Social media should contain useful or interesting information. When charged with the responsibility of generating new content for the same brand day after day, it can get difficult to brainstorm ideas that publics want.

This is when thinking like the consumer is more important than ever. Meet with your entire team and ask what they would like to see more of in terms of content on social media channels. Search for what kind of news pops up when googling keywords relating to your brand.

Imagine being on the other side, and think of what kind of news or information you would be searching for. When you think more like a consumer, your posts will become more meaningful and better benefit your brand.

Diversify in your content.
While the purpose of the content calendar is to uphold an organized schedule and use time most efficiently, you do not need to stick to the same routine with the same general content you share.

Successful social media channels post the brand’s original content, as well engage and share content by other brands. Link to news, post pictures, and videos engage with consumers and other brands. Post content that will establish discussions.

Social media is responsibility — a big one at that. Without an organized content calendar, you will likely find your business’s channels abandoned, with one or two irrelevant posts each months and only a few followers.

As a blogger, I go through a lot of effort to keep spam comments off my blogs.

You know, comments that don’t add any value to the article like, “thanks! Great article.” As far as I know, most bloggers do this kind of monitoring.

In fact, the comment plug-in that I use, CommentLuv, doesn’t allow comments to come through in less the visitor has been on the page for a certain amount of time.

This, to me, is to ensure that people are at least looking at the article and getting a general idea about what it is before they comment.

Are Online Communities Different Than Bloggers
Besides my blogs, I am also quite active on HubPages.

People can leave comments in HubPages after the hub (article) and we can monitor the comments: reject or approve them. Unlike most blogs, people cannot link to their website;

however, if they are a member of Hubpages their name is automatically linked to their profile page, which is kind of like the homepage of their own personal website.

In any case, in my eyes, this is kind of like a regular blog, where comments should be high value, add to the article, and not just be people trying to get a link to their profile page.

However, after asking the question of what people thought about spam comments on hub pages, I was quick to receive answers that said, “I am just grateful that anybody comments.

If they take the time to stop and leave a comment, whether or not they read the article, I appreciate their effort.”

I was shocked at their answers! Most bloggers get pissed off at short, non-helpful comments that don’t add any value to the article. I expected the Hubbers to rally around me shouting, “YES, YES, YES!” But they didn’t.

In fact, I didn’t get one answer that agreed with my viewpoint on spam comments on hubs.

So it’s very interesting to see the difference between regular privately owned blogs on the Internet and the community of HubPages. Following is one of the comments I got to this question.

What’s the Difference Between Blogs and Community Pages?
As far as SEO goes, nothing that I know of. A comment can definitely add to the content of your article and, therefore, help it rise in the search engines. Especially keyword-specific comments.

And, just like on blogs, a comment can hurt your SEO if you get too many comments that hurt your posts keyword density (meaning it increases to some ridiculously high number. )

There are some people who are doing very well on HubPages and don’t allow comments at all. I’ve also seen very successful blogs that do not allow comments.

So this begs the question are comments really necessary? And if they are not necessary, then why even let comments into your post in the first place?

Personally, I feel that the answers I got on HubPages showed that a community is just that – a community. People expect you to socialize, and a comment that says, “hey, nice work” is technically socializing!

So, it seems to me that when it comes to comments, blogs have more of an ‘I need this to rank well’ feel while Hubs have more of an ‘I want to share this and socialize with you feel’.

And I am not saying that this is 100% of the time, but I am saying that this is the feeling I get.

Me personally, I enjoy comments on my blogs and Hubs for two reasons; they let me know people are interested enough to leave a comment, and they help me build some credibility in the eyes of other readers and, hopefully, the search engines.

I mean, while I love writing about various things, this is how I earn my living and would like to be able to rank well, get some traffic, and make some money! I’m not scared to admit that!

In The End Of It All
But in the end, as far as I’m concerned, spam comments are purely done out of selfishness whether they are on blogs or on a community forum.

It doesn’t take much to write an insightful comment, I should know because I try and do it everyday.

And to be honest, I don’t want to settle for people not reading my articles or hubs and using the comment section as a way to up their value online…I deserve more than that for my hard work and they deserve less than that for their little work.

Yes, comments that are done purely in ego are thriving on community pages like HubPages, and even welcomed by some, but I don’t think that they should be.

The Yelagiri Hills are situated in Tamil Nadu. These hills have covered an area around 30 square km having a height of 3500 ft.

It is in between 4 mountains, at an altitude of 920 m above sea level. These hills are situated in the Vellore District of Tamil Nadu, near the Vaniyambadi Tirupattur road.

It’s an information-gathering exercise. Once you know where your challenges lie, you can come up with strategies to get past them. Pack a low-carb breakfast the night before. Enlist a friend to check you on your plans for the week.

It’s all about the expectation. If you expect you’ll never have another thought of doing things the way you’ve done them for the last 20 years, you’ll run into frustration and disappointment when it inevitably happens.

If you look to the future with the expectation of having a few little bumps to climb over, you’ll be ready to negotiate the change with a minimum of trouble.

Matt Cutts (head of web spam at Google) released a video yesterday (sporting a cool Firefox shirt) giving some hints about Penguin 2.0 which will be coming in the next couple months.

It goes into detail about some of the things that they are working on and it sounds great to ‘white hat’ guys like us (but bad for the link buying page rank flowing black hat guys).

With Penguin 2.0, Google is looking to reward webmasters that run a great site that users love. The type that when they tell their friends (and those friends tell others), they book mark them and visit them often.

Remember in the 90s when every site had a “bookmark us” link? Get ready to see that again as I’m thinking since they probably have the ability to get bookmarking stats from their chrome browser, they’ll probably use it to see who is bookmarking what.

High quality content is still what you should be working on. You’ve made a website – make it something you can pour your heart into and try to create new, useful content every couple/few days to keep things fresh.

By doing this, you should see Google scanning your pages more often (you can check this in Google Webmaster Tools; Health –> Index Status) and see an increase in search queries and clicks.

One thing Matt said a number of times is that Penguin 2.0 is going to be concentrating a lot more on finding paid links that flow page rank to other sites.

If you have links on your site to other sites, make sure you are using the nofollow attribute. 2.0 is more comprehensive than Penguin 1.0 in this respect and it expects to go deeper and have a bigger impact on link spammers.

He also touched on advetorials (an advertisement in the form of an editorial). He stated that while all advetorials are not bad necessarily, some violate Google’s quality guidelines.

