FINANCIAL DIFFICULTY OR HEALTH PROBLEMS ISN'T A LEGAL DEFENCE TO DEBTS OWED IN THE UAE Corporate, Commercial (Debt Recovery), Legal Draftings & Company Formation Specialist in Nig & UAE. +971568225948 The parties entered into a written agreement on 12 January 2016, entitled ‘LEVIS Personal Loan Application (the “Loan Agreement”). Under the terms of the Loan Agreement, the Claimant approved the sale of a personal loan to the Defendant. The Claimant claims sums owed to it pursuant to a Lily Cashback Card also availed of by the Defendant. Pursuant to the Loan Agreement, the Defendant received an amount of AED 150,000, to be repaid in 48 monthly instalments in the amount of AED 3,745 under the product titled the Personal Loan (the “Personal Loan”). The Claimant submits that the total outstanding sum owed to it in relation to this product, and the outstanding sum owed was AED 138,092.05. On 3 July 2016, the Defendant availed of a top up on the Personal Loan, which was approved in the amount of AED 210,000 (the “Top Up Loan”). Pursuant to this, the amount of AED 71,907.95 was credited to the Defendant’s account, and the amount of AED 138,092.05 was settled under the Personal Loan. The Claimant submits that the Defendant fell into arrears in relation to the Top Up Loan on 9 February 2019, and that the remaining outstanding amount is AED 101,372.18. On 11 January 2016, the Defendant received from the Claimant a credit card with a limit of AED 15,000. The Claimant claims that the Defendant fell into arrears and that the outstanding amount owed to the Claimant in relation to this product is AED 19,103.25. Following the Defendant’s failure to settle the amounts outstanding, the Claimant proceeded to file its claim for the recovery of the sums due and owed to it with the Small Claims Tribunal (the “SCT”). The Defendant did not file an Acknowledgment of Service, and has only provided submissions in the form of screenshots evidencing payments being made to the Claimant. At the Hearing, the Defendant did not provide a substantive defence, and submitted that he has been faced with financial difficulty and is unable to pay the amounts owed to the Claimant. The parties met for a Consultation with SCT Judge Nassir Al Nasser on 19 January 2020 but were unable to reach a settlement. In its written submissions and in the Hearing, the Claimant relied on the terms of the Agreement which set out the sums owed to it by the Defendant and the dates by which the Defendant was to settle its liabilities to the Claimant. The Claimant confirmed that it sought repayment of the outstanding amounts of the products it provided to the Defendant, which, as of the hearing date, amounted to AED 121,022.41 It also confirmed that it is seeking post-judgment interest on the sums due, as well as the recovery of the fee paid to the Court for the filing of this Claim, in the amount of AED 6,051.10. No defence was put forward by the Defendant, who submitted that he had become unemployed and has faced health trouble since availing of the products provided to him by the Claimant, and stated that this loss prevented him from making the payments owed by him under the Agreement. Based on the evidence before me and in the absence of any substantial defence being put forward by the Defendant in regards to this Claim, I am satisfied that the Agreement between the parties is valid and binding, and that the Claimant is owed a total of AED 121,022.41 being the sum of the Top Up Loan and the Lily Cashback Card. The Defendant’s financial circumstances, while unfortunate, do not bear any legal standing to his obligations to the Claimant. The Court ordered that the Defendant shall pay the Claimant the amount of AED 121,022.41 for the sums owed to it as well as the sum of AED 6,051.10 being the Court fee paid by the Claimant to the Court for the filing of this Claim and the Claimant shall also be entitled to post-judgment interest at a rate of 9% per annum pursuant to the DIFC Courts’ Practice Direction No. 4 of 2017. It is advisable that:You always respond to court summons, whether you are guilty of the matter of not. Not answering equals to selling off your right to a defence to the claims. When you respond to a court case by filing an Answer, you may have defenses you can tell the court about. If you don’t tell the court about your Legal defenses in your Answer, you can’t bring them up later. List and explain each of your Legal defenses in your Answer to the Complaint, after you have responded to all of the paragraphs in the complaint. You need to put your defenses under a separate heading, like “Defenses,” and include any facts to support them. Kwara South Youth Development Organization (KWAYORG) meets Hon. Raheem Ajuloopin, discuss Youth Conference 2019 Members of the planning Committee of the Kwara South Youth Conference 2019 met with the Honourable Representing Ekiti, Isin, Oke Ero and Irepodun Federal Constituency to discuss the preparations towards the Youth Conference slated for December 19 in Omu Aran. The meeting was an avenue to discuss modalities, templates and the Roadmap towards a fruitful and stress free Conference in December. The Lead Convener, Barrister Titilope Akogun took time to explain the practical workings and benefits of the conference to the Lawmaker. KWAYORG team represented by Barr Titilope