It’s been a while since my previous post……sorry about that. I’ve been super busy writing content for a photography workshop I’m teaching online in October for moms that want to take better pictures of their kids.

It’s coming along pretty well, but it has consumed almost all of my free time. I haven’t done any P90X workouts since my initial 90 day period.

This week I have been playing racquetball for 1 to 1 1/2 hours a day. It’s been good to get back in the court, but I haven’t played as well as I used to in the past.

My go to shots are rusty to say the least and more than anything I think I’m sidetracked with my photography workshop to the point that I’m having a hard time getting my head into the games.

That’s a new problem for me. I’m also struggling with my left knee again. It is sore as crap and my left heel is bruised from a poorly timed landing. I’m falling apart, quite literally.

I have stuff just hanging on by threads at this point in my life. Another adjustment, I was pain free for the last 3 months….it was nice!

I’m playing somebody new this morning and I’m concerned I’m too sore to give him any kind of run for his money. I guess we’ll see.

I will be starting round 2 of P90X on September 1st and am looking forward to getting back into those workouts. I’ve taken a little time off just to see what happens to my body and I can tell my arms especially are getting a little softer.

I will do some weightlifting next week, but not an all-out P90X assault.

I still weigh 268. I have been there for a month now. At the beginning of this journey one of my main goals was to not get discouraged if the weight didn’t just fall off my body even when I was working out hard.

I know that I’m healthier and more fit when I’m exercising consistently. I’ve been riding the bike the entire month of August except for this week when I started playing R-ball every day.

I’m gearing up for September with the goal to hit it pretty hard. I’ll do P90X workouts and ride the bike at least 6 days a week and throw in some racquetball for good measure unless my knee and heel keep flaring up.

It’s been a fun ride so far. I’ve gone from a high of 310 down to 268. I have a total of 58 more pounds to go til I hit my goal weight of 210. Once I’m there I’ll make some decisions about what comes next.

I may decide to lose a little more weight or I may decide just to maintain, depending on how I carry it.

Well……I went and played racquetball this morning and I think I totalled my knee. I hit a kill shot along the left wall and went to slide out of the way. My left foot stuck to the floor as if it was nailed there.

That almost never happens on this court. My knee hyperextended and buckled and I went down.

As is typical for me, I got back up and played. My adrenaline kicks in and I’m kind of stupid “old school” that way. You never quit unless stuff is actually falling off you. It was really sore yesterday and if I wasn’t paying attention it would buckle and just give out.

I woke up today and can’t even put any pressure on it without it collapsing……..how fun is that! ? ! Getting my knee scoped right now is so not good timing. I guess it never is, but I have so much on my plate at the moment.

Today’s Sunday. I’ll stay off it all day and see if it’s any better at all tomorrow and if not……..off to the docs office. I hate doctor’s offices, I know I shouldn’t feel that way, but I hate going.

I also hate surgery. I had 60% of the cartilage in my left knee removed when I was 18 years old.

That’s why my left knee has continually given me trouble. I had xrays done a couple years ago and it was pretty close to bone on bone at that time. Who knows how bad it is now.

The real bummer for me is that for the first time in years my knee was pain free the whole time I was doing P90X and riding the bike.

No pain, no swelling, no problems. Maybe it’s time for me to give up on racquetball. I hope not, I love the game. It’s also great exercise.

A short distance away is the natural cave called Speco di San Francesco , a split of about 60 meters. which descends almost vertically into the valley below where the Saint used to retire in prayer.

On the climb that leads to the Hermitage we meet the Elce Santo who bowed in reverence to the Saint.

Abbey of Santa Croce di Sassovivo (Foligno): between woods of holm oaks and centuries-old olive trees, in the shape of an ancient castle, it is located on the slopes of Mount Serrone.

In a panoramic position over the entire Umbrian Valley, after being abandoned today it has been completely restored and managed by the little brothers of the Jesus Caritas Community. do not miss its cloister made up of 128 marble columns.

Abbey of Santi Felice and Mauro (Sant'Anatolia di Narco - Perugia): There are many hypotheses on the foundation of the Abbey. Some attribute it to the Benedictines, others to Roman consuls.

