Sangoamadioha1:You don't seem like a particularly intelligent one. If you are around places where those weeds are being smoked(which is essentially anywhere, especially in Lagos) then guess what? It's in your bloodstream too. Does this then make you a smoker? |

NO... NDLEA can not arrest you for failing a drug test. that is ridiculous |

Antwan99:Do not give consent to the test (if you are an adult... If you are under age, you parents have the right to test you and enroll you in their rehab). |

They have no right to test you without consent, there's no Nigerian law that mandates drug testing without probable cause but of course we already know they do things with no regard for lawfulness hence avoid such situation at all cost! |

Sangoamadioha1:It does not work like that. In most countries, the anti-drug agencies target drug dealers and not users. There is a minimum amount of drugs that you can possess that will be considered criminal, like 200mg of coke (that was just an example). The law will presume that smaller quantities than that is for self use and not for sale. Drug users are considered victims of the drug trade, and not not perpetrators. |

Antwan99:No they cant do that. It is not possible. They will end up with plenty false results. Lots of people can have lips, eyes and foot of a smoker and not be a smoker |

Antwan99:Just settle them and go, don’t be surprised if they present exhibit in court and state they were found in your possession. It becomes your word against theirs, who do you think the Judge would believe? |

Alusiizizi:That's not how it works chief, inhaling second hand smoke will not make you fail a drug test, there's a high treshold for the test to be positive. |

See answer here according to Google AI overview: The Nigerian NDLEA can arrest someone who tests positive for drug use, even without physical possession of the substance at the time of arrest. The NDLEA Act grants broad powers to the agency to enforce laws against drug use and to investigate individuals suspected of committing drug-related offenses. While a positive test is strong evidence of prior use, an arrest would typically be made based on a reasonable suspicion that an offense (i.e., unlawful use or consumption) has occurred. The positive drug test serves as a key piece of evidence in proving that a drug-related offense has been committed. The focus is on the act of using the illicit substance, which the test confirms, rather than the ongoing act of possessing it at that specific moment. Individuals arrested under such circumstances have the right to legal counsel and humane treatment, and must be brought before a court as prescribed by law. The NDLEA also has a mandate that includes rehabilitation and demand reduction strategies, so a positive test could lead to a focus on treatment rather than solely punitive measures, depending on the circumstances. |

Not legal and could be challenged in court unless you are caught doing something that you are prohibited from doing while intoxicated e.g unruly behaviour especially in a public place, driving etc. However, being legal and being possible are two different things. Yes, you could get picked up and easily slammed with other manufactured charges in Nigeria. Stay clear of drugs and if you "accidentally" do drugs, stay inside your house! ![]() |

If a car was driving erratically and is stopped by the agents ... is the driver only observed for being under the influence? ... or all the passengers? If they all seem to be "high" ... who is given the drug test? ...the driver only? ... or everybody? If positive... who is charged? I'm not a lawyer ... but we need to understand that there are differences in being in possession of illegal drugs .... being under the influence of illegal drugs ... and testing positive for illegal drugs.. The topic is about testing. I believe it is not legal for one to be charged for testing positive for illegal drugs.... being in possession is different. It is the reason they don't test th addicts then cart them off to prison .....but then .... the masses will protest and ask them to carry out the same tests and actions for the politicians. Who will bell the cat? |

Antwan99:There is DUI. There should also be WUI. Attempted suicide is a crime under the law and offenders can be prosecuted. So yes, if you offend the government or someone in government, you can be arrested even in your sleep and charged for using drugs in your dreams! |

Antwan99:Legally, the circumstances surrounding the test is what will give them the locus. If they randomly pick people without the person consenting to the test, they will not have any ground in court. |

grandstar:We are in Nigeria and the topic here concern Nigeria. In Nigeria, drug users and drug dealers are considered criminals. Leave that talk of 'most countries' because it is not relevant to this discussion. |

Antwan99:.. . No, you cannot be prosecuted without being caught with the hard drugs physically...... Unless court order asking for your blood work so as to tie you to a crime.... Outside that, you're good.... In case of job application, you cannot be arrested, you can only be disqualified for the job,, , in case of physical features you mentioned, there's no law tie-ing anyones physical features to drug test with reasonable suspicion on a crime |

Absolutely. But they likely won't waste resources on you or such a person. Why? While the law criminalizes possession and usage, they will have to prove that you knowing got the drugs into your system. That is, you knowingly used it and that was how it got into your system. Na them the legal work dey. So, unless they want to shakara you or punish you, there is no point. But if the gods are after you, they might have your time and prosecute, knowing fully well that it is 50/50. Especially if you have an exceptionally crazy litigator as your defense counsel. |