You want to make sure that if you are taking money for links/ads/advetorials that it is clearly stated so that visitors don’t think its organic or editorial.

There is nothing wrong with native advertising mind you – just be sure that they should not flow pagerank.

Expect Google to go upstream and follow known link spammers to deny value to their sites and to the sites selling link spam. They will be using more sophisticated link analysis checks with this update.

On the other side of things, this summer’s update of Penguin will also concentrate on hacked sites. They are working on ways to detect them better/sooner and are also working on better/different ways to communicate to ‘regular’ webmasters.

They understand that every webmaster doesn’t partake in their webmaster tools, but they’d like to try and make their webmaster tools a kind of ‘one stop shopping’ for webmasters so they can communicate information to them easier.

If you are reading this and haven’t set up webmaster tools for your site(s), then I’d suggest you go do that today some time. There is a wealth of information in there and it can help show you what you are doing right (and wrong) on your site.

We should see some changes in webmaster tools as well – more concrete details about your site(s) including more example URLs to help you diagnose problems.

They are working hard to reward those regular webmasters that work hard – those small/medium sized businesses.

This version of Penguin will also try to detect sites with authority in a specific niche and rank them higher because of it (getting back to bookmarks, quality content, etc..).

However, recent research concluded in Ireland, where I live, showed that customer service on our little island here is down by a staggering 33%! Mind you, this is in a country where business was heavily hit by the recession.

I compared this report with experiences of some of my colleagues in other corners of the world and it seems that my country is not isolated with its low customer service problem.

Many of the people I talked to voiced the same worries that with prices for goods and services going down, so goes the value of a good customer service.

And what seems to be even worse, good customer service is not something that many startups consider their top priority. Sure, they have some idea of how to provide good service.

They know that being nice to the customer, offering the best service, and always trying to exceed the clients’ expectations pay off. They realize that the friendlier you are to the customer, the more likely he is to come back for more.

The form can be beautifully designed, practically every aspect of the document can be made pleasing to the eye but …. I gave one such questionnaire I previously received myself to my mom to complete. A result? She didn’t fill it in and what’s worse, she felt stupid that she didn’t know how, even though that editing a PDF was beyond her technical abilities.

Fancy design in Word Documents Quite opposite to the problem above is sending questionnaires in Word (well done, even my Mom can open it and give feedback) but trying to still design it to look amazingly well on every computer. A result? Fonts falling apart, the whole design being a mess and generally the document making you feel that you don’t want to look at it again.

Limiting the amount of information the customer can provide I know it is a good idea to steer the customer in one specific way in their feedback.

You can be sure that the customer answers will relate to what you really want to know and that he will no be simply commenting on the carpet you have in your office.

It is easier to gather and process such data since it was designed by you however limiting what the customer can speak out about only to the “safe aspects” of your business may not be a that good idea.

It is always good to leave some room for the customer so that he can truly tell you what he or she thinks about working with you.

With shovel in hand I shoveled six driveways and a couple hundred yards of sidewalks.

After shoveling I did a series of photographs for my stock agency of my nieces, nephew and son playing in the snow

I actually like shoveling snow….maybe proof of my low I.Q.

I remember watching my mom shovel snow when I was a kid and throwing snowballs at the big picture window my sisters and I would watch her through.

I was really excited once I got old enough to go out and shovel and through snowballs at the big window while my sisters watched me shovel…….a winter right of passage of sorts.

We’ve lived in Arizona for 22 years before moving up here to Utah so I’ve avoided snow shoveling for almost half my life.

I still enjoy it. It’s actually a great workout.

There were several people on the block with snow blowers, but they didn’t finish their driveways any faster than it took me doing it “manually.”

How many things are sold to us in order to make our lives easier?

Save time, save energy, save effort etc.

Many of these things might make life easier, but the real question is…….do they make our lives better.

We’ve sought out ease of living at the expense of our health in many cases.

We use our lungs less, we use our legs less, we use our backs less, we use our muscles less.

We get weaker and more and more out of shape as we seek a life of ease.

In the long run, so many of these things we do to make our lives easier actually make it worse as we lose more and more of our physical abilities.

I have no plans to buy a snow blower…..on this one….I’ll stick to the old fashioned way of doing things.

Heaven knows I can use the workout. I spent 2 hours yesterday morning shoveling snow. It felt great.

The really cool thing though is this……because I’ve been doing P90X consistently over the last 2 months, my back isn’t sore at all today.

No pain, no soreness, no side effects from 2 hours of shoveling……not bad.

Doing the P90X Legs and Back workout is probably responsible for my lack of pain.

P90X does such a good job of exercising all areas and muscle groups in your body that there are very few if any that don’t get worked out, so when you do something physical that is different from your normal routine you don’t end up paying the price of a super sore rarely used muscle group.

I know that in the past, even as a young kid that was in great shape….and I was. I was always sore the day after shoveling our super long driveway.

Today I’m pain free……cool!

So what if I didn’t end up doing any P90X workout yesterday……shoveling snow for 2 hours sure seemed to be a great P90X alternative for just one day.

One Spelling – You need to ensure that your domain can only be spelled in one way.

Keywords – If possible, you should try and use your keywords in the domain name. For example, if you sell garden sheds, in an ideal world you would choose “GardenSheds.com”.

However the chances are that is long gone, so the next option would be something such as “UKGardenSheds.com” or “GardenShedsOnline.com”. This can have an added benefit when it comes to online marketing.

Do Not Use Numbers – Unless your company or product name has a number in it, avoid using numbers. Do not replace “for” with “4” or “to” with “2”.

Do Not Use Slang – Ensure your domain does not use slang or text speak. While you may know that “FishinB8.com” is supposed to be “FishingBate.com” – your customers want!

Memorable – The domain should be easily remembered. If you think that 15 years ago, nobody had heard of Amazon, Google, or eBay, now they are all household names, all instantly recognizable and memorable.

Easy To Understand – The domain should be easy to understand in every format. For example, if it is printed it should be easy to read, and if it is spoken it should be easy to understand the first time.

Copyright Issues – Make sure that your domain does not contain any copyright or trademarked terms. If you are unsure, check before registering. If you are still unsure, leave it and move onto the next domain.

We should care about the source, though. We should care about where bottlers get the water, and what they put into it before they sell it to us.

Not all bottled drinking waters are the same. Even though the bottle shows flowing rivers or mountain vistas, you must read the label carefully to know if the water came from mountain springs or municipal pipes. Bottled water is not necessarily cleaner or safer than tap water.