Akogun, Stephen Ariyo, Kazeem Adebayo and Omotosho Babatunde took their time to explain the conference would feature industrialists, captains of industries, Businessmen, Governance specialists who are mostly young men specifically from Kwara South and those who have Distinguished themselves in their respective careers. It was stated the Conference would berth a Proclamation that would be presented to the State Government and all Legislators for probable adoption and finally the Criss - Cross Empowerment Model for a sustainable empowerment Model in Kwara South. The Lawmaker in turn explored the avenue to draw an insight into his lofty initiatives which includes his Federal College of Education Bill, beginning of Eye - solution intervention for over 700 in Oke Ero Local Government from 11th October, 2019, scholarship for best 4 indigent students in each Secondary School in his 4 Local Government Areas he represents, productively training and empowering young persons on ICT soon, amongst several other laudable initiatives. The Lawmaker used the opportunity to express his dissatisfaction and regrets on the Youth unemployment rate in his Constituency and gave a working template of how to achieve a sustainable Roadmap to addressing unemployment which would be unveiled soon. He also stressed that Women and Traders would soon rejoice under his representation. He used the opportu nity to also address the issues of transformers in some communities which he is presently working on salvaging their conditions as facilitation of new transformers to replace the old and refurbished transformers is his priority for those communities. The Lawmaker expressed his confidence in the initiative of the conference as it would be a laudable eye opener for many, and would be an avenue to brainstorm and suggest way forward for our Constituency. He concluded by giving his nod to his active participation at the Conference come December 19, 2019 as it would also be a platform to share experience, expertise and hear from his constituents, especially being the first in Kwara South History. CONSIDER SENSITIZING YOUTH ON 21ST CENTURY SKILLS; SENATOR LOLA ASHIRU CHARGES KWARA SOUTH YOUTH DEVELOPMENT ORGANIZATION While meeting Planning Committee of the Kwara South Youth Conference 2019, Sen Ashiru decried the disunited tendencies amongst the Youth, while calling for a purposeful and united youth population to start addressing the unlimited challenges confronting Kwara South. Sen. Ashiru further reiterated the elders could do less, as the future lies in the abilities of the young persons to take up challenges and be ready to be problem solvers at the expense of being complainants. Asserting his support for the Youth Conference, emphasizing on the need to collectively "Rebuild Kwara South", the Lawmaker declared he is always interested in 21st ideas towards Rebuilding Kwara South. He affirmed his commitment towards youth oriented initiatives that are Laudable and sustainable, charging KWAYORG to consider 21st Century skills, towards building it's teaming members. "Your resolve to lay a foundation towards addressing the Challenges of our Senatorial District is a very commendable one. If we can massively confront the challenges head - on, the solutions if not achieved wholistically by now, would have been closer to us". I urge you to use the population of our Senatorial District towards a positive drive, lead by principles, to achieve the desired result. This has neither taken our region anywhere, neither has it culminated to the even development of our region. We continue to be subservient in all ramifications. We have power, but we are weak. We have population, but without impact, we are educated and exposed but without a commensurate development. We have a lot of untapped resources, diverse opportunities which pass us by year in year out. We seem to be sheep without shepherds. We allow division reign supreme in our midsts. Kwara South must have a Voice and we must not be shattered despite our political inclinations or personal yearnings. We welcome us to this endless and mutual beneficial relationship. We will at the conference be dissecting, analysing our failures, opportunities and solutions towards bringing out the best in our youth. Education of our youth and people of the grassroot is Paramount to achieving our goals. Impactful and Sustainable Empowerment, Job Creation, Agriculture and Industrialization should be the hub of our region. We refuse to live in the euphoria of the past! Many of the political players are not also on social media platforms or the conventional media, reason why we have to take the cause to the grassroot through the Youth who happen to be the victims of untapped opportunities. This Kwara South Youth Conference 2019 will be a vehicle to reorient the grassroot and redefine our orientation as Youth towards a productive future. The historical antecedents of the artistic and cultural sights of the museum gives us a convinction that if given the necessary attention, with a proper maintenance culture, could become in no distant time, our "Dubai in Nigeria". We believe in your leadership that it will not stop with just a visit, but the fact that you would surpass our expectations on the Museum being a widely traveled Governor with an unrivaled experience of the unprecedented