The tradition, on the other hand, of two Syriac hermits, Mauro and Felice (and their nurse), whose bodies would be buried inside the crypt, protected by a grate. The light penetrates through four slits and makes the environment very suggestive. [visiting hours from 09:00 to 19:00].

Hermitage of San Pietro in Vigneto (Gubbio): it can be reached along a dirt road, it is located along a detour of the ancient Via Flaminia. A shelter for pilgrims surrounded by vineyards, today it is inhabited only by Father Basilio Martin, a priest of the diocese of Turin, who has chosen to lead a hermit's life here and to welcome any pilgrims.

At the end of the 18th century, thanks to the abundant rains, the remains of a pagan time have come back to light.

Hermitage of Sant'Eutizio (Preci): founded by the Syrian monk Eutizio, it is built on a terrace between the cliff and the steep valley. With a glorious past as an important economic center for both Umbria and the Marches.

Its baptismal font was the only one in the surrounding area for centuries. Seat of the famous Preciana surgical school, it is now the location of many religious events.

Abbey of San Silvestro (Collepino - Spello): going up from the castle of Collepino towards Mount Subasio, one encounters the Abbey which, according to tradition, was founded by San Romualdo.

On the access road there is still the fountain known for its ability to return milk to the mother: until a few years ago, in fact, the gates of the church were covered with bonnets, baby shirts offered by mothers.

On December 31st the patron saint is celebrated with the distribution of blessed bread also to animals.

Hermitage of Santa Maria Giacobbe (Pale - Foligno): one with the rock and suspended in the air, it can only be reached thanks to ladders carved out of the living stone overlooking the void.

Its essential architecture and the improbability of the place make it extremely suggestive. The water from the cistern of the ermo, as well as the plaster, are believed to have therapeutic properties.

Everyone has their own reasons for venturing into the online world. As for me, I’m learning how to build a successful affiliate marketing business from scratch.

With that comes having to create my own website and blog. Now I can have the best looking site on the planet and a product that will knock your socks off, but without targeted traffic and lots of it, my sites will die a slow death.

I received my first invitation to write a guest post. After leaving a comment on one of Steve Roy’s posts, he read my comment and decided to head over to my main blog and take a look around.

It seems like everywhere I go, people keep telling me that I need to start writing guest posts for other blogs. It’s one of the best sources of traffic to their own site and their stats have really increased after their posts have gone live.

It helps to introduce you to people who may have never run across your information otherwise. At the end of your post you get the opportunity to tell people more about you and where they can visit your blog.

Just from my blog commenting and building relationships, I’ve had one other lady tell me that I’m welcome any time to write a guest post on her site. I’m thrilled that the invitations are starting to come in now.

Is health care reform constitutional – especially an individual mandate.

The answer is “no” according to an increasing chorus of conservative legal opinions, here, here, here, here, here, here, and here.

As Sen. Patrick Moynihan once quipped, “everyone is entitled to his own opinion, but not his own facts.”

So too for law. Certainly, one might wish for a legal order where Congress lacks the power to mandate health insurance, but that in no way is our actual constitutional law, in fact.

And so on the question, “Is it constitutional?,” is all depends, as President Clinton memorably reminded us, on what you mean by “is.”

If the question is about whether this is constitutional according to Supreme Court precedents, the answer is an overwhelming “yes.” . . .

But if the question is how the Constitution *should* be understood, precedent and the last seventy years of doctrine aside, . . .

those who make claims based on any of these (or other) normative theories of constitutional interpretation have an obligation to make clear that they are talking about “is” in.

the context of their own preferred theory of constitutional interpretation and not at all in the context of what the Supreme Court precedents actually say.

Turning to those precedents, I’ll start with the power to tax and spend for the general welfare, and power to regulate interstate commerce. [If you don’t recall the chapter and verse, Google Wikipedia for a quick refresher.]

First, mandatory Medicare insurance is clearly constitutional, just as mandatory Social Security retirement insurance.

The Court upheld Social Security in 1937 (Helvering v. Davis) as a valid exercise of Congressional power to tax and spend for the general welfare.

Mandating private insurance falls under the power to regulate interstate commerce.

There is nothing more commercial than insurance, and the financing and impact of insurance clearly crosses state lines – as the Supreme Court held in 1944 (United States v. South-Eastern Underwriters Ass’n).