1. Bottled drinking water can be tap water.

In 2004, Coca-Cola introduced Dasani bottled drinking water to Great Britain. Within weeks, British newspapers discovered that Dasani was simply processed tap water. Then bromate, a cancer-causing chemical was discovered in Dasani produced in Britain.

Three years later, all of Europe remains a Dasani-free zone. Most Americans are probably unaware that Dasani, like much of our bottled drinking water, does not bubble forth from pristine mountain springs.

It flows from the same water pipes that deliver tap water to city kitchens and bathrooms. Dasani passes through a filtering process and, according to Coke, is “enhanced” with minerals, but it is simply tapped water. Aquafina bottled drinking water also comes from municipal pipes.

2. Bottled drinking water can be spring water.

FDA guidelines define spring water as water that flows naturally to the surface from underground. If the label does not specify “spring water”, it is not. Unfortunately, even if the label does say “spring water”, you have no assurance that the water is pure.

FDA rules allow bottlers to call bottled drinking water “spring water” even when it is brought to the surface from a pumped well and is treated with chemicals. The actual source of the water may not be the pristine spring we imagine.

One company label observed read “Spring Water” (picturing a lake surrounded by mountains), but the water actually was found to come from an industrial parking lot near a hazardous waste site!

3. Bottled drinking water can be mineral water.

FDA guidelines state that mineral water also comes from underground, but contains at least 250 parts per million of dissolved solids such as minerals and trace elements. Mineral waters have a stronger taste, which some prefer.

Mineral water is distinguished from other types of bottled drinking water by its constant level and relative proportions of mineral and trace elements at the point of emergence from the source. No minerals may be added to this product, and those that exist naturally should be safe. Some sources, however, may contain lead.

4. Bottled drinking water can contain additives.

Bottlers add fluoride to some bottled drinking water, but the label doesn’t tell you. Some bottlers add disinfectants, but the label says nothing about them. Bottled drinking water may contain added minerals and vitamins.

It may contain added electrolytes. The FDA defines bottled water as water that is intended for human consumption and sealed in bottles or other containers with no added ingredients - except a safe and suitable antimicrobial agent. Fluoride also may be added within FDA limits.

5. Bottled drinking water can be impure.

The FDA regulates bottled drinking water, which is classified as a “food”. The Environmental Protection Agency regulates tap water. Amazingly, the EPA guidelines for municipal water are stricter than the FDA restrictions for bottled drinking water!

You might buy bottled drinking water that is acceptable to the FDA but is not acceptable for use as ordinary bathroom tap water. Tests for the Cryptosporidium parasite aren’t even recommended by the FDA for bottled drinking water.

Plastic bottles in which your bottled drinking water comes are stamped on the bottom with a number in a triangle. Most bottles are #1, which means they are made of plastic that leaches into the bottled drinking water.

6. Bottled drinking water can be costly.

Beverage Marketing Corp. says a typical half-liter (approximately 2 cups) of bottled drinking water sells for about one dollar in the U.S. At that rate, we are paying about $7.50 per gallon when we buy bottled drinking water in those convenient bottles.

Cheaper by the case or in 5-gallon jugs delivered to the home, your bottled drinking water still may be costing you $50 or more monthly. As I write this, regular, unleaded gas averaged less than $2 per gallon, according to AAA. Bottled drinking water is not inexpensive.

Good bottled drinking water does exist, but consider the above facts before making your purchase. Also consider that municipal tap water is not necessarily a great or even acceptable option.

There is a great number of free or inexpensive design templates available for all kinds of blogging software. They are easy to install and can be, to some extent, easily modified.

They come in different arrangements of content blocks and color schemes. When it comes to looking for that close-to-the-perfect template, we spend hours picking the right graphical design.

But there is more to it than colors, visual structure or cool pictures; it also has to have the right HTML coding or the correct, as some of us say, “invisible part”.

As I went through a number of different designs that look “clean” and “usable”, I found that most of them did not have the best HTML foundation for the optimized presentation of your content.
There is no doubt that the designers spent a lot of time creating these templates, considering the details that they have incorporated in their designs.

However, as I scanned the code I could tell that there were things that are just not SEO. This article uncovers some of the common mistakes made by pro and not so pro web designers that create free downloadable blog templates.

1. Headers
When one creates a page he or she would have a <h1> header (in most cases used once per page) to emphasize the topic covered on a given page. Search engines are aware of such practices and use them in their algorithms to, perhaps, define keywords for the page.

So, headers are valuable for stating your keyword/phrases as well as giving your visitors a general idea about a page’s content.

Therefore <h1> header should vary from page to page and describe the rest of the page right to the point. However, I have found that many designers use <h1> in the headers of their templates and include only the name of the blog, which will stay the same from page to page. Such a waste!

2. Page Titles
It’s always nice to have a page title that looks something like this:

Page Topic – Website Name

or simply

Page Topic

But you will see that a bunch of templates will have the site’s name in front of the page topic. You want your visitors to see what this page is about before they read the name of the website. Plus it works much better with SE’s and their keyword assigning algorithms.

3. Archive Links
I suggest that you take off any references to archive pages for your blog, especially if you have just a few categories and rarely make your posts.

It may duplicate contents of the root page of your blog and that is not cool! Although Google seems to go nicely about dupes these days, I still wouldn’t risk it.

4. Rel=”Nofollow”
If some of the pages to which you link from your blog pages are not important for your commercial purposes (About us, Contact, blah-blah page, etc), make sure they include rel=”nofollow” attribute and don’t suck out the PR from the important pages.

So, ok these are some of the basic and frequently appearing problems you should be aware of. Take your time to investigate the SEO level of your favorite design by, of course, looking up the source of the page.

If you don’t know much about HTML get a friend or a professional to look into this matter. It is very important to be set up the right way from the beginning.

Are you using the JetPack by WordPress plugin on your self-hosted blog yet? If not, you really should be.
It gives you some of the functionality that’s included at hosted blogs, but all you really need to use is a WordPress account to activate it and that’s free.JetPack by WordPress

What makes it so totally cool today is that they just added a mobile formatting option. I’ve used WordPress Mobile Pack, which is OK, but JetPack is AWESOME.

It will present a nice, clean format for your blog when viewed on a mobile device. Plus, it adds in all your widgets at the end of the three most recent posts that it provides readers. Very cool. Here are some other features that I love about this plugin.

