The Supreme Court on Friday said anybody found to have forged certificates to seek qualification to contest for any elective post in the country will not be allowed because of the criminality involved.

The apex court said the issue of certificate forgery to secure eligibility for election is a serious issue that must not be allowed in the country’s body polity.

Delivering judgment in the disputed Okpokwu, Ado, and Ogbadibo Federal Constituency of Benue State, (House of Representatives) suit Justice Sidi Dauda Badeh said Nigeria will be doomed when certificate forgers are allowed to take centre stage in the elections for political offices.

Justice Badeh who delivered judgment in the appeal filed by Honourable Hassan Anthony Saleh upheld his nomination by the Peoples’ Democratic Party (PDP) as the candidate of the party in the 2015 National Assembly Election.

The Apex court said the challenger to the appellant, Mr Christian Abba, who is laying claim to the ticket of PDP for the Federal Constituency must not be allowed to have his way because he has had his hand soiled in a proven certificate forgery.

Abba who was a respondent in the matter was confirmed by the Federal Polytechnic, Mubi in Adamawa State to have forged a National Diploma Certificate in Accountancy upon which he was forced to withdraw from the same race in 2011. Yet in a dramatic turn, used the same forged certificate to secure PDP ticket in the 2014 PDP Primary Election.

Justice Badeh said that Supreme Court, being the highest court in the land must take the lead in righting the wrong so as to bring sanity into the murky water of the country’s electioneering process.

He said the murky water of the Nigeria body politics will remain murky and contaminated until the people who forged certificate with reckless impunity are shown the way out, and that must begin now.


Justice Badeh said that Abba has no basis to be in the race for the National Assembly election in 2015 having been found to have secured the eligibility through forged certificate.

“Let me say it here categorically and with emphasis that this court, being the highest court in the country must rise and take the lead in righting the wrongs in our electioneering process.”

“The murky water will remain contaminated in our body polity until the reckless issue of certificate forgery with impunity is thoroughly address and put to a final end in our own interest,”

The Apex court therefore, nullified the nomination of Abba and ordered that the clearance issued to him by PDP for the National Assembly Election be withdrawn.

In the same vein, the Apex court ordered the Independent National Electoral Commission (INEC) to immediately withdraw the purported Certificate of Return issued to Abba on the ground that he did not merit it.

The Supreme Court ordered that PDP ticket for the constituency must be delivered to Honourable Hassan Anthony Saleh who came second in the 2014 PDP primary election.

The court also ordered INEC that the certificate of return for the seat must be delivered to Saleh being the qualified person to fly the flag of PDP for the 2015 National election.

A Court of Appeal judgment which had earlier recognized Abba as PDP candidate was set aside by the Apex court and in its place the judgment of the Federal High Court which nullified the candidature of Abba and recommended his arrest and prosecution by the Inspector General of Police delivered by Justice Adeniyi Ademola was restored.

I don't have hope in the supreme Court. David Lyon's, Uzodinma and Yahaya Bello's case weakened my confidence in them. But that does not mean that Tinubu is clean, he has been caught and no matter the noise of his supporters he has been caught on false claim on UCL and maybe forgery.

The same supreme court of Nigeria (SCN)that made a 4th place winner of an election?

It's unfortunate but the election was lost when INEC corruptly declared Tinubu the winner of the election.
Just watch as the SCN comes up with another illogical argument to uphold Tinubu's declaration.

You need to read the full Judgement from the Justice Sidi Bage to appreciate this case. I know the case like my backhand.

Justice Bage resigned before his retirement age to go become Emir of Lafia in 2019. When the opposing lawyers tried to bring in technicality, he was so angered that technicality was brought into a case as serious as FORGERY. That the SC will never allow it. All those on the panel with him are either dead or retired (Mary Odili presided, Bata Ogunbiyi, Late C C Nweze & Amina Augie)

Saleh and Abbah contested under the PDP in 2011 for a Fed Const. seat. Abba won, filled the INEC form but was pressured by PDP to step down since the then ACN Candidate, Onjeh had found out about the forged Certificate. Abbah had forged an OND Certificate from Fed Poly, Mubi.
Just days before the election, PDP replaced Abbah with Saleh who came 2nd in the Primary.

Prior to that, In his INEC form before his eventual withdrawal, Abbah had filled that dreaded column: Have you ever presented a forged Certificate to INEC (Yes/No), he ticked NO.

Onjeh challenged PDP at the tribunal that Abbah forged hIs Certificate and PDP had replaced him overnight contravening the Electoral Act. PDP however argued that Saleh had been replaced and it was pre-election. The tribunal held that Saleh indeed forged his document as the Registrar of Fed Poly Mubi told the Court that the certificate was forged, however he has been replaced and nomination was a Party issue.

Now in 2015, Abbah defeated Saleh again in the Primary and infact no other Party sponsored a Candidate in that Constituency but Saleh was waiting.

This time Abbah didn't attach the Certificate and went on to be declared winner by INEC unopposed. However, Saleh went to Court and the Federal High Court said forgery is forgery, whether you attach or not, it has been confirmed. Abbah appealed and the Appeal Court said that since Abbah didn't attach the Certificate again, he is a free man. Again, he didn't knowingly attach it then to be seen as genuine so he is free.

Saleh went to Supreme Court, and the Justice Bage was mad. The Supreme Court made it clear that forgery had no limitation. Have you ever? So, why tick No?

The Supreme Court didn't just invalidate Abbah, they asked the Police to arrest and prosecute him immediately, that was the end of Abbah'a political journey ever.

It is a must, to take the lead, righting the wrong in our society if and when the opportunity presents itself as in this appeal. Allowing criminality and certificate forgery to continue to percolate into the streams, waters and oceans of our national polity will only mean that our waters are and will remain dangerously contaminated.