The only plausible objection is that mandating the purchase of insurance is not the same as regulating its purchase.

Opponents distinguish regulating insurers from regulating people who buy insurance, but the Constitution does not address who is regulated, it only addresses what.

The what is commerce, and it takes two to trade, so regulating commerce entails regulating either side of the transaction.

Regulation usually takes the form of prohibiting or restricting types of trade, rather than mandating trade. But nothing in constitutional theory or precedent says that government is limited to one type of regulation or another.

Government often regulates through mandates when widespread participation is required to meet social needs. Consider, for instance enforcing building codes to keep up property values, compulsory education, and vaccinations.

Healthier insurance requires full participation in order to spread risks, eliminate medical underwriting, and avoid excluding pre-existing conditions.

Because mandating insurance is a logical means to achieve the valid legislative purpose of regulating the commercial product of insurance.

it clearly falls within well-established constitutional precedents and principles, despite the druthers of those who wish for the versions of constitutional law that prevailed before the Great Depression and the Civil War.

As a tenured professor, it is easy to take potshots at politicians for their failure to enact health insurance reform legislation.

After all, I don’t face angry voters and the need to raise copious amounts of money just to be competitive (the latter made even more treacherous after yesterday’s Supreme Court ruling on campaign finance).

I also don’t face a party caucus with disparate views on numerous contentious issues.

Nonetheless, I’d like to offer a few words in support of Tim’s cogently argued posting on how the Democrats should respond at this point. First, I prefer many of the House provisions.

But the question for me, as succinctly framed by one of my friends who is not a health policy analyst, is whether the Senate bill “will be an improvement of the health care system in this country…not for me or you personally but for this country?”

My answer is yes. Therefore, I support Tim and others who argue for enacting the Senate bill as it as and attempting to improve over time.

Second, it’s no use pointing fingers–the damage is done.

Third, there are still 59 Democrats (or nominal Democrats) to 41 Republicans.

True, the 41 Republicans are disciplined and almost unanimously opposed to any compromise with the Democrats on health reform.

The Obama administration’s seemingly ongoing attempt to find common ground with Republicans on health reform reminds me of Charlie Brown relying on Lucy Van Pelt to hold the football while he kicks it.

Every time, Lucy pulls away once Charlie starts to kick.

Same thing with bipartisanship in this environment—it won’t happen as long as Republicans smell weakness on the other side.

Short of capitulation to Republicans’ vision of health reform (a market-based approach), I see minimal possibilities for serious bipartisan cooperation.

No matter what legislative strategy the Democrats adopt, the Republicans will furiously oppose it.

What’s their incentive for collaborating?

Fourth, if the economy improves and the unemployment rate declines, the Democrats will have a much better story to tell (and will be able to portray their success as doubly impressive given the Republicans’ collective obstructionism) than appears now.

To be sure, this is a rather large if.

To revive the legislation, the Democrats must be willing to take bold legislative action.

That means, either: 1) completing the reconciliation process and holding the vote before Mr. Brown is sworn in; 2) enacting the Senate’s version right now; 3) using the budget reconciliation process to enact portions of the current legislation, or 4)

changing the filibuster rules, as Republicans’ threatened to do during the Supreme Court nomination hearings for Samuel Alito. (Changing the filibuster rules deserves a separate discussion.)

Each of these presents obvious problems. Aside from Tim’s analysis, what’s attractive to me about the second option is that enacting the Senate bill provides leverage for any future negotiations.

For example, once the law is in place, the Democrats can then sponsor legislation that would make corrections that House and Senate negotiators.

would agree on and then be submitted as a budget reconciliation measure to avoid a Republican filibuster.

Beyond making the legislative choice, however, the Obama administration needs a forceful media campaign to educate the public as to why the bill is good policy and will improve health care delivery.

So far, the Democrats have done a woeful job of countering Republican criticisms.

Nothing the Democrats achieve legislatively will mean much if they are unable to more effectively explain what the legislation actually will accomplish and why it should be widely supported.

Taking a break from law, this post is about whether the Veterans Health Administration provides care more efficiently than the private sector.