That means your opt-in box is right there (or it should be) when people get done reading. WP Mobile Pack allows one widget, but the mobile formatting from JetPack shows them all. Plus, it just looks better.

But that’s not all JetPack does.
Here are some of the other features that I like a lot:

Stats: JetPack keeps track of your visitors, what they read, and what they clicked. It also tells you about your organic traffic and what keywords people typed in to get to your web page. Plus, you can get a quick idea about how many people came to your blog in the last 48 hours in the ribbon at the top of your pages when you’re logged in. The stats are really awesome. Love it!

Email Subscriptions: This feature allows your readers to subscribe via email. I don’t use it because I use FeedBlitz now, which has this option as well. Feedblitz, however, allows you to format your “newsletter,” and add photos. Just spiffier, but then, I’ve not used JetPack’s subscriptions for a while. I’m guessing they look pretty good, too.

If you’re not terribly tech-savvy, this is a great folk to sign up and it’s easy. Just activate, and JetPack keeps track of your subscribers, too.
Sharing: This is a big one for me. I hate to see too much clutter and it’s easy to clutter a blog up.

JetPack’s sharing buttons are easy to configure and look nice at the bottom of your posts. They’re not obtrusive in any way, but they’re clearly identifiable. You can customize the buttons, too.

Spelling & Grammar: JetPack adds spelling and grammar check functionality to your blog. Just click the checkmark next to the “more” button when you’re done writing. Whether you realize it or not good grammar and perfect spelling is important to Google now.

Extra Sidebar Widgets: You can see some of them in my sidebar. One is for rotating videos from YouTube, which is cool. But there are also widgets for adding images, for subscriptions, and for showing your latest Tweets.

There are other features that you might find useful, no doubt, and there are some features that are paid, and not free. All of the features I’ve described above are free. So, what are you waiting for?

Go to Plugins/Add New and type in “Jetpack by WordPress.” Install that baby now. It’s totally sweet!

Google has given us some great SEO tools that we’re able to use for free. In that respect, Google is still pretty cool. Not a day goes by that I’m not checking Google Webmaster Tools and/or Analytics for my own site or for those of my regular clients.

I was discussing bounce rate with one of my clients this morning and told him that I’d seen a remarkable change for my own site since I set the duration visitors needed to stay on my site by creating a Content Event in Analytics.

It’s down to 18.7% from organic search and I have the time frame set at 15 seconds which is far below the time an average visitor stays on this site. (Here is how to set the “Adjusted Bounce Rate” for your site.)

And then, we got on talking about an SEO Tool site called “AHrefs.com” and how it was similar to SEMRush.com or MajesticSEO.com, and about how every site comes up with different sets of stats for you. Even Google itself does this.

You can see the differences between Google Webmaster Tools and Google Analytics easily.

So, which SEO tool is right?

I’m guessing that Google Webmaster Tools is about as close to right (for Google) as you can get. Here are reasons why Google says that the stats differ:

Webmaster Tools does some additional data processing—for example, to handle duplicate content and visits from robots—that may cause your stats to differ from stats listed in other sources.

Here’s a good example of robot visits. If you look at AWStats in your site’s control panel to see how many visitors came to your website the day before, you might be really excited. It probably shows way more visits than Google Analytics, for example.

For last month, my AWStats account shows thousands of more visitors than Analytics, and that’s because visits from search or other robots are included in AWStats, whereas in Analytics, they are not.
Bots are NOT real visitors. So, if you’re relying on AWStats, strip out the robots’ visits and you’ll have a clearer picture of how many real visitors your site got.

Plus, some search engines still include your duplicate content as extra pages for your site, thus improving your authority. The big three do not, so that metric will be different in Analytics or Bing Webmaster Tools from Majestic, for example, which may show all pages in your site, dupe content or not.

Some tools, such as Google Analytics, track traffic only from users who have enabled JavaScript in their browser.
Did you know that? I’m guessing no. Most visitors have javascript enabled, but some do not.

Those visits aren’t included, since Google’s code is in java. Yet, sites like SEMRush provide data without code additions to your page.

Google Analytics tracks visit only to pages that include the correctly configured Analytics Javascript code. If pages on the site don’t have the code, Analytics will not track visits to those pages.

Visits to pages without the Analytics tracking code will, however, be tracked in Webmaster Tools if users reach them via search results or if Google crawls or otherwise discovers them.

So, if your Analtyics code isn’t properly installed, you won’t get a true count of visitors, goals, or any other metric. Be sure to double-check this, if you’re seeing things are way off in Analytics. And don’t forget that you need to add the Analytics code to every page on your website or Analytics won’t track those pages.

With a blog, it’s easier because a plugin will add the code to all pages for you. You can use Google Analyticator, Analytics for WordPress, or any other Analytics plugin and it should do the trick.

Some tools define “keywords” differently:
Webmaster Tools displays the most significant words Google found on your site.
Adwords displays the total number of user queries for that keyword across the Web.

Analytics describes both search engine queries and AdWords paid keywords.
The Webmaster Tools Search Queries page lists show the total number of keyword search queries in which your page’s listing was seen in search results and round search query data to one or two significant digits.

There could be lags. You might be comparing data in Webmaster Tools that hasn’t hit Analytics yet.
These are all valid reasons for why Google Webmaster Tools and Google Analytics differ, but they can also explain why data is so different from different other independent SEO Tools around the Web.

It used to be said that Yahoo was most accurate when it came to showing backlinks to your website, and there were usually more Yahoo backlinks than backlinks showing in Google.

But think about it… What really matters? Where do most of your traffic come from, when it comes to search — Google, right? So, what you find in any other search engine may be helping you with the SERPs for those engines, but Google only sees and does what Google sees and does.

That’s why we optimize for them, and why I think paying attention to the data you get from Google’s SEO tools can only help you. Improve backlinks there, decrease your bounce rate for Google, etc. You’ll still do well with other search engines, but well… the Big Dog is still topped.

Wow… I’ve been depressed for a while now because Google has decided to close Feedburner next month. This site was one of those interesting and really cool services that I grew up with in terms of blogging.

I knew that if I had a Feedburner feed, my feed would be cooler than the other kids. I could get stats. I could sell ads on my feed. I could do a whole lot of other cool and interesting things that a plain old WordPress feed just doesn’t do.

But Google announced some 16 months ago that Feedburner would be closing and when October rolls around, Feedburner is checking out. I’m sad. <sniff> Some have been hoping that Google would decide to integrate the Feedburner functionality into another of their products, the most obvious choice being AdWords.

