ENIGMATIC2023: Only the court of appeal can set aside that ruling.... A high court cannot set aside a judgement of another high court A lower court cannot set aside a ruling of a higher court. The two court have the same jurisdiction they can set aside their ruling. |

Lol I see people saying the judiciary is useless meanwhile they don't even know how it works. Two of them can keep countering their Ruling because they're of equal jurisdiction. The matter should be taking to a higher court to avoid problems. according to judicial precedence the two of them are allowed to do that because they're equal. |

Two cases were dismissed based on the same principle of finality and only one got fined.
Whereas for the Bayelsa case,the law clearly states that you disqualify a candidate based on false information of fundamental nature and not on conflicting information . The two cases are not the same. |

The primary case, I mean the written submissions before it went to the Supreme Court was weak from the APC angle. The SC based on that to give judgement against APC.
Try and get the submissions of the APC lawyer, you can see the weaknesses even if you aren't a lawyer. I have all this 'cos my roommateat school works in the Chamber of one of the lawyers that won. They played into the PDP's hands.
I am not talking about the review.
Get a good lawyer, but there are certain cases that warrant a big lawyer. When you get to those cases, you will know. Finally we're on the same page! It was a very weak call for review from the APC. They just played the ball into PDP hands. |

Because first of all it was a review and a review don't mean Supreme Court will change its mind. It can hardly overturn situations or verdict it has previously dealt with. When I mean no two cases are the same refer to the applications entered by the lawyers. This Bayelsa connundrum would have been averted if APC had used an experienced lawyer.
APC fell into the hands of the PDP. I saw the written addresses and can tell you if some big lawyers had handled Bayelsa case...APC would have won

No two cases are the same. The case of Bayelsa was thrashed excitingly well here some weeks ago. Legally, Degi had no case as the error(s) had been made by his lawyers from the lower court and he showed an aptitude for been chameleonic. Section 187(1) and (2) of the 1999 Constitution (as ammended) also made his case affect Lyon.
If you want to be honest, Uncle Wole and Aare didn't quote any technical (or human) error, they only based on the fact that the lower court was silent on certain prayers that the SC upheld. Judicial precedent can tell us that the FHC judgement isn't binding on the SC. We have dealt with this extensively in the last few weeks.
In the case of Imo, there are clear errors pointed out. I support the SC's stance on not reviewing it (because it will call for ceaseless litigations) but they could have sought a way to correct inter alia some fascinating lacuna in their judgement.
1)The issue of spread which Hope and ultimately Ihedioha didn't enjoy as enshrined in Section 179(2) of the 1999 Constitution (as ammended).
2) The issue of valid votes higher than the number of accredited voters.
The judgement is for all ages, and this is going to be a big problem for INEC as the Edo and Ondo elections beckon.
Lawyers will seize every opportunity to quote and link this judgement, politicians as well aren't fools. Since the SC has legitimised it( so to speak), win at all costs with or without credence to any of the two reasons above.
The Omehia/Amaechi case is an example where the SC had to reverse itself 11 years later. This judgement post-2023, will judiciously die permanently.
Their thinking is let us allow all parties lick their wounds, and let's move on.
For the fine...following the uproar, it will be unearthing pandora box.

According to Glanvile Williams Definition of precedence, states that precedence is following previous decisions where the facts are the same. If Musa stole a car In someone's compound in 2008 and Ebere stole a car too in someone compound in 2020.They are the same Case, their facts are the same so the same punishment that applied to Musa is the same that'll apply to Ebere (unless the constitution was amended within those years) if not its the same case. But, That of Baylesa and Imo are two different Cases! The verdict was not even the same and that's how it's supposed to be. |