Paul Krugman and others have held the VA out as a shining example of the government’s ability to provide high quality care efficiently.

as well as the private sector’s need to lower costs and improve quality through electronic medical records, comparative effectiveness research.

reduced overhead, salaried physicians, and integrated delivery systems – all issues that are central to current health reform debates.

It would be a huge blow if it turns out none of this is true – but that’s precisely what’s suggested by an article published by VA researchers earlier this year.

Wm. Weeks, MD (at Dartmouth and the VA’s regional center) reported that, from 2001-2006, the VA cost 33% more than equivalent care in the private sector, and its quality was not notably better.

Here, I focus on the cost findings, since they diverge dramatically from the prior, state-of-the-art, study by Nugent, Hendricks et al (also from the VA), which found that, in 1999, the VA cost about 20% less than Medicare.

Since Medicare itself costs 25-30% less than the private sector, Dr. Weeks reports the VA costs about twice what Dr. Nugent and other VA colleagues previously reported.

What makes this discrepancy even more remarkable is that Weeks did not even cite this prior work of VA colleagues, published in multiple articles in leading journals.

What gives? I’m not expert, but its clear their methods differed sharply.

Nugent et al. took all care delivered at 6 VA centers and valued the services at actual Medicare fee-for-service rates, comparing the total with costs borne by the 6 VA centers.

Thus, the measures and comparison are direct, apples-to-apples.

Weeks, on the other hand, compared total VA medical costs (excluding nursing homes) per user with per person costs reported by VA users in the Medical Expenditure Panel Survey (MEPS), which values those services at private sector rates.

MEPS is a national survey that contains only a small subsample of 500 VA users, about 1 of every 50,000 VA user.

Extrapolating from such a small sample is a much more indirect comparison, so merits closer scrutiny, which reveals many potential flaws:

The 500 VA users in MEPS are probably not an accurate reflection of 5 million total users.

MEPS surveys people living at home who respond to surveys. This entirely excludes people who are homeless, institutionalized, or have died earlier in the year, and it under-represents mentally ill or substance abusers.

All of these categories have worse health, and regrettably are prevalent among vets, so MEPS almost certainly omits vets who reflect the highest burden of illness.

This sample may lacks much statistical validity, even for the vets it does include.

MEPS weights responses to make them nationally representative for demographic characteristics, but not for veteran status.

Without this weighting, the chance of random error is much greater.

This is suggested, for instance, by the fact that the value of VA care reported over this six-year study ranged two-fold from year to year, with no discernible pattern (the sixth year was twice the fifth year, which was half the third year, etc.)

Even for those whom MEPS does represent, it underreports actual health care costs.

Exactly how much and why is somewhat unsettled, but what seem to be the most recent studies conclude that MEPS underreports by 14% – 19%, in large part because reports of both utilization and costs are understated.

Weeks acknowledges these possible flaws, but asserts that studies he and others have done show MEPS is reasonably accurate – again without citing any of the leading studies to the contrary.

Weddings – they are a busy affair.

For months, sometimes years before the big day, plans and arrangements are made, all leading up to what will likely be the biggest event in your life.

So, when is the best time to actually take out wedding insurance? Well, you really do not want to leave it too late into proceedings.

Ideally, the best time to actually take out your policy is straight after you have made your initial deposits.

This is because at this stage in the organisation process, you should have a good idea as to the actual final cost of everything – cake, suits, dress etc.

When you know how much everything will cost (in broad terms), you will know what level of cover you will then require.

So, before you go too far into the process, be sure you are covered with a wedding insurance policy!

You and your husband or bride to be can then go forth and organise to your heart’s content.

This is why you should consider taking out a wedding insurance policy, to cover your big day.

If you’re like most Americans and Europeans, you spend hours online each day.

A huge amount of that time is taken up by with idle browsing, games, social media, and other trivial activities.

otherwise spending your time in less than productive ways, it’s always possible to change your habits.

Better time management starts with acknowledging how long you spend on various activities and having the self-control to restrain yourself where necessary.

The very nature of the internet, with its essentially limitless expanse of content, makes this difficult.

Start small—set attainable goals, and wean yourself off of it like you would any other addiction.

Going cold turkey is difficult for most and impossible for some, and isn’t really the goal anyway.

The internet isn’t evil, you could probably just be spending your time on it more wisely.
