The Federal High Court in Abuja, on Wednesday, ordered the Independent National Electoral Commission, INEC, to forthwith, issue Certificate of Return to Dr. Obiora Okonkwo of the Peoples Democratic Party, PDP, as the validly elected representative for Anambra Central Senatorial District.

The court, in a judgment that was delivered by Justice John Tsoho, further ordered the Senate President, Dr. Bukola Saraki to immediately swear-in the plaintiff to occupy the Senatorial seat which has been vacant since 2015.

The verdict followed a suit marked FHC/Abj/CS/1092/14, which Okonkwo filed against the PDP, its former National Chiarman, Alhaji Adamu Muazu, INEC and Mrs. Uche Ekwunife. The plaintiff had in the suit he filed in 2014, told the court that he contested and won the primary election PDP conducted for the district held on December 7, 2014, at Ekwueme Square in Awka by scoring the highest number of votes cast at the said primary.

He said the primary was conducted by the National Executive Committee of the party. However, the plaintiff told the court that Chairman of the Electoral Panel that was sent to Anambra state to conduct the exercise, refused to sign and forward the Result Sheet of the primary poll and insisted that Abuja had directed them on whom they should return whether the Plaintiff scored the highest number of votes or not.

Dissatisfied with action of the party, the plaintiff filed the suit wherein he sought an interpretation of section 87 of the Electoral Act, 2010, by the court, even as he alleged breach of provisions of 2014 PDP Guidelines for primary election. The Plaintiff said he was aware that the Court of Appeal in Enugu had in an election petition No CA/EPT/28/2015, held that Ekwunife did not win the said primary election and was not qualified to contest the National Assembly Election.

He insisted that what the appellate court decided in the petition that was filed by Chief Victor Umeh of the All Progressives Grand Alliance, APGA, against the PDP, was what he equally went to court to challenge, to the effect that he was the the validly nominated candidate of the PDP that scored highest number of votes at the primary and not Ekwunife.

Meantime, after about three years into hearing of Okonkwo suit, all the defendants including Ekwunife, withdrew their objections to the suit, saying they would abide by the decision of the court. Consequently, Justice Tsoho agreed with counsel to the plaintiff, Chief Sebastine Hon, SAN, that in view of the withdrawal of counter-affidavits by all defendants, he said the court was at liberty under the law to enter judgment in Okonkwo’s favour. Justice Tsoho therefore granted relief three and sub-paragraph (i-iv) of the plaintiff’s amended originating summons dated June 20, 2017.

Specifically, the court granted: “An order that the Plaintiff/Applicant is the validly nominated candidate of PDP at the 7th December, 2014 PDP Primary Election to nominate its candidate for Anambra Central Senatorial District at Ekwueme Square Awka Anambra State whose Political Party (PDP) contested and won the National Assembly Election that was held on the 28th of March, 2015. “An order directing that INEC the 3rd Defendant/Respondent cancels the Certificate of Return (if any is subsisting) issued to the 4th Defendant/Respondent (Chief Mrs Uche Ekwunife). “An order that the 3rd Defendant/Respondent (INEC) issue a Certificate of Return to the Plaintiff/Applicant Dr Obiora Okonkwo forthwith as the Senator representing Anambra Central Senatorial District of Anambra State. As well as, “An order that the Senate President of the Federal Republic of Nigeria swear in the Plaintiff/Applicant Dr Obiora Okonkwo forthwith as the Senator representing Anambra Central Senatorial District of Anambra State in the Senate of National Assembly of the Federal Republic of Nigeria as there is no occupant of the said seat at the Senate at the moment”.

Justice Tsoho agreed with the plaintiff’s counsel that based on Supreme Court judgments, pre-election matters like the instant case take priority over decisions by election tribunals and other courts in election disputes based on a political seat already contested for. He said the court was not bound by section 87(9) or 151 of the Electoral Act, 2010.

It will be recalled that the Court of Appeal in Abuja had on November 20, ordered INEC to conduct a re-run election for Anambra Central Senatorial District within 90 days.

A three-member panel of the court headed by Justice Tinuade Akomolafe Wilson, gave the order while delivering judgment in a suit that was filed by APGA and its candidate, Chief Umeh. Umeh and his party filed the appeal to challenge the February 29 verdict of the Federal High Court in Abuja, which ordered the inclusion of PDP and its candidate, Ekwenife in the Anambra Central Senatorial re-run poll.

Anambra Central Senatorial seat has remained vacant since Ekwunife’s election was nullified. The Anambra State Election Petition Tribunal and the Court of Appeal sitting in Awka had in their concurrent judgments nullified the election that produced Ekwunife as Senator for the district in 2015, on the premise that she was not validly nominated. Both the tribunal and the appellate court directed INEC to conduct fresh re-run election in the district. Dissatisfied with the verdicts, Ekwunife who was formerly a member of APGA before she defected to the Peoples Democratic Party, PDP, took the case to the Supreme Court for redress. Ekwunife had since defected to the All Progressive Congress, APC.