Yet, somehow, I doubt that will happen. Google didn’t find that AdWords advertising on feeds was bringing in the kind of income they had hoped, and so… they seem to be letting Feedburner languor and die.

Last month, they closed the Twitter account and the blog, and now, the .jp domain — used by Japanese Feedburner users — was allowed to expire. Google just doesn’t seem to give a hoot anymore. Oh, and you can’t get support from Feedburner anymore, either. I’d say it’s curtains for the old girl.

So, what should you do?

Find an alternative now before Feedburner closes, and get everything changed before that day.

Here’s my choice:

FeedBlitz
I’ve used FeedBlitz before for clients, and it’s really cool, too. Sign up and try the service for 30 days for free, and then, if you want to stop ads on your feed, you’ll have to pay. However, the good news is that the price is under $15 a year for up to 10 email subscribers.

No matter how many RSS subscribers you have, the price will never go up. But there are no free accounts. If you want to keep the cost down, just don’t advertise for email subscriptions and you’ll continue to pay the lowest price.

(The lowest price is $1.49 per month, but they’re offering a 25% discount if you pay annually.)

To set up your account, you provide the description and URL for your feed address, complete some other preferences, such as customizing your email autoresponder confirmation message (if you’re going to accept email subscriptions), and you’re golden.

They even offer a migration service from Feedburner and are going after that business in a big way.

I’ve switched over and find Feedblitz easy to use. Plus, if you do want to offer email subscriptions, it sends out an attractive newsletter-style feed, which you can customize or completely design yourself.

Feedblitz also acts as your autoresponder, houses email addresses, and takes care of all the CAN-SPAM compliance, too.

This is great if you’re not using a service like AWeber, which will send these newsletters through your autoresponder account for free as part of your subscription. (Did you know that?)

There are other feed enhancement services you can try, though I’ve not used them. Here are some other free places you may want to check out:

Many feel that #4 is a reach for an RB, but I also have seen many compare his abilities to Adrian Peterson as well. Richardson is a once every 10 years type of back and would take a lot of pressure off of Colt McCoy. WR is a need, but I think they will address it.

5. Tampa Bay Buccaneers - Morris Claiborne CB/LSU

Even though the Bucs signed Eric Wright, I feel they will still look at Claiborne here. Richardson could also be the guy if available, but I think they may be skeptical on the future of Aqib Talib and may just end up releasing him. I’m not sure yet, but I can picture Claiborne and Wright starting this season.

6. St. Louis Rams - Justin Blackmon WR/Oklahoma State

The Rams get their #1 target in the draft and gained 3 extra high draft picks to do so. I think there will be a team who is willing to leap in front of the Rams to snag Blackmon first, because as we all know…..this is a pass-happy league now.

7. Jacksonville Jaguars - Michael Floyd WR/Notre Dame

After his recent pro day workout, I think the Jaguars have to pull the trigger on Floyd. The signing of Laurent Robinson was a waste of money in my opinion and they need to upgrade the position further.

8. Miami Dolphins - Ryan Tannehill QB/Texas A&M

With all the recent rumblings from the NFL meetings, I am starting to feel that the Dolphins will take the risk on Tannehill instead of hoping he drops to the 2nd round. Think the Chiefs and Cardinals may pull the trigger if they aren’t really sold on Cassell and Kolb, respectively.

9. Carolina Panthers - Fletcher Cox DT/Mississippi State

The Panthers are looking for a DT and it is up to Cox and Poe. The more I look at it, Cox fits their system much better than Poe.

10. Buffalo Bills - Riley Reiff OT/Iowa

Kuechly may be the perfect fit for the Bills, but I held out hope that the Bills would re-sign Bell, but he officially moved on. I think Reiff has to be the pick.

11. Kansas City Chiefs - Dontari Poe DT/Memphis

Crennel loves big nose tackles and Poe fits the description. Will he be the force in the middle that the Chiefs hope he can be? That’s the real question as many analysts agree his game tape doesn’t match his combined workout.

12. Seattle Seahawks - Luke Kuechly ILB/Boston College

With Hawthorne moving on to the Saints, the Seahawks have to replace him. It’s crazy because just a few years ago they drafted Tatupu who seemed to be the next big thing….now they have to hope Kuechly is.

13. Arizona Cardinals - David DeCastro OG/Stanford

DeCastro will give Kolb and later Skelton much-needed protection. If Floyd falls he’ll be the pick here, but they may also look at Gilmore or Kirkpatrick.

14. Dallas Cowboys – Dre Kirkpatrick CB/Alabama

I think that DeCastro is the BPA, but with the Cowboy's recent signing at OG, I think they’ll look to upgrade the secondary. Kirkpatrick seems to be an upgrade over former pro-bowler Jenkins.

15. Philadelphia Eagles - Mark Barron SS/Alabama

With the addition of Bell at LT, Martin will continue his fall in the draft. Barron is what the Eagles have been missing on their defense since they let Brian Dawkins leave. In no way am I comparing Barron to Dawkins, but he is a playmaker.

16. New York Jets - Melvin Ingram OLB/South Carolina

The Jets would love for Ingram to fall to them here. He is one of those types of players that Rex Ryan loves on his team.

17. Cincinnati Bengals – Cordy Glenn OG/Georgia

With DeCastro off the board, Glenn is the next best OL to take. With their surprising run last season, upgrading the protection for Dalton can only help.

18. San Diego Chargers - Stephon Gilmore CB/South Carolina

The Chargers pick up probably the 2nd best CB in this draft and give Jammer help/replacement.

19. Chicago Bears - Quinton Coples DE/North Carolina

Coples have been dropping down many draft boards. He is the BPA available here and gives Peppers another pass-rushing threat on the opposite side and upgrades their aging defense.

20. Tennessee Titans - Nick Perry DE/USC

The Titans pass on a CB to replace Finnegan and look to upgrade their DL which is very weak. Perry is probably the best fit for the Titans as well.

The past 14 days have been more about March Madness than professional sports.
On a side note, the Kings did play in a few games this past week. The Sacramento Kings faced off against three teams at home this week: Detroit Pistons, Atlanta Hawks and Boston Celtics.

They finished with a disappointing 1-2 record, losing to a lowly Pistons team but included a 15-point win over the Hawks. In this post, I will take a look back at how the Kings have been playing since the All-Star break and look ahead towards the NBA draft lottery.

