The presidential candidate of the Congress for Pro-gressive Change (CPC) in the April 16 election, Major-General Muhammadu Buhari (rtd), yesterday said the dismissal of the party's petition that challenged the presidential election result did not come as a surprise.

Speaking in the same vein, the National Publicity Secretary of CPC, Mr. Rotimi Fashakin, described the judgment as a “miscarriage of justice”.

Buhari, who spoke through his spokesperson, Mr. Yinka Odumakin, said anyone who followed the judicial process that led to the tribunal's judgment would not be surprised that the outcome was against the CPC.

“The judgment did not come to us as a surprise.  Anyone who followed the judicial process with regard to the handling of the presidential petition would not be surprised at the final outcome.  First, it was the removal of the Appeal Court President, Justice Isa Ayo Salami, who was replaced by an Acting President, Justice Dalhatu Adamu, under controversial circumstances and then came the re-shuffling of the tribunal panel,” he said.

Odumakin said CPC practically lost hope in the entire process when the tribunal could not guarantee the party access to critical electoral materials, let alone compelling the Chairman of the Independent National Electoral Commission (INEC), Prof. Atahiru Jega, to appear before it.

He regretted that the refusal to allow CPC's legal team to conduct forensic investigation into the documents used to declare the presidential election result had caused a colossal damage to the case.

He further lamented the futile efforts made by CPC to try to get Jega into the dock so as to enable the tribunal extract needed evidence to prove the rigging allegation.

According to Odumakin, as far as the former Head of State is concerned, it was obvious that the odds were against CPC and there is no way it would have surmounted it under the circumstance.

Fashakin said the party had decided to appeal against the tribunal's judgment.

“Today's judgment was a miscarriage of justice; we shall appeal.  We believe that there was evidence that INEC did not conduct election in South-east and the South-south.  INEC could not tender the election materials used in conducting the election.  The commission abandoned its pleadings by not being able to support its pleadings with evidence,” he said.

i thought the man went to the court recently to assure of his confidence in them. now that they ruled against him, he has lost confidence? undecided

CPC should have withdrawn its case when Salami was removed, in protest

i thought the man went to the court recently to assure of his confidence in them. now that they ruled against him, he has lost confidence? undecided

1. Buhari did not 'go to court'. He said he would not do so. CPC did.

2. The article clearly states events that transpired that made it obvious to the CPC that Justice would not be done. Can't you read what you posted?

1. You refused to allow the evidence that Nigeria paid over 80 Billion for, to be tendered.

2. You change the umpires and select your judges to suit you

How then could justice be served - without fair umpires and evidence?

BUT you are sowing a tempest! Ultimately, there always is a reckoning. Let's see what judgement you will face from posterity
