Thankfully, no. All you need is Governor's Consent.

Here's the lowdown: According to Section 22 of the Land Use Act 1978 (as amended), the holder of a statutory right of occupancy must obtain consent from the governor before any alienation of the property. In simpler terms, even with a C of O, any transaction involving the property requires the governor's approval to be legally binding.

In Lagos State, the Land Registry Directorate manages all land transactions. To obtain Governor's Consent, here are the key requirements and steps:

Application letter addressed to the Lagos state director of land services.
Land Form 1c, signed and dated by all parties, and sworn before a magistrate or notary public.
Three copies of signed Deed of Assignment, Mortgage, etc.
Locational sketch map and chartable survey plan.
Certified True Copy of root of title/title of the property.
Photographs of the property.
Charting fee, Endorsement fee, Administrative charges, etc.
These documents are then submitted to the Surveyor-General of Lagos state for charting. After a successful charting process, a clean report is issued, and a demand notice is sent for payment of consent fee, capital gains tax, stamp duty fee, and registration fee.