The Kings have not played particularly well since the all-star break, going 6-11 and losing by an average of 11.3 points per game. They Have won their six games by an average of 6.3 points per game, but on a more frustrating point, they are losing to the teams they are supposed to beat and competing with teams that have a better record.

In the middle of March, the Kings lost by 26 points to a potential playoff team in Denver. They then went on to beat playoff teams, the Miami Heat and on the road at Golden State. What this shows me is the Kings are a young and inconsistent basketball team. They have, much to learn and that will only come with more experience and playing time.

With just eight games left in the regular season, the Kings will soon turn their focus to free agency and the NBA Draft. As they currently stand, the Kings would most likely receive the 7th overall pick.
This draft class is going to be extremely talented and young, very similar to last year with the Kings picking two freshmen from the college ranks. Looking at the Kings current roster, to me they just lack experience.

De’Aaron Fox is their starting point guard and do not expect that to change any time soon.
On top of that, Frank Mason is perfect back up to compliment Fox.
Both of them will be battling for that starting spot which will bring out a higher intensity in both of their skill sets.


As for shooting guard, I truly believe the Kings have the ideal situation. Buddy Hield and Bogdan Bogdanovic are two of the best young shooters in the NBA. The Kings can start either of them and bring the other off the bench and I will be perfectly happy (and they should be to).
In the small forward position, Justin Jackson’s starting role has turned in to a more confident and productive player.
I believe he will be the starter moving forward, but do not forget Garrett Temple, who’s defense is one of the best in the game.

Moving to power forward, this is the one position I struggle with. It looks as if Skal Labissiere will start at this position for the remainder of the season as the Kings have no other options to turn to. The center will continue to be Willie Cauley-Stein unless we add a big-name center through free agency. As for what the Kings should be looking for in the draft, they should choose the best player available. They are just a few pieces away from starting something special in Sacramento.

As for my player of the week, Buddy Hield is earning those honors for the second straight week, averaging 19 points, 5 rebounds and 2.3 steals per game, not to mention eight three pointers. Next week, the Kings will take on the Dallas Mavericks, Indiana Pacers and Golden State Warriors at home before heading south to face the Los Angeles Lakers.

With eight games left in this up and down season, I want to see the Kings win the games they are meant to and compete at the highest level against top tier teams.


This season does not have to be a failure if they can gain momentum going into the offseason then the draft. Patience is key with this organization and I have learned that patience is a virtue, and their time will come.

The Sacramento Kings played just two games this past week with the All-Star break taking place this weekend.
They played two road games against the Dallas Mavericks and Houston Rockets.
They finished with a 1-1 record, which is great because they have not had recent success playing against either of these teams.

After the two games, Buddy Hield, De’Aaron Fox, and Bogdan Bogdanovich headed to Los Angeles to play in the rising stars game which is for first and second-year players.
Let’s just say one of the three took home the MVP, but we will get to that.

First, the Kings traveled to Dallas to take on the Mavericks.
The Kings used a strong first half to set the tone for the game.
They scored 65 points and played stellar defense by only allowing 44.
The 3rd quarter was an even battle, which gave the Kings a 17-point lead going into the final period.

The Kings would let up near the end of the quarter by letting the Mavericks scored 38 points to just 26 for Sacramento.
Fortunately, the Kings were still able to hold on and win this game 114-109.
The Kings have now won four of their last five in Dallas after losing 22 straight games in a span of 13 years.

Zach Randolph led the way with 22 points and 7 rebounds, while Bogdanovich added 19 points as well.
The 41-year-old, Vince Carter filled the stat sheet with 8 points, 7 assists, 4 rebounds, and 3 steals. This game was absolutely necessary for the Kings to win because their next matchup against Houston was going to be a much more difficult challenge.

On the second night of a back-to-back, the Kings faced the Rockets. The Kings jumped out to an early lead with great defensive presence, only allowing 20 points in the first quarter.
We knew the Rocket's high-powered offense would catch fire eventually and that is what happened in the 2nd quarter.
They outscored the Kings 35 -20 and had a 10-point lead going into the half.

From there, the Kings were not able to make up the separation and shot nearly identical in the 2nd half as the Rockets.
Therefore, Houston went on to win 100-91. The Kings held the Rockets to just under 40% from the field and 28% from three-point range after shooting 49 three-pointers. The defense was definitely there for the Kings, but they left their offense in Dallas.

The Kings only attempted 8 free throws to 22 for Houston. Bogdanovich led the way for Sacramento with 20 points, 5 assists, 4 rebounds, and 2 steals. No other player scored over 13 points for the Kings which cannot happen against arguably the most high-powered offense in the league.

Now that we are officially at the all-star break, the Kings were well represented in the rising stars challenge in Las Angeles. The ten best first or second-year players from the United States faced off against the ten best that are from another country.
Hield and Bogdanovich played for team World while Fox played for team USA.

In 26 minutes, Buddy Hield scored 29 points, including 5 three-pointers. In 22 minutes, Bogdan Bogdanovich scored 26 points, on 7 made three-pointers, and added 6 assists.
In 16 minutes for Fox, he had 4 points, 2 assists, and a steal. Since I said one of three took home the MVP, you are probably thinking it was either Hield and Bogdanovich.

Drum roll please…it was BOGDANOVICH. He had a game-high 7 threes and one of those was nearly shot all the way from Sacramento.
Buddy and Bogdan combined for 55 of the 155 points for team World. The future is bright in Sacramento.

With a 1-1 record and a rising stars MVP, it was a very positive week for the Kings. My player of the week, of course, goes to Bogdan Bogdanovich who averaged 19.5 points, 4.5 assists, 4.5 rebounds, and 1 MVP performance.
I know there is very little defense played in the rising stars game, but you still have to be able to score the basketball, and that is exactly what these young Kings did.

Next week, the Kings will only play two home games against the Oklahoma City Thunder and Los Angeles Lakers.
Even though it was a short week for the Kings, it was extremely encouraging.
Even if the wins are not coming in, this team is getting better each and every week.
Players are beginning to figure out their roles and no one’s ego is bigger than another’s. Now that it is the 2nd half of the season, I want to see this team finish strong, regardless of the win column.

The Sacramento Kings defeated the Golden State Warriors on Monday and nothing else matters.
I am kidding of course. The Sacramento Kings played four games this past week and went 2-2.

That might not sound great, but this may have been the best week of the season for the Kings.
They played the Warriors, the Bucks twice, and the Bulls. The reason it was the most successful week as they went 2-1 on the road.
Before that, the Kings had lost 9 out of their last 10 road contests. Let’s see how they were able to accomplish this.

