Business / Employment Laws In Nigeria. by akinniranye(m): 6:57pm On Dec 29, 2015
Top management/human resource consultancy |www.novatiaconsulting.com

Employment law in Nigeria is generally employer friendly. Nevertheless, there are federal and local employment and labor laws that govern contracts, wage and hour, discrimination, terminations, lay-offs and privacy. Any company conducting business in Nigeria or considering doing so should be familiar with the various laws which govern the employment relationship.

Sources of Law and Associated Government Agencies:

With regard to private employers, Nigerian Labor and Employment law is largely based on the following statutes:

the Labour Act of 2004;
the Trade Union Amended Act, 2005;
the Employees Compensation Act, 2010;
the Factories Act, 2004;
the Pensions Act, 2004; and
the Trade Disputes Act, 2004.
The Ministry of Labour and Productivity (the Ministry) is the main regulatory agency. Enforcement of employment statutes and regulations falls under the auspices of the National Industrial Court With regard to discrimination claims, there are no laws that specifically prohibit discrimination or harassment in the employment context. However, Section 42 of the Nigerian Constitution provides for freedom from discrimination on the basis of sex, age, ethnic group, and political affiliation.

Organized Labor and Worker Representation:

Although the Constitution allows for free association, including the formation of, or membership in labor unions, there is no specific legislation mandating works councils or workers' committees.

Hiring of Employees

Aside from the constitutional requirement of freedom from discrimination on the basis of sex, age, political affinity, and ethnic group there are no legal requirements to give preference in hiring, or not to discriminate in the hire of employees. In addition, employers may perform background and medical/drug checks when deciding hire a potential employee. Such checks may be performed by a third party, and must be undertaken at the employer's expense.

When a hire is made, The Labour Act requires employers to provide an employment contract setting out the terms and conditions of employment within three months of the commencement of employment. The contract must provide: the name of the employer, and if appropriate, the undertaking by which the worker is employed; name, address, and date of hire of the worker; nature of the employment; date of expiration if the contract is for a fixed term; the appropriate period of notice for termination with attention to section 11 of the Labour Act; rates of wages, method of calculation, and frequency of pay; terms and conditions relating to hours, holidays, incapacity (including any provisions for sick pay), and any special conditions in the contract. Employers may use the first three months before providing the contract as a probationary period, and if spelled out in the contract, time thereafter as well. With regard to contracts for a fixed term, contracts must be in writing, but otherwise there are no statutory limitations or restrictions on employment contracts for a fixed term.

In certain situations, an employer may desire to use independent contractors rather than hiring an employee. The rules governing independent contractors in Nigeria are similar to the United States. For example, an employer will not be held vicariously liable for torts committed by an independent contractor. Status as an independent contractor is determined by the level of control exercised by the employer over the contractor.

Foreign Workers:

Admission of foreign workers is overseen by the Federal Ministry of the Interior. Employers must seek the consent of the Ministry in order to employ foreign workers by applying for an "expatriate quota." The quota allows a company to employ foreign nationals in specifically approved job designations as well as specifying the validity period of the designations provided on the quota.

There are two types of visas which may be granted, depending on the length of stay. For short-term assignments, an employer must apply for and receive a temporary work permit, allowing the employee to carry out some specific tasks. The temporary work permit is a single-entry visa, and expires after three months. There are no numerical limitations on short-term visas, and foreign nationals who meet the conditions for grant of a visa may apply for as many short-term visas as required.

For long-term assignments, the employer should apply for a "subject-to-regularization" visa (STR). To apply for an STR, an employer must apply for and obtain an expatriate quota. The expatriate quota states positions in the company that will be occupied by expatriate staff. Upon arrival in Nigeria, the employee will need to validate his or her visa by applying for a work and residence permit.

Business / How To Send Bulk E-mail Without Getting Blacklisted! by akinniranye(m): 5:18pm On Nov 12, 2015
1- Everyone on your mass email list must be an opt-in subscriber. Oh did we say must? Sorry, we meant MUST. If you send unsolicited email messages, that is considered to be spam. You can avoid the dreaded spam label (which will hurt your mass email deliverability and your business's online reputation) by only using opt-in subscriber lists. Check out our email list building blog post if you want to know more about how you can get customers to opt in to your mass email newsletters. Also, don't ever rent or buy mass email lists. And include an easy way for subscribers to opt out in each email you send, in case any of them do not wish to receive any more of your email messages.

2. You should be familiar with email marketing regulations before you send out any mass email messages. If you aren't following spam guidelines as well as the laws of the countries to which you are sending, your mass email marketing will go nowhere. Review spam guidelines here.

3. Your email newsletter subject line should be eye-catching yet straightforward, and should avoid spam words. Your email subject line is your first chance to connect with your subscribers. Of course you want subscribers to be intrigued, so you can say something like “The Five Things You Need to Know About Buying a Car” or “The Best Mac and Cheese Recipe Ever.” Be careful not to include words like “Free” or “Cash” and don't put your title in ALL CAPITALS. You can see a more complete list of spam trigger words here. Studies have also found that mass email subject lines perform best with email subscribers when they are direct and truthful about what is in the email. Subscribers want to know what is in the email before they open it, so let them know in the subject line that there is a 25% off coupon for them inside.