benefits of tourism. The interest in re - assessing for revival, the long neglected Technical College is also a reflection of your Roadmap for Kwara South. The Technical College is an abode for training and acquisition of skills for thousands of Kwarans and beyond, especially now that all over the world, there is prioritization of skills to educational certificates. Your Excellency, we are so proud and elated you have started well in Kwara South with this on the spot assessment of the Museum, the Government Technical College, and also the worrisome status of the health facilities in Oro General Hospital, which we believe would receive the necessary attention in due time. HOW TO REGISTER AN NGO IN NIGERIA STEPS TO REGISTERING AN NGO IN NIGERIA Non-Government Organisations (NGOs), sometimes called Civil Society Organisations (CSOs). They are non-profit, voluntary citizen’s groups organised for a common interest and perform a variety of service and humanitarian functions. They are organised around specific issues, such as human rights, child rights, health care, etc. They are usually funded by donations and are run primarily by volunteers. They are exempt from tax in Nigeria. Although an NGO is not a commercial entity, the Corporate Affairs Commission views it as an entity which needs to be registered nonetheless. There is therefore a laid down process for the registration of NGOs in Nigeria. This article will give a step by step breakdown of the process. The registration of NGOs is a bit peculiar in that it can be done under Part A of the Companies and Allied Matters Act as a company limited by guarantee or under Part C of the Companies and Allied Matters Act as Incorporated Trustees. This article will explain the process to register an NGO under Part C. STEP 1 As with all registration of entities in Nigeria, the first step is to conduct a search on the name to find out if it is available and to reserve the name if available. It is always advisable to have at least 2 names, one alternate in case the primary name is unavailable. STEP 2 NGOs and CSOs are supposed to be governed and managed by what is known as a Board of Trustees. These are the equivalent of what a shareholder/director would be in an incorporated company. The Trustees of an NGO or a CSO are responsible for the management and direction of the association. STEP 3 Once you have your name approved and your board of trustees in place, the next step for the registration of a NGO in Nigeria is that the Trustees must publish a notification of their intention to register a NGO. This notice must be published in 3 newspapers, one of the newspapers being one that is widely circulated in the area where the organisation will be based. STEP 4 The next step is to complete and submit the application form. The application form is self-explanatory and asks for information like the approved name of the NGO, the registered address of the NGO, a brief description of the aims and objectives of the NGO. The form also requires the personal details of the Trustees, this includes their names, sex, nationality, permanent residential addresses, occupation etc. The completed application form must be submitted alongside other documentation which includes an application letter, the original newspaper publications, two copies of the NGO constitution, the minutes of the meeting where the trustees were appointed, 2 passport photographs of each Trustee etc. STEP 5 All the documentation is then reviewed by the CAC, and if there are no queries, the NGO is registered with the CAC and can then commence operation. Nigerian courts more often than not share property in a marriage to the benefit of men, who usually have higher income. This is because the court insists on contribution as the basis for division. The court has decided that direct financial contribution to the purchase price of a matrimonial home or to the repayment of the mortgage must be proved before joint property can be inferred (Essien v. Essien (2009) 9 NWLR (Pt. 1146) 306, 331-332), where the Court of Appeal restated the decision of the Supreme Court in Adaku Amadi v. Edward Nwosu (1992) 6 SCNJ 59). The court accordingly refused the appellant's case on the basis that she did not prove contribution. In Oghoyone v Oghoyone (see Question 5), the court held that the respondent was entitled to joint interest because both parties contributed to the property. Contribution by a party does not necessarily have to be in the nature of a cash outlay for the purchase or development of the property. For example, contribution can be by way of moral and/or financial contribution to the business of the other party where the property is acquired with the profits of the business (Ibeabuchi v. Ibeabuchi (2016) LPELR-41268). Given the discretionary powers of the court under the law, it is suggested that contribution should not be the major consideration. The attitude of the court will do injustice in many cases against the intention of section 72 of the Matrimonial Causes Act. For example, a party may have been taking care of the children's food or school fees when the property was acquired by the other. This has resulted in a situation where parties who have properties abroad prefer to petition for the division of assets in countries where the courts are more favourable to women. |
