.The National Headquarters of the Court of Appeal has said that the Osun State Governorship Election Petition Tribunal sitting in Osun, constituted to hear matters arising from the recently concluded governorship poll in the state has not been disbanded as claimed by the Peoples Democratic Party (PDP) in the state. Reacting to the protest by members of the PDP in Osun state at the premises of the state high court, following the alleged disbandment of the governorship election petition tribunal, the Head of Media and Publicity of the Court of Appeal, Hajia Sa’adatu Musa Kachalla said, the tribunal was not disbanded. She said, what the President of the Court of Appeal, Justice Zainab Bulkachuwa did was to rotate members of the panel sitting on the governorship election petition tribunal in the state. Hajia Kachalla told Nigerian Tribune that. “What the President of the Court of Appeal has done was to re-organise members of the panel. “It is a normal practice, as such was done in Imo state in October 2016 and also in Benue state in July 2015. She has the constitutional power to do so”, she said. The Court of Appeal spokeswoman assured that the tribunal will soon commence sitting to hear the petition of Senator Ademola Adeleke and his party. She said everything done by the Justice Bulkachuwa was in good fate for the development of democracy. It was reported that PDP members staged a peaceful protest at the premises of the court, where the tribunal is sitting, carrying placards with the inscriptions such as ‘Why the sudden disbandment of the panel?’ Constitute a new panel immediately now?’ No more Salamigate in Osun’ Save our democracy from rogues.’ The protesters said that the alleged disbandment would have a negative effect on the case of the petitioner. The Osun state chairman of the PDP, Hon Soji Adagunodo had in a statement yesterday said the disbandment of the tribunal was an attempt to commit a second robbery against the people of Osun State. The statement said, “The disbandment of the tribunal barely 24 hours after the submission of the petition by the Governorship candidate of the PDP, Senator Nurudeen Ademola Adeleke poses a serious threat to the free and fair administration of justice in the hearing of the petition. “The PDP is concerned that the All Progressive Congress and indeed the Federal Government appears to be breathing down on the top echelon of the judiciary to constitute a new panel which will be pliable and thus compromise the integrity of the tribunal as a means to manipulating the outcome of the judicial process in favour of the APC. “We equally have it on good authority that the disbandment of the Osun State Governorship Election petition tribunal is one of the devices the APC plans to use to delay the commencement of the hearing of our petition with a hope that the constitutionally prescribed trial period of hearing would not be met”, the statement added. The PDP regards this as a continuation of the desperate antics of the APC to frustrate the genuine desire of the good people of Osun State to be governed by a lawfully elected Governor whose mandate was brazenly stolen on the 22nd of September, 2018. The statement appealed to the Chief Justice of Nigeria (CJN) , Justice Walter Onnoghen to pay closer attention to the constitution and general conduct of the Governorship Election petition tribunal in Osun State and save the state’s democracy from an avoidable mishap which may result from any form of manipulation of the judicial process to favour the ruling party. https://thenigerialawyer.com/osun-governorship-election-petition-tribunal-reorganised-not-disbanded-appeal-court/ |

Publicly declare your assets, CACOL urges Fayemi The Centre for Anti- Corruption and Open Leadership has urged the new Ekiti State Governor , Dr Kayode Fayemi, to declare his assets . It called on Fayemi, who was sworn in on Tuesday , to behave like Caesar ’s wife and “come to equity with clean hands by declaring all his assets and those of his deputy, publicly ”. It said by taking this step , Fayemi would be making his second coming as Ekiti State Governor memorable . CACOL said it knew that what it asked Fayemi to do was not strange to the governor as he did the same during his first stint as governor . “Aside from his pedigree that such declaration tends to preserve , it would serve as a baseline to hold other office holders by and this could be better appreciated if we consider his antecedents as a prominent rights crusader and civil society advocate. “Our position remains that the course of leadership deficit that has afflicted the nation for so long and our resolve to roll it back, would be better served if he could start on this promising note of accountability ,” CACOL said in a statement by its Media Coordinator, Adegboyega Otunuga . The centre , however , commended the governor for immediately springing into action after his swearing -in on Tuesday “by announcing a ‘free education programme ’ for all pupils in the state -owned primary schools up to junior secondary school ”. “This is a laudable step , considering the fact that education is one cardinal area the people of the state has consistently prided themselves in, aside from the global benefits accruable to any government , with an educated populace ,” CACOL said . |

OSUN TRIBUNAL DISBANDMENT: A TREAT TO DEMOCRACY The Peoples Democratic Party (PDP) leadership in the South West Zone under the chairmanship of Dr. Eddy Olafeso has condemned the disbandment of Osun State Election Petition Tribunal. The Election Petition Panel has been set up to hear the Petition filed by the PDP's candidate in the September 22 governorship election, Sen. Ademola Adeleke who was brazenly robbed of people's mandate to govern them for the period of four years. Having sensed waterloo at the constituted Tribunal with persons of impeccable characters, who were prepared for the assignment without any sign of compromise, the ruling All Progressives Congress (APC) in its characteristic manner, has influenced the disbandment of the panel. This act is obviously condemnable, unwarranted and unacceptable, if Nigeria's nascent democracy is to be sustained. The Judiciary which remains the last hope of common men must not be allowed to be tampered with, if the will of Osun people in the September 22 governorship election is to be supported. It must be reiterated that the ruling APC, which temporarily stole Osun people's mandate reposed in Sen. Adeleke on September 22, had been running helter-sketer to subvert the cause of justice in the PDP's suit, praying to declare its candidate the lawful winner of the poll. The unsolicited disbandment is indeed a threat, an assault and attempt to manipulate the process of law to reinstate the people's mandate into the helm of affairs in Osun state. The critical stakeholders of Nigerian Democracy across the globe are hereby implored to wade in the matter to forestall masses revolution if the cause of justice over Osun Election Petition Tribunal is manipulated. Signed : Rev. Bunmi Jenyo, Zonal Secretary, PDP South West Zone.