4. In most cases, try to keep your mass email newsletters short. Subscribers tend to skim longer email messages anyway, so stick to your most important points. If you want to include additional information, you can always add links to online sources (such as blog posts, articles or other information) so interested subscribers can click to find out more.

5. Don't include too many images or graphics in your mass email messages. A lot of images can make your emails slow to load and may cause display issues. Also, many subscribers do not allow images to display, so they may just show up as white space. To avoid this problem, use a mass email marketing program that automatically creates a text only version of your emails.

Firstly, handling MoU is very tactical, we could help prepare one. Sometimes these people are very intelligent that they get you sign a cooperative agreement instead of a partnership agreement.

The difference is that cooperative agreement is not as binding as the partnership agreement. It is an exclusive declaration of interest to work together. The laws that govern them are different.

Under this proposed relationship:

You can have an understanding that would cover the following;
•Distribution partnership
•Promotion/market entry partnership
•Information partnership
•Business representation partnership

All these can be included in one MoU.
You may ask the following questions;
•i am bringing your goods into Nigeria: How do we design the system of purchase? What percentage of money am I to pay on what % of goods? Do I have exclusive right on these distribution? How do you intend to service your guarantee on these goods?
Can you give me goods and I pay later and under what agreement?

•If their products are new in the Nigerian market, I can help represent create and manage a service/maintenance desk.
•How does the company intend to finance business promotions in Nigeria?
And subsidise the cost of promoting their goods in a new market?

I can go on and on...

Business / Questions To Ask To See If You Are In The Wrong Business by akinniranye(m): 5:36pm On Nov 03, 2015
Questions To Ask To See If You Are In The Wrong Business

These words have a certain magical energy to them. They give every solopreneur, looking to hang out a shingle on the Internet, a sense of being on the same level as a Bill Gates, or a Donald Trump, or a Larry Ellison. The vision of a future business maven who creates an empire and makes a mark in the world.

What’s nice about this dream is that it has a fair chance of coming true… for anyone. Yes, even you and me!

That’s why many call the Internet a “great leveler” that flattens the playing field and gives you a fair shot at massive success.

Still, building a business can be hard work – if you let it.

There’s a way you can take most of the pain and tears, frustration and anxiety, struggle and suffering out of it. And that’s by finding the work you love.

When you are engaged in doing what you like and enjoy, it no longer feels like work. It’s like having fun all day long. Most entrepreneurs who have made it big started out with such a fun idea they were wholeheartedly engaged in, they were able to sustain the enthusiasm and excitement for long enough to cash out – and touch the world.

Facebook started out as a playful coding effort in a college dorm room, seeking to build a network for students to interact online. Google was the brainchild of two nerdy engineers obsessed with refining and perfecting search algorithms, and bent on delivering a better search experience than what they could find already. Amazon.com started out as a creative geek’s concept of creating an inventory and catalog of books on a scale that was simply impossible in a physical offline store.

That these online giants have morphed into something far bigger than their origins might have suggested is in itself proof that the concepts on which they were built are valid and valuable. But more to the point, they are proof that the passions of their founders were deep-rooted and powerful enough to last through phases of extra-ordinary growth, strong enough to scale and adapt to the altered vision of their dreams, and continue to soar ever higher and reach new peaks.

That’s only possible when you love the work you do.

Education / Falling In Love In School? Top Advice! by akinniranye(m): 6:07pm On Nov 02, 2015
Wow, I just decided to engage you with something different yet something that will make all your learning affairs count.

It is good to consider this although you may be outstandingly nervous about some inward conditions or circumstances that could get you unsettled in school. You may be losing strength in the wrong or right direction.

How do you feel when your mate is talking to you about some study interests, and all you were busy imagining is the fine and attractive face before you! You might even have been praying for the holiday to quickly end.

How do you feel when your teacher is talking to you with certain level of authority but yet can't look at your overwhelming face twice!!

It seems this is loud in your mind. Hmmmm. I got you.

School sometimes can become a place of some tremblings and inward aggressions. Or even some questions may flash your heart. It seems she loves me?

This what to do! When you are in school know the goals and your part in it. Give your best to achieve the goals. Don't ever allow your confidence in your dignity to fall like a pile of card. Always know that school is a learning place.

Always embrace friendship. Diligent, result oriented and sound friendship!

Let the friendship be open. Allow other become part of that friendship. Don't love in isolation. You will end up having sex.

Keep this! A mature friendship is the key for a happy marriage.

It is what you become out of school that is important. Be happy with friends and keep friendship.

Finally wait for the right time when your mum and dad would approve your entering a marital relationship.

Wait a minute!