The Kings faced off against their in-state rival Golden State Warriors on Monday. This was back and forth scoring for all four quarters.
With the game tied at 106, Bogdan Bogdanovich had the ball with 4 seconds left on the shot clock and drove Draymond Green to the basket, and scored with 12 seconds remaining.

Klay Thompson then missed the potential game-winning shot and the Kings held on to win 110-106.
Willie Cauley-Stein led the way with 19 points, 8 rebounds, and 6 assists.

This was the first time that the Kings won at Golden State in over four years. This game was a complete team effort. Six players scored in double figures and they shot over 53% from the field.
Some might say this win was a fluke because the Warriors were without Stephen Curry and Kevin Durant. You can argue that but a win is still a win and the Kings have been struggling to raise the win column.

Unfortunately, their next game was the next night at home against the Milwaukee Bucks.
This game was about over at halftime when the Bucks were up 61-37.
Giannis Antetokounmpo has truly lived up to his name of the “Greek Freak.”

He had 32 points and 5 rebounds, 5 assists, and 5 steals.
As for the Kings, they had a challenging time finding any offensive rhythm.
Garrett Temple was the only one able to score productively with 18 points.
No one else came out with the same intensity to face the Bucks' high-powered offense. The final score was 112-87.

From there, the Kings took to the road to face a struggling Chicago Bulls team.
The Bulls have the worst record in the entire league so the Kings had a great opportunity at hand.
It is always hard to win on the road and the Kings felt that this game.

No team was able to pull away until the very end.
Zach Randolph was able to will the Kings to a 107-106 victory with 25 points and 13 rebounds.
Bogdanovich was another key contributor with 19 points. Again, the Kings shot 53% which is a great sign.
In two of the last three games, they shot 53% or better and they came away with both victories.

The final game of the week came against the Bucks again, but this time at their home.
The end result was the same for the Kings, but it was a much more competitive game.
The kings were down 14 points with 8 minutes left in the 4th quarter and it looked like the game was out of reach.

They then went on a 17-4 run to bring it within a single point with under two minutes remaining.
That was the closest they would get to taking the lead because the Bucks would pull away and win the game 109-104.

Randolph led the way with 22 points and Buddy Hield made some key late threes to keep them in the game.
Fox was able to score in double figures for the first time in five games which was encouraging.

My final takeaway is that the Kings need more production out of De’Aaron Fox. He is averaging around 10 points, 4 assists, and 3 rebounds per game.
Those might sound like solid numbers for a rookie, but I have not seen him stand out in many games this year.

He has not scored over 20 points in a single game this season.
His speed gives him the capability to get to the basket at will and he needs to start utilizing that.
My player of the week is the future hall of Famer, VINCE CARTER.

In the game against the Warriors, the 40-year-old showed he still has it when he threw down a hammer of a dunk.
You could even hear whispers of greatness from the Warrior crowd.
Overall, this was a solid week of basketball for the Kings because they were able to take two wins on the road and hopefully it shows them what they are truly capable of.

Last night, the Cougs put on an offensive clinic against the New Mexico State Aggies in quarterback Anthony Gordon’s debut as a starter.

WSU took care of business in Martin Stadium, with a 58-7 victory over the Aggies.
After a very impressive first half from Gordon, Coach Leach viewed his performance as “decent”.

He didn’t want to set expectations too high for the Coug faithful because he understands the level of competition they were going up against.

Before we jump to conclusions and proclaim this team as Pac 12 champions, let’s remember that New Mexico State was a warm-up game for the season and they are no indication of the talent the Cougs will face throughout the rest of the season.
Now, let’s take a look at how this newly led offense dominated the field last night.

First-year starter Anthony Gordon looked completely ready when his opportunity finally came.
Gordon came out of the gates firing in Mike Leach’s air raid offense, throwing four touchdowns in his first four drives to four different receivers, with three of those passes going for at least 40 yards.

Don’t forget to throw in a Max Borghi touchdown run and WSU had a 35-7 lead going into the half. From there, the Cougs continued their beat down on the Aggies.
Gordon added another score and a few miscellaneous field goals later, and the Cougars start the season 1-0 with a fantastic confidence booster.
In fact, the Pac 12 announcers were so impressed, they thought they were watching the Washington State “Huskies”.

Taking a closer look at some stats, after starting the game 22 of 23 with four scores, Gordon would finish three-quarters of the game 29 of 35 with 420 yards and five touchdowns.
The most impressive part of it all was that six receivers finished with at least 50 yards, showing that Gordon had a committee behind him, not just a single superstar controlling the show.

Senior Dezmon Patmon led the crew with seven receptions and 103 yards, including a touchdown.
Sophomore Travell Harris added 91 yards of his own and a couple of scores, including one that went for 20 yards in which he probably ran about 60 yards.
Star running back Max Borghi ran the ball just 10 times but added 128 yards on the ground and a touchdown.

If we were to solely judge the Cougar defense based on the score of the game, we would say that they had an excellent performance on the field.
However, the Aggies drove down the field over 40 yards on their opening drive, which resulted in a missed field goal.
However, the very next drive, the Aggies marched down the field 75 yards in three minutes for seven points.

The Aggies had nearly three 40-yard drives in the first half, which probably should not be the case for a team that went 3-9 last year.
There were too many blown coverages by WSU in the first half and thankfully for the Cougs, New Mexico was unable to capitalize on their possessions.

I may be a little harsh for the first game of the season, but this defense must improve quickly before the 3rd week when they face a good Houston football team.

Overall, The Cougs probably exceeded most expectations for the first game of the season.
Anthony Gordon definitely showed what he had been advertised as…for now.
This was a poor New Mexico State defense and he will continue to be tested during the season.

His next challenge will come against the Northern Colorado Bears, who started the season off with a 17 point loss to San Jose State this past week.

My daughter and I love to travel and discover new places to eat and things to do.
We are not so much into the typical touristy things to do, though we have been known to visit typical landmarks and famous places.

We don't participate in the usual tours, instead choosing to explore on our own and take advice and suggestions from others who have been to the same places for food and fun places to visit.

This past long weekend, we visited Portland, Maine for the first U.S. stopover of the Mumford & Sons "Gentlemen of the Road" tour.

Portland is a great place to visit with beautiful scenery, decent weather (don't be fooled by its northern location - it can be hot, but mostly it was dry and lovely), and a plethora of foodie restaurants and boutique shops. Right up our alley.

