarily acquired the citizenship of a country other than Nigeria or, except in such cases as may be prescribed by the National Assembly, he has made a declaration of allegiance to such other country; or


“(b) he has been elected to such office at any two previous elections; or

“(c) under the law in any part of Nigeria, he is adjudged to be a lunatic or otherwise declared to be of unsound mind; or

“(d) he is under a sentence of death imposed by any competent court of law or tribunal in Nigeria or a sentence of imprisonment or fine for any offence involving dishonesty or fraud (by whatever name called) or for any other offence, imposed on him by any court or tribunal or substituted by a competent authority for any other sentence imposed on him by such a court or tribunal; or


“(e) within a period of less than ten years before the date of the election to the office of President he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the Code of Conduct; or

“(f) he is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria or any other country; or

“(g) being a person employed in the civil or public service of the Federation or of any State, he has not resigned, withdrawn or retired from the employment at least thirty days before the date of the election; or

“(h) he is a member of any secret society; or

“(i) he has been indicted for embezzlement or fraud by a Judicial Commission of Inquiry or an Administrative Panel of Inquiry or a Tribunal set up under the Tribunals of Inquiry Act, a Tribunals of Inquiry Law or any other law by the Federal or State Government which indictment has been accepted by the Federal or State Government, respectively; or

“(j) he has presented a forged certificate to the Independent National Electoral Commission.”


In 2007, Tinubu had a case before the Code of Conduct Tribunal (CCT) which he was not convicted for. If he was convicted, the law bars him from public office for 10 years. But it has been 15 years since that case was instituted against him.

Can INEC disqualify Tinubu? The entire provision of the Electoral Act 2022 doesn’t grant any such power to the body to undertake such function or action. Hence illegal. Only a court of law, via an election petition can do that.”

"It is against the Nigerian Constitution to submit forged documents to INEC."
Mr Hayes insisted that CSU records showed Mr Tinubu attended the school, [b]but admitted there were several contradictions that the school’s administrators won’t be able to clarify under oath. Those discrepancies include the June 22, 1977, date that Tinubu’s certificate asserts, as well as the school’s president at the time the certificate was obtained and typographical, font and header errors on the document.

However, on June 17, 2022, Tinubu submitted a certificate to INEC that was purportedly issued in 1979 and signed by Elnora Daniel, who was not yet a staff member of the CSU until 1998 – same year that Tinubu incidentally contested election as governor of Lagos State.

Ms. Daniels was said to have left the school in 2008 following a financial mismanagement scandal, or 14 years before June 2022 when CSU issued yet a fresh certificate in Tinubu’s name under subpoena from a Nigerian lawyer who had inquired about Tinubu’s education there.

INEC have proven history of going to court to testify about the certificate blemish of some politician not in their good books. For instance, the police, and INEC were parties to the certificate forgery case again Ademola Adeleke of Osun State even when WAEC has already testified about same. Why the double standard because Tinubu’s CSU certificate scandal have been raging from time immemorial?

Now what the Nigerian courts, the PEPT made a joke of to insult the sensibility of a nation is what a US court is teaching us how it ought to be done to our shame before the world. It is clear that the APC is filled with a conglomerate of desperate power drunk fellas who have no regard for the law or democratic processes hence have brought this nation to its knees with the shameful scandal of monumental proportion unfolding about the illegitimate president of this nation today

The APC is known for violation of rule of law, & any organisation with disdain for rule of law, cannot stand the test of time. The APC has a very scant regard and respect for the public and for public opinion. It also has a disdain for the law. That makes it a danger to democracy and constitutional rule".

After submitting his certificate, his transcript is only needed by his opponent to mock him on subjects he failed like Mathematics and Economics