On the 8th of September 2017, Major General D D Ahmadu, Chief Of Training And Operations of the Nigerian Army announced an exercise called Operation Python Dance II which he said was going to take place in the five South Eastern States to address "rampancy of assassinations, attack on security personnel, theft of weapons, violent agitations, armed banditry and kidnapping"

2. Operation Python Dance 1 has been on for quite a while in the South East. Whilst Operation Python Dance 1 lasted major roads, entries and exits of important cities in the South East had zigzag check points supervised by members of the Nigerian Army. They turned out to be toll gates used in extorting money under gun point from helpless motorists. Our people were shamelessly intimidated and harassed at these check points. Operation Python Dance 1 procured no arrests of criminals that were prosecuted for any of the criminal activities that Operation Python Dance II is supposed to address. Instead it witnessed reckless and indiscriminate murder of self determination agitators in Asaba,Aba,Nkpor,and Porthacourt numbering up to 191 by the estimates of Transparency International and shattered public confidence of South Easterners in the Nigerian Army and Police.

3 Operation Python Dance II announced to be launched for the five South Eastern states whose crime rates by Police statistics are not the highest in the country, turned out to focus on a tiny suburban road leading to the home of Mazi Nnamdi Kanu,the IPOB LEADER
Last night that road was visited by a combined team of Police and Military personnel with Armoured Personnel Carrier (APC) and armed personnel. Video posts from IPOB and the Nigerian Army did not indicate any act of disobedience before the invasion of this suburban environment. Contradictory versions of the encounter in this location came from both the Military/ Police and IPOB . Sparodic shots were fired at innocent civilians who had no firearms. Stones and bottles were pelted at the APC and military personnel. Which of the attacks preceded the other is not clear, but one was clearly disproportionate to the other and violated rules of military engagement in situations of this nature.

4 Ohaneze Ndigbo considers this development as unfortunate. We believe that it is a deliberate invasion of a quiet homestead, an act of provocation and a continuing policy of intimidation.
Crimes of monstrous proportions are occurring in other parts of Nigeria. Such crimes include ravaging killings by Fulani herdsmen in the Middle Belt, Secret cult killings in Lagos and the South West, bunkering and armed resistance in the Delta, wanton kidnappings and killing of military personnel in Kaduna State and environs as well as Boko Haram insurgency in the North East. The Nigerian Army has never embarked on Operation Python Dance in any of the other five geopolitical zones on account of these incidences. Innocent civilians living in these other parts of Nigeria have not witnessed the type of invasion Umuahia witnessed last night.

5 Ohaneze Ndigbo is left with no alternative than to conclude that this is a containment policy aimed at the South East to intimidate our people from freely expressing their anger and angst at their marginalization and treatment as second class citizens. In a democracy the level of disenchantment expressed by the people of the South East of Nigeria ought to have provoked a serious dialogue between our people and the Federal Executive and the Legislature. History teaches us that the continuous use of force to silence dissent and free speech will only accelerate the growth of dissent and dissatisfaction. Fundamental Rights of freedom of expression are critical for a successful democracy.

6 Ohaneze Ndigbo therefore calls on The Federal Government to call off this phoney Operation Python Dance II. Nigeria at this moment does not need such deliberate and proactive escalation of tensions and crisis. There are more civilised and established practices to resolve our democratic and security challenges.

Owoseni told newsmen at the Lagos State Police Command , Ikeja , that he was yet to receive any directive concerning a new police commissioner in the state .

“ When we get the information , we will let you know , ” Owoseni told journalists , in reaction to reports of his reassignment , which was published by some online media organisations .

Some online media organisations had reported that the Inspector General of Police , Ibrahim Idris , has appointed a new police commissioner for Lagos State .

Owoseni , on Wednesday , also spoke at a conference on security challenges in health institutions scientific Lagos University Teaching Hospital in his capacity as the Lagos police commissioner.

We are gathered here today to thank Chukwu for the work we did has yielded good produce. The work we did was that we cut yam, took some of it and planted in the soil. Few months later, it grew and produced bigger yams.

In our presence today, we have Oji n'ato (3 Kola nuts), Nzu (white chalk), Ego Oji (kola nut money), Ose Oji (alligator pepper), Mmaya (drinks), Ewu (goat), Efi (cow) and Ji (yam).

As we prepare this new yam into pounded yam, served with soup, we pray that as we eat it every sickness in our bodies shall leave.

As we eat this new yam, new things shall happen in our lives.

It shall be well with the Igbos on Eke, Oye, Afor and Nkwo.

Mazi Nnamdi Kanu pays a royal visit to Eri King, His Majesty Eze Chukwuemeka Eri, (Ezeora 34th) at his Obu-Gad Palace in Enugwu Aguleri.

One of the oldest dynasty in South eastern Nigeria in which the kingdom has produced over thirty four kings of Aguleri, up to the 18th century, and has continued, in recent times, up to now, to produce the ruler of Enugwu Aguleri.

The Ezeora Eri dynasty has remained powerful being the sacred holder of the Ofo Eri and as well occupying the throne of Eri at Obu-Gad in Enugwu Aguleri.

Obu-Gad (The Cradle of Ndigbo)

It is located in the present Anambra State.