Our first restaurant visit was to Duckfat. The name says it all.
Their fries are fried in duck fat and served with aioli and other spicy sauces.
We shared a large order which was way more than both of us could handle, but so delicious.
I also had a cup of a great carrot curry soup and C had a salad with shredded duck.

Almost every restaurant we went to in Portland was very familiar with gluten-free requirements, so it was easy to make most meals gluten-free if not full paleo.
Duckfat fries may not be paleo to some, but a little potato indulgence is fine with me.

I wish I had taken pictures, but alas, the food disappeared before I remembered to take any pics on this trip.

The 6000+ influx of people into the Portland area for the Mumford festival flooded the streets during the day and restaurants were a bit hard to get into.
We tried to visit The Farmer's Table for brunch, but they were filled to the brim for the rest of the day.
We opted for a trip to a small bar/restaurant for dinner that night.

I feel bad because I don't even remember the name of it, but they made a killer salmon filet for me with asparagus and more potatoes (potatoes and Maine must go together).
C had a shrimp risotto. The only complaint was the cloud of fruit flies that were attracted to our peach margaritas, but overall an enjoyable experience.

On the night of the festival, the crowds flooded Portland afterwards, looking like zombie hoards looking for victims.
C and I decided to go to a quieter location for dinner, having spent the day with the same 6000.
We went to Fore Street, arriving at almost 11:00 to an almost full house, but seated right away.
This place was amazing in a beautiful refurbished old building with rustic brick and wood.

The hostess led us past an open kitchen where a staff was hard at work.
We were seated next to a candlelit window overlooking the streets of Portland toward the waterfront.
We could watch the zombie hoards following the limos, which they hoped contained the members of Mumford and the other bands from the day, who had promised to frequent various venues for the rest of the night.

We had a waiter with a full 6 inch beard.
C commented that all of these farm-to-table restaurants seemed to have a staff that came straight out of the Daniel Boone era - always with full beards.

We shared an appetizer of the freshest raw fish I've ever had - salmon, tuna, scallops, and a white fish, each with its own topping.
The scallops and white fish were ceviched. C then had a huge piece of pork belly.
I had an even larger pork chop sitting on a bed of sauerkraut. We shared everything.
We were happy we did not order vegetables because there was certainly no room. Again, this restaurant was gluten-free friendly and oh-so-paleo.

On Sunday, we headed to Boston, a quick two-hour drive.
Once again, we did not suffer from lack of choices.
On Monday, we went to Nebo, winner of a Bobby Flay showdown.

We had the most delicious gluten-free pizza (paleo was out the window at this point).
This is possibly the most gluten-free friendly place I have ever been.
They had a complete two page, small type, menu of gluten free pastas and pizzas.
I had the Michael Diavolo pizza - bacon, pepperoni, mozzarella, tomato sauce.

Beautifully prepared and delicious. C and her boyfriend had equally tasty variations.
She opted for a potato gorgonzola version while he had a custom margherita style.
The crusts were wonderful - as far as I am concerned they were as good if not better than most pizza crusts I have had, GF or not.

If that wasn't enough, C and I went to brunch on Tuesday for our last meal in Boston for the week.
We went to Zaftig's. It is a Jewish delicatessen style restaurant.
I had scrambled eggs with beef salami which came with a side of home-fried potatoes and three slices of watermelon topped with strawberries.

C had a version of eggs Benedict on GF potato pancakes with more watermelon and berries.
We ate well this week and this place just topped it off with deliciousness.
What a great finale to a fun week of eating.
Oh yeah, we also visited Walden Pond, Boston Commons, saw two movies (Beasts of the Southern Wild and the latest Batman), Castle Island, and of course, shopped Newbury Street several times.
Almost forgot chocolate hazelnut cake (all GF) from L.A. Burdick and iced chocolate. I think I need to go to the gym a lot this week.

The Fourth Circuit has recognized that alienage is an improper basis for a sentence and violates due process.
The Sentencing Guidelines also expressly prohibit a sentencing court from considering a defendant's national origin when calculating a term of imprisonment.
In U.S. v. Salama, the Fourth Circuit held that it was harmless error for district court to comment about the defendant's alien status based on the particular facts of the case, however, the appellate court did note that the remarks were inappropriate.
In U.S. v. Munoz, the United States Court of Appeals for the Fourth Circuit determined that a district court could consider a defendant's background, characteristics and conduct, thus, a court may refer to a defendant's alienage.
For example, a court may make a reference to a defendant's national origin to deter similar criminal conduct by others of the same ethnic background, as long as alienage is not the basis of the sentence.

The Munoz Court held that the connection between the targeted group for deterrence and the individual being sentenced must be the offense conduct and not the individual's national origin.

This issue will again be examined by the Fourth Circuit Court of Appeals in its December 2009 term.
It will be interesting to see how the appellate court treats alien status as a factor in sentencing proceedings in light of the Supreme Court's decision in Booker.
Other Circuit Courts, like the Second Circuit and Eighth Circuit Court of Appeals, have held that even the appearance that a sentence reflects a defendant's race, national origin, or alienage requires that the sentence be reversed.
In the initial brief and reply brief, the appellant argues that the Fourth Circuit should adopt a similar rule.
The government argues in its appellate brief that any error was harmless.

In Federal cases, a defendant is sentenced in a separate court hearing that is set well after a guilty plea or guilty verdict after a jury trial.
During this hearing, the district court calculates a defendant's guideline range, address objections to the pre-sentence investigation report, decides whether any sentencing enhancements are appropriate, and if a downward or upward departure should be granted.
Federal sentencing proceedings are complicated and as a result, the District Court often commits reversible error during these proceedings.
The appellate court will reverse a defendant's sentencing when the District Court improperly applies the law or violates a defendant's constitutional rights.

When filing a federal appeal, an appellate lawyer uses case law precedent of the Circuit Court and U.S. Supreme Court to argue the defendant's position.
However, in cases that present an issue that has not been addressed in that particular court of appeals, a federal appellate attorney will cite cases from other circuit courts to support their argument.
It will be interesting to see what questions the Fourth Circuit will ask at oral arguments in Richmond, VA in December, and whether the Fourth Circuit will join the Second and Eighth Circuit in holding that even the appearance of ethnic or racial bias by a district court when imposing a sentence is unconstitutional, which would require a reversal and remand for a new sentencing hearing.