Education / Top Ten Qualities You Should Look For In A Home Tutor by akinniranye(m): 8:04pm On Oct 30, 2015
Great tutors are very rare and if a student is lucky enough to have one he/she cherishes and remembers forever. The teachings of a great tutor are like imprints made in the mind of the students and are never wiped off however old they get or go ahead in life. That is the impact of a tutor in a student’s life. An important attribute of a successful tutor is communication. Communication goes hand in hand with teaching as it is the only channel for teaching and learning. It plays a significant role in Home tuitions as the tutor has one –on-one communication with the student. A home tutor has a completely different relationship with the student as compared to the teacher in a classroom in school. A home tutor can make or mar a relationship with the student; hence the parents should be extra careful while selecting the right tutor for home tuitions.

Here is a list of ten qualities that excellent home tutors have in common:-

1)    Excellent listener – Every tutor should be a good listener but this trait takes a foremost position when it comes to a home tutor, primarily because the one-on-one conversation is comparatively more. Hence a home tutor is expected to be an excellent listener and not just a good listener. They have to listen carefully to what the student is saying and figure out the problems and clear it by making the concepts easy and understandable. A home tutor is different from a teacher in a class room. A teacher in a classroom can follow the same teaching technique for years together but a home tutor has to listen to student and change his teaching style according to the student’s ability and grasping power.

2)    Rich in concepts – A home tutor is expected to have thorough knowledge of the curriculum which he is expected to teach. Their teaching should meet a certain standard of understanding so that the parents are confident about their child’s education. The tutor is expected to demonstrate the difficult concepts without using technical words or jargons with ease to the student so that it creates interest and enthusiasm in learning further.

3)    Passion for teaching – A home tutor should be passionate about teaching and should be interested to work with children. They should influence the student’s life and help them realize their dreams. A passionate tutor has a lot of energy and inspires the students to make their dreams come true.

4)    Good rapport with students – A home tutor is expected to share a strong rapport with the students and establish a trustworthy relationship. This job could be difficult as most of the students do not enjoy sitting with a tutor and studying for hours together and this could be stressful for both the student and the tutor. Hence, the home tutor should be able to handle such situations with enough maturity and be a friend with the student rather than an ally. The home tutor should break the ice and constantly encourage the student. A successful home tutor should first establish a comfort level with the student and then start with teaching.

5)    Maintain calm and patience – Maintaining calm and patience is part and parcel in the profession of teaching and a home tutor is expected to have it in abundance. Impatience with students is a sign of the tutors own short comings. A home tutor should follow a systematic approach towards teaching which includes explaining concepts in small manageable parts so that the student gets enough time to learn each concept thoroughly. A home tutor should be capable of patiently teaching the same concept in different ways so that the student can grasp the easiest one.

6)    Professionalism – A good home tutor should always act professionally. Professionalism includes dressing appropriately, positive attitude, maintaining discipline during tuition hours and body language while interacting with student and their parents. Apart from this, the home tutor should be prepared for every session and get relevant work sheets and keep the parents informed on their child’s progress periodically.

7)    Strong communication skills – Communication is a very important quality for a home tutor. The tutor should be able to communicate the subject matter with the student in a way the student understands the best. They should ask questions and ensure that the student has understood what has been taught. Some students say that they have understood even if they have not, Hence in such cases a tutor should explain concepts in several ways and figure out whether they have understood or not.

cool    Have a vision and mission – A good home tutor should have a vision and should illuminate the students mind about the bright future they will have if they learn well. Their only mission should be teaching and inculcate interest in learning. They should have the ability to build up curiosity in teaching.

9)    A Mature mentor – Maturity and teaching go hand in hand. A home tutor should be able to handle emotional ups and downs of the student respond to them appropriately. They should act like strong pillars and ensure to the student that come what may they are always there by their side.

10)    A good planner – Planning well in advance and sticking to the plan is an important trait of a home tutor. A planer should be made keeping into account the syllabus and curriculum and the students pace and grasping power. The tutor should plan in such a way that the student is ready for exams well in advance with a good number of revisions.

These are the top ten qualities one should look for before hiring a Home tutor. A student will surely succeed in life and perform well in school and college once he/she gets connected to the right Home tutor.

Education / Getting A Home Tutor (guidelines) by akinniranye(m): 5:54pm On Oct 21, 2015
Most of the time, requesting the service of a Nigerian tuition agency or searching through a home tuition forum will take up too much of your precious time to find a suitable home tuition teacher.

This can get frustrating, especially when you need a home tuition teacher urgently for the upcoming examinations.

If you are unfortunate, a home tuition agency might even introduce a home tuition teacher who is inexperienced or unprofessional
Tempted to go for group tuition at a tuition center instead?

Well, as it turns out, this might not be the right choice for your child too, as studies have shown that the average student under personalised one-to-one tutoring performs better than 98 percent of students. (Bloom, 1984)

Unless someone within your contact pool knows of a trusted and reliable private home tuition teacher, finding a good home tuition teacher who can help improve your child’s grades is largely a game of chance.

Or is it?

The trick is to simply find City tutors Nigeria the only approved and authorised home tutors organization for tutoring in major cities in Nigeria, who can cater to a child’s personalised learning path and pace.

And here’s how:
